Criteria for evaluation of risk degree for selection of subjects (objects) of control in the field of energy saving and increase in energy efficiency

Chapter 1. General provisions

1. These Criteria for evaluation of risk degree in the field of energy saving and increase in energy efficiency (further – Criteria) are developed for selection of subjects (objects) of control according to Items 5 and 6 of article 141 of the Entrepreneurial code of the Republic of Kazakhstan and the order of the Minister of national economy of the Republic of Kazakhstan of December 14, 2022 No. 126 "About modification the order of the acting minister of national economy of the Republic of Kazakhstan of June 22, 2022 No. 48 "About approval of Rules of forming by regulatory state agencies of system of assessment and risk management and about introduction of amendments to the order of the acting minister of national economy of the Republic of Kazakhstan of July 31, 2018 No. 3 "About approval of Rules of forming by state bodies of system of risks assessment and form of checking sheets" (it is registered in the Register of state registration of regulatory legal acts at No. 31148).

2. In these Criteria the following concepts are used:

1) the state energy register - the systematized code of information on subjects of the State energy register;

2) subjects of the State energy register are the individual entrepreneurs and legal entities consuming energy resources in amount, equivalent one thousand five hundred and more tons of conditional fuel a year and also public institutions, subjects of the quasi-public sector and natural monopolies;

3) training center – the subject of entrepreneurship performing activities in the field of retraining and (or) advanced trainings of personnel in the field of energy saving and increase in energy efficiency;

4) customers – public institutions, and also the state companies, legal entities, fifty and more percent of voting shares (shares in the authorized capital) which belong to the state, and the legal entities affiliated with them, except for national managing holdings, national holdings, national managing companies and the legal entities affiliated with them;

5) authorized body – state body in the field of energy saving and increase in energy efficiency;

6) energy audit (further – energy audit) – collection, processing and data analysis about use of energy resources for the purpose of assessment of opportunity and energy saving potential and preparation of the conclusion on energy saving and increase in energy efficiency;

7) power auditing organization – the legal entity performing energy audit;
