1. General provisions
1. These Regulations according to the Constitution of the Kyrgyz Republic, the constitutional Law of the Kyrgyz Republic "About the Cabinet of Ministers of the Kyrgyz Republic", the Presidential decree of the Kyrgyz Republic "About Administration of the President of the Kyrgyz Republic" of May 7, 2021 No. 134, Regulations of the Cabinet of Ministers of the Kyrgyz Republic (further - Regulations of the Cabinet of Ministers) provide the main requirements to procedure for preparation and introduction of drafts of acts of the President of the Kyrgyz Republic (further - the President), decisions of the Chairman of the Cabinet of Ministers of the Kyrgyz Republic - the Head of Administration of the President of the Kyrgyz Republic (further - the Chairman of the Cabinet of Ministers), preparation of drafts of acts of the Cabinet of Ministers of the Kyrgyz Republic (further - the Cabinet of Ministers) for introduction on cabinet meeting, to consideration of the documents arriving in Administration of the President of the Kyrgyz Republic (further - Presidential Administration).
The questions which are not settled by these Regulations are determined by Regulations of work with documents in Presidential Administration.
2. Responsibility for ensuring timely accomplishment of the made decisions and orders, high-quality preparation of materials, and also accounting and safety of documents in structural divisions of Presidential Administration (further - structural divisions) it is assigned to their heads.
3. Control of observance of requirements of Regulations of the Cabinet of Ministers, this Regulations and the Regulations of work with documents in Presidential Administration is performed by office of the President and the Presidential Administration Cabinet of Ministers (further - office of the President and the Cabinet of Ministers), management on preparation of decisions of the President and the Cabinet of Ministers, other structural divisions according to their competence.
2. Main requirements to procedure for preparation and introduction of drafts of acts of the President
4. The drafts of acts of the President prepared by state bodies before their entering into Presidential Administration are subject without fail to approval with:
- Ministry of Justice of the Kyrgyz Republic;
- The Ministry of Finance of the Kyrgyz Republic - on the questions providing reducing the income or increase in expenses of the state;
- The Ministry of Economy and Trade of the Kyrgyz Republic - on the questions directed to regulation of activities of subjects of entrepreneurship;
- other state bodies if projects contain the regulations concerning them competence.
Approval of drafts of acts of the President in state bodies shall not exceed the following terms from the date of their receipt:
- drafts of decrees - 6 working days;
- drafts of orders - 3 working days.
In need of urgent adoption of acts of the President according to orders of the President, Chairman of the Cabinet of Ministers, vice-chairmen of the Cabinet of Ministers, chiefs of managements of Presidential Administration shorter terms of approval can be established or the project can be approved at meeting in Presidential Administration by vising of the questionnaire by heads of state bodies.
5. Following the results of consideration of the draft of the act of the President the approving state body represents to the initiator the letter on approval of the project signed by the first head of state body with reflection of line item. If regulatory legal acts provide giving by the approving body of the conclusion, it is subject to signing by the first head of state body and encloses to the letter. In case of absence of the first heads of the letter (conclusion) can be signed by persons fulfilling their duties.
By results of approval the initiator of the draft of the act of the President has the right to finish the project taking into account the arrived notes and offers either not to consider them or to suspend further promotion of the project. Information on the considered and unaccounted notes and offers and reasons for the reasons of their not accounting is reflected in the reference reasons to the project.
Responsibility for accounting and not accounting of notes and offers is assigned to the head of state body which introduces the document in Presidential Administration.
6. The drafts of acts of the President introduced to Presidential Administration shall be followed by packet of the following documents:
- the cover letter addressed to the President, the Chairman of the Cabinet of Ministers or the supervising vice-chairman of the Cabinet of Ministers signed by the first head of the state body introducing the draft or person fulfilling its duties;
- the reference reasons to the project signed by the first head of the state body introducing the draft, or person fulfilling its duties, containing:
the data specified in the Law of the Kyrgyz Republic "About regulatory legal acts of the Kyrgyz Republic" and Instructions for project development of bylaws of the Kyrgyz Republic approved by the order of the Government of the Kyrgyz Republic of May 31, 2017 No. 313;
information on the considered and unaccounted notes and offers, reasons for the reasons of their not accounting;
financial and economic calculations;
- the comparative table (in case of introduction of amendments to the act);
- letters of state bodies on approval of the project, and also the conclusion of state bodies in cases, stipulated by the legislation the Kyrgyz Republic.
Drafts of acts of the President and accompanying documents are submitted to Presidential Administration in the state and official languages, on paper and electronic carriers. The draft of the act of the President and the reference reasons shall have identical headings and are drawn up on white paper of the A4 format by the Times New Roman font of 14 in size through unary line spacing with space of 1,25 of cm of the first line in the paragraph. The upper field of the draft of the act is established by limits of the form. In case of execution of the draft of the act on two and more pages the upper field of the second and the subsequent pages constitutes 2 cm, at the same time the left and right fields shall constitute 3 cm, lower - 2 cm.
Drafts of acts of the President shall be initialed (are signed) by the head of state body or person fulfilling its duties with indication of surname, initials and date. In case of exceeding of amount of the text of the draft of the act over ten typewritten pages are allowed putting down from reverse side of the document of seals of structural division of the body developer knowing clerical work questions.
7. The drafts of acts of the President introduced by state bodies to Presidential Administration are subject without fail to registration in the structural division of office of the President and the Cabinet of Ministers knowing clerical work questions (further - the structural division of office knowing clerical work questions), in day of their receipt.
The drafts of acts of the President introduced to Presidential Administration are transferred by the structural division of office knowing clerical work questions in day of their registration for consideration of the Chairman of the Cabinet of Ministers or vice-chairmen of the Cabinet of Ministers according to distribution of obligations.
