Based on part two of article 5 of the Air code of the Republic of Belarus the Council of Ministers of the Republic of Belarus DECIDES:

1. Approve Rules of use of airspace of the Republic of Belarus (are applied).

2. This resolution becomes effective from the date of its acceptance.

Rules of use of airspace of the Republic of Belarus

Chapter 1. General provisions

1. These rules determine procedure for the organization of use of airspace of the Republic of Belarus (further if other is not determined, – airspace), and also procedure for its use for the benefit of citizens and economy, defense and safety of the state.

2. For the purposes of these rules terms and their determinations in the values established by the Air code of the Republic of Belarus and also the following terms and their determinations are used:

the emergency notification – the services of air traffic provided for the notification of the relevant organizations on the aircrafts needing the help of services of search and rescue, and rendering necessary assistance to such organizations;

automated management of air traffic – realization of process of management of air traffic by means of automated control system for air traffic or the automated workplace of air traffic control;

aerial photography – photo and video filming in all areas of optical spectrum of the Earth's surface and objects which are on it with use of the camera (video camera) established (established) on stabilization platform of the aircraft which is carrying out flight in airspace with fixing of the received image on any data carriers;

safe height – flight altitude excluding collision of the aircraft with land (water) surface or with obstacles in it;

extra route route – the route of flight of the aircraft passing out of routes of servicing of air traffic;

air situation – simultaneous relative positioning of aircrafts and other material objects in certain part of airspace;

the airway – the corridor limited on height and width in airspace intended for accomplishment of flights of aircrafts and equipped with controls, control and radio navigation;

airspace for accomplishment of flights along free routes (FRA) – part of controlled airspace of class C within which flights between the established and published points in the Minsk district of flight information on the trajectory as close as possible to the ortodromichesky line of way can be planned and be carried out;

airspace of servicing of air traffic – part of airspace of certain sizes with alphabetic reference within which certain types of flights can be carried out and for which servicing of air traffic and certain rules of flights are established;

the temporary mode of use of airspace of the Republic of Belarus (further – the temporary mode) – the special procedure for use of airspace established and entered by bodies of the Single system of air traffic management of the Republic of Belarus (further – the Single system) for a period of up to ten days for implementation of the activities for use of airspace requiring the special organization of this use;

the secondary radar – the radar-tracking system in which the radio signal transferred by radar station causes transfer of response radio signal by other station;

transition height – the established value of absolute height for transfer of scale of pressure of the barometric altimeter into standard pressure in case of set of the set echelon;

flight altitude – distance down from certain level to the aircraft. Depending on the level of reference mark differentiate heights – true (from the level of the point which is directly under the aircraft), relative (from the specified initial level) and absolute (from the average level of the sea);

the dispatching area – the part of controlled airspace established for provision of servicing of air traffic;

dispatching servicing of air traffic – the services of controlled flights provided for the purpose of prevention of collisions of aircrafts among themselves and other material objects in air with obstacles, including in the maneuvering area of airfield, maintenance of the arranged flow of air traffic, assistance to aircrafts, in distress;

dispatching permission – permission to the user of airspace to be effective in accordance with the terms, established by dispatching body;

the document of aeronautical information – the document containing the actual data concerning characteristics and actual state of airfields, airline hubs, elements of structure of airspace and means of radio engineering providing and communication necessary for the organization and accomplishment of flights;

the request for use of airspace of the Republic of Belarus (further – the request) – the document of the established sample containing necessary data for providing and accomplishment of activities for use of airspace;

zone of take off and landing – the part of airspace of the established sizes intended for maneuvering of aircrafts in case of take-off and landing approach;

the zone which is temporarily allocated – the part of airspace established by the center of the Single system in planning process and coordination of use of airspace;

zone of accomplishment of tasks of the state value – part of airspace of the established sizes within which during certain period of time actions for ensuring national security, safety of protected persons and protection of the protected objects against the threats connected with flights of aircraft or other activities for use of airspace are performed;

the prohibited area (UMP) – part of airspace of the established sizes within which use of airspace is forbidden, except as specified, provided by these rules;

zone, forbidden for flights of unmanned aerial vehicles (UMU), – part of airspace of the established sizes within which use of airspace unmanned aerial vehicles is forbidden, except as specified, provided by these rules;

zone of restriction (UMR) – part of airspace of the established sizes within which flights of aircraft are limited to the conditions determined by the Ministry of Defence;

the area danger (UMD) – part of airspace of the established sizes within which during certain period the activities posing safety hazard of flights of aircrafts can be performed;

zone flight – the part of airspace of the established sizes intended for task performance on flight;

zone special – the part of airspace of the established sizes intended for accomplishment of test flights, refueling in air, missiles launches, air firing practice and other special flights;

zone navigation – the navigation method allowing aircrafts to carry out flight on any trajectory within operation of radio beacon-type navigation aids or in the limits determined by opportunities of special autonomous means or their combinations;

controlled airspace – part of airspace of the established sizes within which dispatching servicing of air traffic according to classification of airspace is performed;

controlled flight – any flight which is carried out in the presence of dispatching permission;

coordination of use of airspace of the Republic of Belarus – administrative activities of bodies of the Single system within their competence on permission, approval, determination of the sequence and conditions of activities for use of airspace according to the state priorities in use of airspace (further – the state priorities), and also activities which can pose safety hazard of flights taking into account the entered temporary modes, the short-term restrictions predicted and the actual air, meteorological, ornithological situation and structure of airspace of the Republic of Belarus;

short-term restriction of use of airspace of the Republic of Belarus – the special procedure for use of separate parts of airspace established and enacted by the military sector of the center of the Single system duration till two o'clock for operational safety of use of airspace;

route – the projection of trajectory of flight of the aircraft to land (water) surface fixed by checkpoints (geographical coordinates of points) through which the aircraft shall fly by;

route of zone navigation – the route of servicing of air traffic established for aircrafts which can apply zone navigation;

route of servicing of air traffic – the established route which is intended for the direction of flow of movement of aircrafts for the purpose of servicing of air traffic. Routes of zone navigation, airways, local air-lines belong to route of servicing of air traffic;

local air-line – the corridor limited on height and width in airspace intended for flights of aircrafts at heights below the lower echelon and provided with servicing of air traffic;
