About approval of the Regulations on procedure for carrying out the state metrological supervision

For the purpose of regulation of the procedures connected with metrological supervision on execution of requirements of regulatory legal acts in the field of ensuring unity of measurements in the Kyrgyz Republic according to article 15 of the Law of the Kyrgyz Republic "About ensuring unity of measurements", articles 13, of the 17th constitutional Law of the Kyrgyz Republic "About the Cabinet of Ministers of the Kyrgyz Republic" the Cabinet of Ministers of the Kyrgyz Republic decides:

1. Approve Regulations on procedure for carrying out the state metrological supervision according to appendix.

2. Recognize to invalid:

1) the order of the Government of the Kyrgyz Republic "About approval of the Regulations on procedure for carrying out the state metrological supervision" of May 31, 2012 No. 350;

2) Item of 31 appendices to the order of the Government of the Kyrgyz Republic "About modification and amendments in some decisions of the Government of the Kyrgyz Republic" of July 1, 2013 No. 395;

3) Items 1 and 2 of the order of the Government of the Kyrgyz Republic "About modification and amendments in some decisions of the Government of the Kyrgyz Republic" of March 25, 2015 No. 153;

4) the order of the Government of the Kyrgyz Republic "About modification of the order of the Government of the Kyrgyz Republic "About approval of the Regulations on procedure for carrying out the state metrological supervision" of May 31, 2012 No. 350" of May 16, 2017 No. 286.

3. This resolution becomes effective after fifteen days from the date of official publication.

Regulations on procedure for carrying out the state metrological supervision

1. General provisions

1. In this Provision the following concepts are used:

1) the state metrological supervision - the activities performed by state body of the executive authority, specially authorized Cabinet of Ministers of the Kyrgyz Republic for implementation of check of observance of mandatory requirements of regulatory legal acts in the field of ensuring unity of measurements;

2) measurement - set of the transactions on use of the technical tool storing unit of physical quantity providing finding of ratio (in explicit or implicit type) the measured size with its unit and receipt of value of this size;

3) gage - the technical tool intended for measurements, having the normalized metrological characteristics;

4) alienation of goods are transactions in case of which goods pass from property of one subject (seller) into property of other subject (buyer). At the same time goods quantity is determined as a result of the procedure of measurements, and the price and cost are fixed;

5) packaged goods in packagings (further - ready packagings) - goods in packagings which pack up pack and seal in the absence of the consumer, at the same time content of packaging cannot be changed without its opening and deformation, and the weight, amount, length, the area or other sizes specifying quantity of the goods containing in packaging are designated on packaging.

2. The provision establishes procedure for carrying out the state metrological supervision (further - GMN) behind observance of requirements of regulatory legal acts in the field of ensuring unity of measurements, metrological rules and regulations in the field of the state regulation determined by the Law of the Kyrgyz Republic "About ensuring unity of measurements", authorized state body by metrological supervision (further - authorized body).

3. Basic principles of GMN:

1) presumption of conscientiousness of the checked business entities, that is the business entity is not recognized violated mandatory requirements and other conditions if other is not established;

2) openness and availability to business entities of the acts establishing mandatory requirements and conditions which observance is checked when carrying out GMN;

3) continuity and efficiency of carrying out GMN, that is its complete most bystry implementation during fixed term.

4. In authorized body:

- GMN is performed by structural division on metrological supervision (the head and specialists) (further - structural division on metrological supervision);

- GMN can be conducted independently by structural division on metrological supervision or together with other control supervisory authorities;

- GMN is carried out by the specialist of structural division in metrological supervision or the commission headed by one of specialists of the structural division in metrological supervision responsible for carrying out supervision.

The structure of the commission is determined by the head of authorized body by metrological supervision. Carrying out GMN requires order availability (the order, the instruction) on conducting check in the form provided in appendix 1 to this Provision.

5. The state metrological supervision is exercised for:

- release, condition and use of measuring instruments (further - the SI), including standard samples of structure and properties of substances (materials), observance of regulatory legal acts in the field of ensuring unity of measurements, metrological rules and regulations;

- goods quantity, the trading activities alienated when making, for the purpose of determination of the valid value of weight, amount, expense or other sizes and compliance to the realized quantity of these goods;

- by quantity of packaged goods in packagings of any kind in case of their packing, sale, import in cases when content of packaging cannot be changed without its opening or deformation, and the weight, amount, length, the area or other sizes specifying quantity of the goods containing in packaging are designated on packaging.

6. The state metrological supervision extends to the sphere of state regulation:

1) on health care, veterinary science;

2) on environmental protection, traffic circulation safety;

3) on providing safe conditions and labor protection;

4) on implementation of trading activities and mutual calculations between the producer (seller) and the consumer (buyer), when accounting energy and material resources regarding ensuring unity of measurements (electrical, heat energy, gas, water, etc.), except for the internal accounting which is carried out by the companies, the organizations and citizens - business entities;

5) on services of mail service and accounting of amount of the rendered services of telecommunication (duration of connection and amount of traffic);

6) on implementation of activities in the obligatory sphere of technical regulation.

7. Subject GMN in the field of health care, veterinary science, environmental protection, safety of traffic circulation, providing safe conditions and labor protection, trading activities and mutual calculations, services of mail service and accounting of amount of the rendered services of telecommunication (duration of connection and amount of traffic) are:

- availability of system of ensuring control of the applied SI;

- availability of person responsible for condition of the applied SI;

- availability of the approved schedule with indication of frequency of checking of the SI and control of their accomplishment;

- traceability of standards and SI;

- identification of standards and documentary registration of their metrological and technical characteristics;

- availability of conditions for work of standards and documentary drawn up rules of application and storage of standards;

- compliance of the uncertainty of measurements received as a result of calibration (checking) of standard, to the requirements determined by purpose of this standard;

- application of standards only as means of checking (calibration) or for interlaboratory checkings and for any other purposes;

- use of standards only by qualified personnel; appointment of personally responsible persons for standards;

- availability of the approved and acknowledged procedures for checking/calibration and use of standards;

- establishment of the intercalibrating (intertesting) intervals determined according to characteristics of standards;

- availability and completeness of the list of the SI used in the field of state regulation of ensuring unity of measurements;

- right of carrying out checking of the SI by forces of this legal entity;

- certification of techniques of accomplishment of the measurements used in the field of state regulation of ensuring unity of measurements;

- approval of type and checking of the SI used in the field of state regulation;

- compliance of condition of the SI and conditions of their operation to the established requirements for the form provided in appendix 2 to this Provision;

- availability of the documents confirming certification of persons performing checking as the verificator;

- availability of documents on checking and verification mark on the SI.

The above is checked in responsible divisions / persons of the ministries, in departments of business entities.

At the discretion of the specialist separate structural divisions of the ministries and business entities irrespective of pattern of ownership in the field of state regulation can be object of the state metrological supervision.

8. Subject GMN in the field of trade is:

- availability of system of ensuring control of the applied SI;

- availability of the responsible person behind condition of the applied SI;

- availability of the approved schedule with indication of frequency of checking of the SI and control of their accomplishment;

- condition and application of the SI, observance of regulatory legal acts in the field of ensuring unity of measurements, metrological rules and regulations;

- quantity of alienable goods upon control purchase, for the purpose of determination of the valid value of weight, amount, expense or other sizes and compliance to the realized quantity of these goods;

- quantity of packaged goods in packagings of any kind in case of their packing, sale, import in cases when content of packaging cannot be changed without its opening or deformation, and the weight, amount, length, the area or other sizes specifying quantity of the goods containing in packaging are designated on packaging;

- refining of the list of packaged goods in the packagings which are subject to GMN;

- refining of data on nominal quantity of consumer goods on labels (labels) or packagings, limit of permissible deviations, the name and the address of manufacturer and the company packer;

- refining of the regulating documentation regulating requirements to quantity of packaged goods in packaging;

- the organization of sampling of packaged goods for carrying out GMN with the subsequent return to business entity of the selected samples in the form provided in appendix 4 to this Provision;

- measurement of quantity of content net in the form provided in appendix 5 to this Provision.

In each individual packaging from among the selected samples of packaged goods on site of selection or if necessary, the selected packaged goods are transferred to accredited laboratories for carrying out measurements, and also the condition and correctness of use of measuring instruments, techniques of accomplishment and processing of results of measurements is checked.

The state metrological supervision of observance of metrological requirements to quantity of packaged goods in packagings of any kind shall be, whenever possible, organized so that the costs connected with conducting checks were minimum, in case of possibility of measurement of weight and density were made with use of indirect methods of measurements without opening packaging.

9. Subject GMN in the field of technical regulation, i.e. in case of development, acceptance, application and execution of mandatory requirements to products and/or the related design processes (including researches), productions, constructions, installation, adjustment, storage, transportation, realization, operation and utilization, and also in case of obligatory assessment of conformity, is:

1) availability of system of ensuring control of the applied SI;

2) availability of the responsible person behind condition of the applied SI;

3) availability of the approved schedule with indication of frequency of checking of the SI and control of their accomplishment;

4) traceability of standards and SI;

5) identification of standards and documentary registration of their metrological and technical characteristics;

6) availability of conditions for work of standards and documentary drawn up rules of application and storage of standards;

7) compliance of the uncertainty of measurements received as a result of calibration (checking) of standard, to the requirements determined by purpose of this standard;

8) application of standards only as means of checking (calibration) or for interlaboratory checkings and for any other purposes;

9) use of standards only by qualified personnel; appointment of personally responsible persons for standards;

10) availability of the approved and acknowledged procedures for checking/calibration and use of standards;

11) establishment of the intercalibrating (intertesting) intervals determined according to characteristics of standards;

12) availability and completeness of the list of the SI used in the field of state regulation of ensuring unity of measurements;

13) right of carrying out checking of the SI by forces of this legal entity;

14) certification of techniques of accomplishment of the measurements used in the field of state regulation of ensuring unity of measurements;

15) approval of type and checking of the SI used in the field of state regulation;

16) compliance of condition of the SI and conditions of their operation to the established requirements for the form provided in appendix 2 to this Provision;

17) availability of the documents confirming certification of persons performing checking as the verificator;

18) availability of documents on checking and verification mark on the SI.

10. Classification of objects (category of the objects) which are subject to GMN is subdivided on risk degree. The risk degree when implementing activities in the field of state regulation is determined depending on probability of damnification to citizens and economy of the Kyrgyz Republic owing to doubtful results of measurements.

The types of activity connected with measurements which results are used in case of belong to high risk:

- works on ensuring protection of life and health of citizens;

- works on safety of work and traffic circulation;

- control of state of environment;

- the state accounting transactions, trade and commercial transactions between the buyer (consumer) and the seller (the supplier, the producer, the contractor), including in spheres household and utilities and communication services.

The types of activity connected with measurements which results are used in case of belong to average risk degree:

- implementation of activities in geodesy, geology and hydrometeorology;

- arms production, military and special equipment, other types of special products;

- production, production, conversion, transportation, storage and consumption of all types of energy resources;

- testing, checking, calibration of the SI, the licensed activities;

- implementation of activities for assessment of conformity according to the legislation on technical regulation;

- the works performed on the order of state bodies, court and law enforcement agencies.

The types of activity connected with measurements which results are used in case of belong to insignificant risk degree:

- carrying out scientific research;

- registration of national and international sports records.

The subjects of checks in the field of state regulation of ensuring unity of measurements carried to degree high (80% of total quantity of the planned checks), average (15%) and insignificant (5%) risks join in the plan of checks.

2. Procedure and procedures of carrying out the state metrological supervision

11. The structural division on metrological supervision performing check of the packed-up goods quantity, trading activities alienated when making having the right to carry out GMN without preliminary notice.

In this case the specialist shows the order (the order, the instruction) on check and the official ID after implementation of control purchase.

When implementing control purchase the specialist shall take at least three names of goods.

Check of correctness of goods issue and the made calculations is carried out after receipt of the cash register receipt by the seller or cashier - cash and after transfer of goods to the buyer, and in self-service outlets - after receipt of money by the cashier and issue of the check and purchase, and the act in the form provided in appendix 3 to this Provision is drawn up.

The goods acquired by the specialist and announced by control purchase shall remain on counter or in case of check-out to challenge of the representative of administration.

In necessary cases in case of preponderating (peremerivaniye) they can be transferred to other place in the presence of the seller and the representative of administration.

Control measurements are performed on the operational, confided SI together with persons who sold goods.

12. When conducting checks the authorized body and business entities use documents:

- book of registration of inspection checks;

- notice on check;

- the order (the order, the instruction) of authorized body on check;

- act of results of audit of condition of the SI;

- the inspection statement of observance of the metrological regulations and rules in case of determination of goods quantity alienated when making trading activities;

- sampling report of ready packagings;

- protocol of measurement net ready packagings;

- act of metrological supervision (appendix 6);

- the instruction about elimination of violations of requirements of regulatory legal acts in the field of ensuring unity of measurements (appendix 7);

- the instruction about prohibition of application and release of the SI of the unconfirmed types which are not corresponding to the approved type, not confided or defective (appendix 8);

- the certificate of the taken measures for results of check (appendix 10);

- request of authorized body about submission of documents and information before GMN;

- notification on elimination of violations (appendix 9);

- request of business entity in authorized body;

- the reply of business entity to request of structural division on metrological supervision;

- claims of business entity to actions (failure to act) of authorized body and its officials.

The structural division on metrological supervision shall record all above-stated documents.

13. The structural division on metrological supervision of the signature of the head of authorized body shall send to business entity of the notice:

1) about the forthcoming scheduled inspection with reference to the approved plan of checks;

2) about approach or delay of completion dates of the obligations established by the law;

3) about correction of provided data and calculations;

4) about change of procedure and completion dates of the requirements of the legislation which are subject to check;

5) about briefings and the other information relating to relations of authorized body and business entity in any form.

3. Responsibility for violation and procedure for appeal of actions and decisions of bodies of the state metrological supervision

14. Structural division on metrological supervision and its officials in case of improper execution of the functions and service duties when carrying out the state metrological supervision bear responsibility according to the Code of the Kyrgyz Republic about offenses.

15. The procedure for appeal of actions and decisions of authorized body is performed according to the current legislation of the Kyrgyz Republic.

16. The business entity for violation of requirements of regulatory legal acts of the Kyrgyz Republic and technical regulations when implementing the activities, and also bears responsibility according to the Code of the Kyrgyz Republic about offenses for violation of this provision.
