About introduction of amendments to the order of the Minister of Agriculture of the Republic of Kazakhstan of June 29, 2015 No. 15-02/584 "About approval of phytosanitary standard rates, forms of phytosanitary accounting, and also Rules of their representation"

I ORDER:

1. Bring in the order of the Minister of Agriculture of the Republic of Kazakhstan of June 29, 2015 No. 15-02/584 "About approval of phytosanitary standard rates, forms of phytosanitary accounting, and also Rules of their representation" (it is registered in the Register of state registration of regulatory legal acts No. 11913) the following changes:

state preamble in the following edition:

"According to the subitem 15) of article 6 of the Law of the Republic of Kazakhstan "About protection of plants" and the subitem 2) of Item 3 of article 16 of the Law of the Republic of Kazakhstan "About the state statistics" I ORDER:";

to be reworded as follows the forms of phytosanitary accounting approved by the specified order according to appendix 1 to this order;

The rules of representation of forms of phytosanitary accounting approved by the specified order to be reworded as follows according to appendix 2 to this order.

2. To provide to committee of the state inspection in agro-industrial complex of the Ministry of Agriculture of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Agriculture of the Republic of Kazakhstan after its official publication.

3. To impose control of execution of this order on the supervising vice-Minister of Agriculture of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

It is approved Bureau of national statistics of the Agency on strategic planning and reforms of the Republic of Kazakhstan

Rules of representation of forms of phytosanitary accounting

Chapter 1. General provisions

1. These rules of representation of forms of phytosanitary accounting (further – Rules) are developed according to the subitem 15) of article 6 of the Law of the Republic of Kazakhstan "About protection of plants", the subitem 2) of Item 3 of article 16 of the Law of the Republic of Kazakhstan "About the state statistics" and determine procedure for representation of forms of phytosanitary accounting.

2. Forms of phytosanitary accounting are represented:

1) physical persons and legal entities which activities are connected with objects of the state phytosanitary control;

2) the state organizations performing activities in the field of protection of plants;

3) state inspectors on protection of plants.

3. Department of authorized body in the field of protection of plants is the Committee of the state inspection in agro-industrial complex of the Ministry of Agriculture of the Republic of Kazakhstan (further – Committee).

Chapter 2. Procedure for representation of forms of phytosanitary accounting

4. Physical persons and legal entities which activities are connected with objects of the state phytosanitary control (further – subjects of phytosanitary accounting) keep phytosanitary account on:

1) to production and (or) realization of pesticides, bioagents;

2) to movement of pesticides, bioagents;

3) to storage of pesticides, bioagents;

4) to carrying out the chemical processings performing use of pesticides, bioagents;

5) to neutralization of the prohibited, become useless pesticides and container from under them, and also container from under the used pesticides.

5. Subjects of phytosanitary accounting keep phytosanitary account and represent the phytosanitary reporting to district territorial subdivisions of Committee (further – district inspection) in forms according to appendix 2 to this order on production site, realization, applications, rendering services, movement, storage, neutralization of pesticides, bioagents, carrying out phytosanitary monitoring.

6. Forms of phytosanitary accounting are represented by subjects of phytosanitary accounting to district inspectorates for the following report types and to terms:

1) the report on production and (or) realization of pesticides, bioagents, the subjects of phytosanitary accounting performing based on the license production (formulyation), purchase and realization of pesticides, cultivation and realization of bioagents monthly from January to December, to the 10th day of every month following reporting;

2) the report on movement of pesticides, bioagents, two times a year, once till July 10 and once till January 10;

3) the report on storage of pesticides, bioagents annually, till January 10;

4) the report on carrying out chemical processings, the subjects of phytosanitary accounting performing use of pesticides, bioagents for production of own crop products, monthly, from March to October to the 5th day of every month following reporting;

5) the report on neutralization of the prohibited, become useless pesticides and container from under them, and also container from under the used pesticides the subjects of phytosanitary accounting performing neutralization of the prohibited, become useless pesticides and container from under them, and also container from under the used pesticides annually, till January 10.

7. Forms of phytosanitary accounting are represented by subjects of phytosanitary accounting to district inspections on paper or electronically. The filled forms of administrative data go to e-mail addresses of the district inspections specified on official Internet resource of Committee.

8. The district inspectorate keeps phytosanitary account based on the submitted phytosanitary reports by subjects of phytosanitary accounting, with the subsequent representation in regional, the cities of republican value, the capital territorial subdivisions of Committee (further – regional inspection) in forms according to appendix 2 to this order.

9. Forms of phytosanitary accounting are represented by the state inspector of district inspection to regional inspectorates for the following report types and to terms:

1) the report on production and (or) realization of pesticides, bioagents monthly, from January to December, to the 15th day of every month following reporting;

2) the report on movement of pesticides, bioagents two times a year, once till July 15 and once till January 15;

3) the report on storage of pesticides, bioagents annually, till January 15;

4) the report on carrying out chemical processings, monthly, from March to September, to the 10th day of every month following reporting;

5) the report on neutralization of the prohibited, become useless pesticides and container from under them, and also container from under the used pesticides annually, till January 15.

10. Based on the submitted phytosanitary reports the state inspector on protection of plants of regional inspection keeps phytosanitary account, with the subsequent submission to Committee.

11. Forms of phytosanitary accounting are represented by the state inspector of regional inspection to Committee on the following report types and to terms:

1) the report on production and (or) realization of pesticides, bioagents monthly, from January to December, to the 20th day of every month following reporting;

2) the report on movement of pesticides, bioagents two times a year, once till July 20 and once till January 20;

3) the report on storage of pesticides, bioagents annually, till January 20;

4) the report on carrying out chemical processings, monthly, from March to October, to the 15th day of every month following reporting;

5) the report on neutralization of the prohibited, become useless pesticides and container from under them, and also container from under the used pesticides annually, till January 20.

12. The state organizations performing activities in the field of protection of plants keep phytosanitary account and represent the phytosanitary reporting to Committee on report types and to the terms specified in Item 11 of these rules.
