About approval of Rules of implementation of verification of documents and data, survey and (or) examination of the goods moved through Frontier of the Republic of Kazakhstan with state members of the Eurasian Economic Union, and also forms of inspection reports and examination
According to Items 10 and 11 of article 28 of the Law of the Republic of Kazakhstan "About control of specific goods" I ORDER:
1. Approve enclosed:
1) Rules of implementation of verification of documents and data, survey and (or) examination of the goods moved through Frontier of the Republic of Kazakhstan with state members of the Eurasian Economic Union, according to appendix 1 to this order;
2) form of the inspection report of the goods moved through Frontier of the Republic of Kazakhstan with state members of the Eurasian Economic Union according to appendix 2 to this order;
3) form of the act of goods inspection, moved through Frontier of the Republic of Kazakhstan with state members of the Eurasian Economic Union, according to appendix 3 to this order.
2. Procedure to provide to committee of state revenues of the Ministry of Finance of the Republic of Kazakhstan in the established legislation of the Republic of Kazakhstan:
1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;
2) placement of this order on Internet resource of the Ministry of Finance of the Republic of Kazakhstan;
3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of Finance of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.
3. This order becomes effective after ten calendar days after day of its first official publication.

Appendix 1
to the Order of the Deputy. The deputy prime minister - the Deputy. The Minister of Finance of the Republic of Kazakhstan of March 27, 2023 No. 295
1. These rules of implementation of verification of documents and data, survey and (or) examination of the goods moved through Frontier of the Republic of Kazakhstan with state members of the Eurasian Economic Union (further – Rules) are developed according to Item 11 of article 28 of the Law of the Republic of Kazakhstan "About control of specific goods" (further – the Law) and determine procedure bodies of state revenues (further – OGD) verifications of the documents and data, survey and (or) goods inspection moved through Frontier of the Republic of Kazakhstan (further – Gosgranitsa) with state members of the Eurasian Economic Union (further – EEU).
2. The official of OGD when implementing verification of documents and data, compares the data containing in the provided physical persons and legal entities performing movement of goods, transport (transportation) and business documents:
1) with the data received from the information systems used by OGD;
2) with the data received by the methods which are not prohibited by the legislation of the Republic of Kazakhstan.
3. In the absence of the facts specifying illicit movement of specific goods, the official of OGD returns the provided documents to physical persons or representatives of the legal entity having powers concerning the goods moved through Gosgranitsa with state members of EEU, and in case of their absence – to physical persons, managing directors of the vehicle on which goods are transported.
4. In case of identification of the specific goods moved through Gosgranitsa with state members of EEU without the permission the official of OGD accepts according to Item 2 of article 27 of the Law the decision on prohibition of export, import or transit of specific goods (further – the Decision on prohibition).
5. The official of OGD brings the Decision on prohibition to the attention of the physical persons or representatives of the legal entity having powers concerning the specific goods moved through Gosgranitsa with state members of EEU, and in case of their absence – the physical persons managing the vehicle on which specific goods, by putting down of marks in the transport (transportation) document are transported.
6. Data from transport (transportation) documents are entered in the Magazine of registration of the facts of export, re-export, import and transit of specific goods, the official of OGD, in form according to appendix 1 to these rules in electronic form.
7. The official of OGD in case of establishment of the facts specifying availability of signs of offenses, responsibility for which is provided by the Code of the Republic of Kazakhstan about administrative offenses:
1) without delay in writing informs the head of OGD;
2) after completion of control and fixing of the elicited facts of violations takes measures according to article 463 of the Code of the Republic of Kazakhstan about administrative offenses.
8. The official of OGD in case of establishment of the facts specifying availability of signs of offenses, responsibility for which is provided by the Criminal Code of Kazakhstan:
1) without delay, and the law enforcement agency which competence includes conducting investigations according to the Code of penal procedure of the Republic of Kazakhstan in writing informs the head of OGD;
2) after completion of control and fixing of the elicited facts of violations directs materials to law enforcement agency which competence includes conducting investigations according to the Code of penal procedure of the Republic of Kazakhstan.
9. The bases for carrying out survey of the goods moved through Gosgranitsa with state members of EEU according to item 4 of article 28 of the Law are:
1) visual detection of specific goods on which when moving through Gosgranitsa with state members of EEU permissions were not provided;
2) recommendations of profiles of risk.
10. Time of the beginning of survey is time of the beginning of actions of the official of OGD for visual survey of packaging of goods or stowage space of the vehicle or reservoirs, containers and other places where there are or can be goods.
11. Inspection is performed in places of movement of goods and vehicles through Gosgranitsa with state members of EEU in the presence of the physical persons or representatives of the legal entity having powers concerning the goods moved through Gosgranitsa with state members of EEU, and in case of their absence – the physical persons managing the vehicle on which goods are transported.
12. Officials of OGD will see off survey of goods in the presence of two witnesses if:
1) the physical person managing the vehicle moving through Gosgranitsa with state members of EEU goods refused presence when carrying out survey;
2) there is threat of homeland security of the Republic of Kazakhstan, life and to health of the person, the environment and approaches of other circumstances, being urgent, including the signs specifying that goods are flammable substances, explosive objects, the explosive, poisoning, dangerous chemical and biological substances, toxic, toxic, radioactive materials, nuclear materials.
13. The official of OGD according to the subitem 2) of Item 2 of article 26 of the Law attracts state bodies of the Republic of Kazakhstan, the organization, experts and specialists to research of the questions requiring special knowledge and skills.
14. When implementing survey of goods by the official of OGD for the purpose of increase in its efficiency the technical means of control of specific goods (further – TSK) allowing to reveal necessary data on goods (their quantity, structure, physical and chemical properties, authenticity, availability of hiding places) are used.
In case of application of TSK officials of OGD observe necessary security measures for the purpose of non-admission of damnification of life and to human health, the environment, and also goods and vehicles.
15. The official of OGD when implementing survey of the goods moved through Gosgranitsa with state members of EEU according to the subitem 6) of Item 2 of article 26 of the Law makes video and audio recording, film and photographing of the facts and events according to procedure for use of technical means of control of the specific goods approved according to Item 3 of article 27 of the Law.
In case of production of video, film and photographings of survey of goods the official of OGD comments on all process, including time of the beginning and completion of survey, the venue of survey, surname, name and middle name (in case of its availability) (further – First name, middle initial, last name (in case of its availability)) and position of the official of OGD performing inspection and persons which are present at survey, actions for measurement of geometrical characteristics of goods, weighing of goods, recalculation, application of TSK, verification of presence and compliance of the imposed means of identification, results of survey.
Production of audio recording of survey is followed by photographing.
16. The official of OGD before application checks operability of the equipment for video and audio recording, film and photographings and TSK, level of charge of batteries (availability of the reserve, loaded batteries), availability of sufficient empty seat on the store, exposure of exact date and time in settings, and also in installation of optimum settings.
17. The video, film and photographing includes the general plan (appearance) of cargo section of the vehicle (container), fixing of its number and integrity of the imposed providing, and when carrying out survey of the goods placed on temporary storage, general view of placement of goods in the place of temporary storage, integrity of the imposed providing (in case of temporary storage of goods in the certain room).
The video, film and photographing of process of survey is made according to the following standard scheme:
fixing like the vehicle, its state registration number, the imposed utilities;
the fixing of extent of loading of the vehicle allowing to estimate extent (amount) of loading of the vehicle as a percentage of greatest possible), nature of cargo pieces and packaging of goods.
During implementation photo and video, filmings it is necessary to fix in full the main characteristics of goods allowing them to identify unambiguously.
Storage of video and audio recording, film and photographings in digital format is performed on the OGD servers.
18. The official of OGD following the results of implementation of survey of the goods moved through Gosgranitsa with state members of EEU without delay after completion draws up the inspection report in form, according to appendix 2 to this order.
19. The inspection report is drawn up in 2 (two) copies, one of which is handed to the physical persons or representatives of the legal entity having powers concerning the goods moved through Gosgranitsa with state members of EEU, and in case of their absence – to the physical persons managing the vehicle on which the specific goods moved through Gosgranitsa with state members of EEU are transported.
20. With participation in carrying out survey of officials of other state bodies, in the Inspection report the information about such persons is reflected.
21. Are put to the Inspection report:
survey photographic materials (familiarizing of the digital carrier of these materials) (depending on the used technical means is in addition allowed);
video records of survey (depending on the used technical means);
copies of the documents confirming powers of specialists (in case of their attraction) and the officials of other state bodies participating or who are present at survey;
copies of identity documents of persons which are present at survey;
other documents processed during implementation of survey and having relation to it.
All documents and data containing on paper attached to the Inspection report are integral part of the Inspection report.
22. Results of survey by the official are registered registration of inspection reports and examination of the goods moved through Frontier of the Republic of Kazakhstan with state members of the Eurasian Economic Union in form according to appendix 2 to these rules (further – the Magazine of registration of acts).
23. In case of identification of the specific goods moved through Gosgranitsa with state members of EEU without the permission the official of OGD makes the decision on prohibition of movement of these goods and performs actions according to Items 5, of 6, of 7 and 8 these rules.
24. The bases for carrying out examination are:
1) information availability from state bodies of the Republic of Kazakhstan about potential risk of movement of specific goods without the permission;
2) recommendations of profiles of risk.
25. Time of the beginning of examination is time of the beginning of actions of the official of OGD for visual survey of packaging of goods or stowage space of the vehicle or reservoirs, containers and other places where there are or can be goods.
26. Examination is carried out in places of movement of goods and vehicles through Gosgranitsa with state members of EEU in the presence of the physical persons or representatives of the legal entity having powers concerning the goods moved through Gosgranitsa with state members of EEU, and in case of their absence – the physical persons managing the vehicle on which goods are transported.
27. The official of OGD carries out examination in the presence of two witnesses if:
1) the physical person or the representative of the legal entity having powers concerning the goods moved through Gosgranitsa with state members of EEU and also the physical person managing the vehicle on which goods are transported refused presence when carrying out examination;
2) there is threat of homeland security of the Republic of Kazakhstan, life and to health of the person, the environment and approaches of other circumstances, being urgent, including the signs specifying that goods are flammable substances, explosive objects, the explosive, poisoning, dangerous chemical and biological substances, toxic, toxic, radioactive materials, nuclear materials.
28. The official of OGD according to the subitem 2) of Item 2 of article 26 of the Law attracts state bodies of the Republic of Kazakhstan, the organization, experts and specialists to research of the questions requiring special knowledge and skills.
29. When implementing examination by the official of OGD for the purpose of increase in its efficiency the different types of TSK allowing to reveal necessary data on goods (their quantity, structure, physical and chemical properties, authenticity, availability of hiding places) are applied.
In case of application of TSK officials of OGD observe necessary security measures for the purpose of non-admission of damnification of life and to human health, the environment, and also goods and vehicles.
30. The official of OGD when implementing examination of the goods moved through Gosgranitsa with state members of EEU according to the subitem 6) of Item 2 of article 26 of the Law makes video and audio recording, film and photographing of the facts and events according to procedure for use of technical means of control of the specific goods approved according to Item 3 of article 27 of the Law.
In case of production of video and audio recording, examination filming the official of OGD comments on all process, including time of the beginning and completion of examination, the venue of examination, First name, middle initial, last name (in case of its availability) and position of the official who is carrying out examination and persons which are present at examination all performed operations, results of examination.
Production of audio recording of examination is followed by photographing.
Production of video and audio recording, filming for implementation of handling works stops with the corresponding comment of the official of OGD performing examination on time of suspension (renewal) of examination and the basis of suspension.
31. The official of OGD before application checks operability of the equipment for video and audiozapiya, film and photographings and TSK, level of charge of batteries (availability of the reserve, loaded batteries), availability of sufficient empty seat on the store, exposure of exact date and time in settings, and also in installation of optimum settings.
32. The video, film and photographing includes the general plan (appearance) of cargo section of the vehicle (container), fixing of its number and integrity of the imposed providing, and when implementing survey of the goods placed on temporary storage, general view of placement of goods in the place of temporary storage, integrity of the imposed providing (in case of temporary storage of goods in the certain room).
The video, film and photographing of process of examination is made according to the following standard scheme:
fixing like the vehicle, its state registration number, the imposed utilities;
the fixing of extent of loading of the vehicle allowing to estimate extent (amount) of loading of the vehicle as a percentage of greatest possible), nature of cargo pieces and packaging of goods;
fixing of unloading of goods from the vehicle (in case of partial unloading of goods – allowing to estimate percentage of the goods unloaded from the vehicle in relation to not unloaded):
fixing of the unloaded part of goods is made so that the possibility of identification of quantity or amount of actually unloaded goods was provided;
fixing of not unloaded part of goods, or in case of complete unloading of empty compartment of the vehicle with availability of the data allowing to identify the vehicle (state registration number of the vehicle);
fixing of disassembly (opening) of cargo pieces and examination of their content.
During photo and video, filming it is necessary to fix in full the main characteristics of goods allowing them to identify unambiguously.
Storage of pictures (videos) in digital format is performed on the OGD servers.
33. When implementing examination the goods are subject to unloading from the vehicle.
If the vehicle is loaded by exclusively homogeneous goods (goods of one code of the Commodity nomenclature of the foreign economic activity approved by the Decision of Council of the Eurasian economic commission of September 14, 2021 No. 80, at the level of ten signs), partial unloading of goods, by formation of pass like "corridor", on all length of cargo section of the vehicle is performed.
Unloading is not performed on the goods moved with embankment, pile or in bulk.
34. Examination is performed by the official of OGD:
1) by recalculation of all cargo pieces, with opening of packaging of goods, recalculation and weighing it is exclusive 1 (one) copy of each type of packaging of goods, with the subsequent determination of quantity and weight of all batch in the settlement way in the relation:
the homogeneous goods which are in identical packagings with identical marking;
the goods which are exposed to bystry spoil;
2) by opening of cargo section of the vehicle with carrying out video filming of its content (without unloading of goods from the vehicle) or video filming of the goods placed in the place of temporary storage concerning stated below types of goods:
delivered according to international treaties of the Republic of Kazakhstan, to the international organizations which underwent accounting registration in the Republic of Kazakhstan;
the delivered for the purpose of natural disaster response, emergency situations of natural and technogenic nature;
moved and intended for official use by diplomatic representations and consular establishments, international organizations and (or) their representations, representative offices of the states under the international organizations located in the territory of the Republic of Kazakhstan;
the vehicles declared in goods quality;
substances which pose threat for life and health of the officials who are carrying out examination, and requiring special knowledge and (or) equipment;
large-size and heavyweight goods on which transportation there is special permission issued according to the order of the Minister of investments and development of the Republic of Kazakhstan of February 27, 2015 to No. 206 "About approval of Rules of the organization and implementation of transportations of bulky and heavy loads in the territory of the Republic of Kazakhstan" (it is registered in the Register of state registration of regulatory legal acts at No. 11395).
35. Opening of packaging is made by the official of OGD in the presence of the physical persons or representatives of the legal entity having powers concerning the goods moved through Gosgranitsa with state members of EEU, and in case of their absence – the physical persons managing the vehicle on which goods are transported.
In the absence of the physical persons or representatives of the legal entity having powers concerning the goods moved through Gosgranitsa with state members of EEU, also physical persons managing the vehicle on which goods are transported opening of packaging it is made by OGD authorized officer in the presence of two witnesses.
36. Opening of cargo pieces provides violation of their integrity and means of their identification with the subsequent extraction of separate units of goods from their packaging (boxes, boxes), from technological reservoirs, specially made hiding places for receipt of possibility of control of quantity and the name, determination of country of source and receipt of other data on goods, identification of the goods moved under the guise of other goods.
When implementing examination for the purpose of identification of the specific goods hidden from control by drawing on surface of the hidden goods of paint coats, metals, other materials or by investment of goods in specially made non-demountable hiding places, and also determinations of chemical composition of goods, their physical properties by the official of OGD cutting, grinding, cutting and opening of design is performed.
37. In case of insufficiency of data on characteristics of goods and lack of certain knowledge, for identification of goods, the official of OGD sends inquiry to authorized body in the field of control of specific goods, for receipt of the conclusion about identification of specific goods issued based on the subitem 8) of article 8 of the Law.
38. In case of interruption of process of examination owing to the objective reasons (break, the termination of working hours) the official of OGD takes the measures aimed at providing safety of goods in steady-state condition including by imposing of funds of identification for cargo pieces, vehicles or rooms where there are goods.
39. The official of OGD following the results of implementation of examination of the goods moved through Gosgranitsa with state members of EEU, without delay after completion draw up the statement of examination in form, according to appendix 3 to this order.
40. The statement of examination is drawn up in 2 (two) copies, one of which is handed to the physical persons or representatives of the legal entity having powers concerning the goods moved through state border with state members of EEU, and in case of their absence – to the physical persons managing the vehicle on which the specific goods moved through Gosgranitsa with state members of EEU are transported.
41. With participation in implementation of examination of officials of other state bodies, in the Act of examination the information about such persons is reflected.
42. Are put to the Act of examination:
models of the marking which is available on packaging of goods, labels, labels and other means of identification of goods (in the presence);
examination photographic materials (familiarizing of the digital carrier of these materials) (depending on the used technical means is in addition allowed);
video records of examination (depending on the used technical means);
copies of the documents confirming powers of specialists (in case of their attraction) and the officials of other state bodies participating or who are present at examination;
copies of identity documents of persons which are present at examination;
other documents processed during implementation of examination and having relation to it.
All documents and data containing on paper attached to the Act of examination are integral part of the Act of examination.
43. Results of examination of acts by the official are registered registration of acts.
44. In case of identification of the specific goods moved through Gosgranitsa with state members of EEU without the permission the official of OGD makes the decision on prohibition of movement of these goods and performs actions according to Items 5, of 6, of 7 and 8 these rules.
