1. Approve the enclosed Rules of import to the Russian Federation of seeds of agricultural plants for conducting examinations and research works, and also for use in the educational purposes.

2. Realization of the powers provided by this resolution is performed by the Ministry of Agriculture of the Russian Federation within the number of employees of the Ministry and budgetary appropriations provided to it in the federal budget on management and management in the field of the established functions established by the Government of the limiting Russian Federation.

3. To the Ministry of Agriculture of the Russian Federation till September 1, 2024:

provide technical readiness of federal state information system in the field of seed farming of agricultural plants to reception of applications on issue of confirmation of purpose of the imported seeds of agricultural plants for conducting examinations and research works, and also for use in the educational purposes arriving from the federal state information system "Single Portal of the State and Municipal Services (Functions)";

perform together with the Ministry of digital development, communication and mass communications of the Russian Federation development and placement in the federal state information system "Single Portal of the State and Municipal Services (Functions)" of the corresponding interactive application form in the procedure established by the legislation of the Russian Federation.

4. This resolution becomes effective since September 1, 2024 and is effective till September 1, 2030, except for Item 3, which becomes effective since September 1, 2023.

Rules of import to the Russian Federation of seeds of agricultural plants for conducting examinations and research works, and also for use in the educational purposes

1. These rules determine procedure for import to the Russian Federation of seeds of agricultural plants for conducting examinations and research works, and also for use in the educational purposes (further - import of seeds).

Provisions of these rules do not extend to the relations connected with import to the Russian Federation of seeds of agricultural plants from the states which are members of the Eurasian Economic Union.

2. Import of seeds is performed by the scientific organizations, the educational organizations, including the educational organizations of the higher education, for conducting examinations, research works, use in the educational purposes, and also other organizations for the purpose of conducting examinations.

3. Import of seeds by the organizations specified in Item 2 of these rules (further - the applicant), is performed in the presence of confirmation of purpose of the imported seeds of agricultural plants for conducting examinations and research works, and also for use in the educational purposes issued by the Ministry of Agriculture of the Russian Federation (further - confirmation).

4. For receipt of confirmation the applicant represents to the Ministry of Agriculture of the Russian Federation in the form of the electronic documents with use of the federal state information system "Single Portal of the State and Municipal Services (Functions)" (further - the single portal) the statement on issue of confirmation with application of documents specified in Item 5 of these rules.

The application on issue of confirmation is signed by the applicant with use of the strengthened qualified digital signature.

The statement on issue of confirmation in case of its signing by physical person or individual entrepreneur in case of representation of interests of the applicant (in the presence of the power of attorney confirming its powers) is signed with use of the strengthened unqualified digital signature which certificate of key of check is created and used in the infrastructure providing information and technological interaction of the information systems used for provision of the state and municipal services electronically, in accordance with the established procedure.

For issue of confirmation are specified in the statement:

the complete and reduced (in the presence) names of the applicant, the primary state registration number of record and date of entering into the Unified State Register of Legal Entities (in the presence), identification taxpayer number (in the presence), reason code of registration according to the certificate on registration in tax authority in the location (in the presence), the address within the location, the e-mail address (in the presence);

names of agricultural plants concerning which seeds confirmation, their codes (to the tenth sign of coding) according to the single Commodity nomenclature of foreign economic activity of the Eurasian Economic Union and amount of seeds of such agricultural plants is requested;

the name of sample of seeds of agricultural plant specified in the contract (contract) for delivery of seeds of agricultural plants for conducting examinations and (or) research works and (or) for use in the educational purposes providing their import to the territory of the Russian Federation (further - the contract (contract) for delivery of seeds) (in the presence), or appropriated by the applicant (in case of import of seeds without contract (contract) for delivery of seeds).

5. Electronic images of the following documents (the paper documents transformed to electronic form by scanning with preserving their details) are enclosed to the application on issue of confirmation:

a) copies of contracts (contracts) for delivery of seeds (in the presence);

b) notarized transfer of the contract (contract) for delivery of seeds into Russian (if the submitted documents (their verified copies) are constituted in foreign language).

6. The Ministry of Agriculture of the Russian Federation in time, not exceeding 5 working days from the date of receipt of the statement on issue of confirmation and the documents attached to it specified in Item 5 of these rules makes the decision on issue of confirmation or the decision on refusal in confirmation issue.

The decision on issue of confirmation is entering of record into federal state information system in the field of seed farming of agricultural plants.

7. The bases for refusal in issue of confirmation are:

a) discrepancy of the statement on issue of confirmation and documents to the requirements established by items 4 and 5 these rules;

b) availability in the statement on issue of confirmation of unreliable information.

8. The notification on refusal in issue of confirmation goes to the applicant in day of decision making about refusal in issue of confirmation in the automatic mode to personal account of the applicant on the single portal in electronic form signed by the strengthened qualified digital signature of the authorized officer of the Ministry of Agriculture of the Russian Federation.

9. The applicant has the right repeatedly according to the procedure, provided by items 4 and 5 these rules, to submit the statement for issue of confirmation and documents for consideration in the Ministry of Agriculture of the Russian Federation after elimination of the reasons which formed the basis for refusal in their consideration.

10. In case of disagreement with the decision on refusal in confirmation issue it can be disputed by the applicant within 3 months from the date of the direction of the notification on refusal in issue of confirmation by giving in the Ministry of Agriculture of the Russian Federation of the claim in electronic form with use of the single portal with observance of the requirements established by paragraphs second and third item 4 of these rules (further - the claim).

11. The claim is subject to consideration by the Ministry of Agriculture of the Russian Federation within 10 working days from the date of its registration.

12. Following the results of consideration of the claim Ministry of Agriculture of the Russian Federation accepts one of the following decisions:

a) leaves the claim without satisfaction;

b) cancels the decision on refusal in confirmation issue completely and makes the decision on issue of confirmation according to the paragraph the second Item 6 of these rules.

13. The decision on refusal in issue of confirmation following the results of consideration of the claim containing reasons for the made decision goes to the applicant in day of adoption of the relevant decision in the automatic mode to personal account of the applicant on the single portal in electronic form signed by the strengthened qualified digital signature of the authorized officer of the Ministry of Agriculture of the Russian Federation.

14. In case of lack of the bases for refusal in confirmation issue to the applicant in day of adoption of the relevant decision the statement from federal state information system in the field of seed farming of agricultural plants about confirmation of purpose of the imported seeds of agricultural plants for conducting examinations and research works, and also for use in the educational purposes in form according to appendix goes to personal account of the applicant on the single portal in the form of the electronic document signed by the strengthened qualified digital signature of the authorized officer of the Ministry of Agriculture of the Russian Federation.

Confirmation is effective during 1 year.

Information on the issued confirmations is brought to the attention of Federal Service for Veterinary and Phytosanitary Surveillance no later than the 2nd working day by means of use of single system of interdepartmental electronic interaction.

15. Import of seeds is performed at the check points through frontier of the Russian Federation intended for import to the Russian Federation of animals, products of animal origin, forages, feed additives, medicines for animals and the quarantine products (the quarantine material, quarantine freight) determined by the order of the Government of the Russian Federation of July 7, 2011 No. 557 "About determination of check points through frontier of the Russian Federation, intended for import to the Russian Federation of animals, products of animal origin, forages, feed additives, medicines for animals and quarantine products (quarantine material, quarantine freight)".

16. The imported seeds of agricultural plants shall conform to the quarantine phytosanitary requirements imposed to quarantine products and quarantinable objects on customs border and on customs area of the Eurasian Economic Union, established by the decision of Council of the Eurasian economic commission of November 30, 2016 No. 157 "About approval of the Single quarantine phytosanitary requirements imposed to quarantine products and quarantinable objects on customs border and on customs area of the Eurasian Economic Union" and also in the packaged condition to have label (label) which form is established by the Ministry of Agriculture of the Russian Federation according to part 2 of article 17 of the Federal law "About Seed Farming" on container (packaging).

If seeds of agricultural plants are processed by the chemical or biological medicines included in such seeds in the State catalog of the pesticides and agrochemicals allowed for use in the territory of the Russian Federation shall be in the packaged condition, and their container (packaging), labels (labels) shall have the corresponding texts and accompanying documents determining procedure for the address with such seeds and containing data on possible negative impacts on health of the person and the environment.

17. Import of seeds is allowed in the presence:

a) the contract (contract) for transportation (delivery) of seeds of agricultural plants for conducting examinations and (or) research works and (or) for use in the educational purposes concluded with the applicant having confirmation (if import of seeds is performed by carrier);

b) confirmations;

c) the accompanying documents containing data on names of grades and hybrids of plants, origin and quality of seeds (when importing seeds of agricultural plants in not packaged condition (in bulk), and also the accompanying documents determining procedure for the address with seeds and containing data on possible negative impacts on health of the person and the environment (if seeds of agricultural plants are processed by chemical or biological medicines).

18. For conducting examinations and research works import of seeds is forbidden:

a) processed by the chemical or biological medicines, pesticides which are not included in the State catalog of the pesticides and agrochemicals allowed for use in the territory of the Russian Federation in not packaged condition (in bulk);

b) without label (label) on container (packaging) in the form established by the Ministry of Agriculture of the Russian Federation according to part 2 of article 17 of the Federal law "About Seed Farming";

c) without the accompanying documents containing data on names of grades and hybrids of plants, origin and quality of seeds (when importing seeds of agricultural plants in not packaged condition (in bulk), and also without the accompanying documents determining procedure for the address with seeds and containing data on possible negative impacts on health of the person and the environment (if seeds of agricultural plants are processed by chemical or biological medicines);

d) processed by chemical or biological medicines, container (packaging) which labels (labels) have no corresponding texts.

19. For use in the educational purposes import of the seeds specified in Item 18 of these rules, and also seeds is forbidden:

a) which grades and hybrids are not included in the State register of grades and hybrids of the agricultural plants allowed to use (for grades and hybrids, childbirth and which types contain in the list of childbirth and types of agricultural plants which production and cultivation is aimed at providing food security of the Russian Federation, approved according to part 2 of article 19 of the Federal law "About Seed Farming");

b) containing the gene engineering modified organisms.
