About questions of consideration, preparation and cancellation of acts of separate bodies of the Eurasian Economic Union

For the purpose of implementation of the Agreement on the Eurasian Economic Union of May 29, 2014 and the Regulations of work of the Eurasian economic commission approved by the Decision of the Supreme Eurasian economic council of December 23, 2014 No. 98, Council of Ministers of the Republic of Belarus DECIDES:

1. Approve:

Regulations of consideration of documents and materials, preparation of line items for meetings of the Supreme Eurasian economic council, Eurasian intergovernmental council (are attached);

Regulations of consideration of documents and materials, preparation of the generalized line items for meetings of Council of the Eurasian economic commission (are attached);

Regulations of consideration of documents and materials, preparation of the generalized line items for meetings of Board of the Eurasian economic commission (are attached);

The regulations of preparation of initiative offers for consideration at meetings of Board and (or) Council of the Eurasian economic commission, Eurasian intergovernmental council, the Supreme Eurasian economic council (are attached);

The regulations of preparation of offers on cancellation or change of the decisions made by Board of the Eurasian economic commission (are attached).

2. For the purposes of this resolution the following terms and their determinations are used:

the coordinating body – the republican state body authorized by the Government of the Republic of Belarus on implementation of coordination of work in the Republic of Belarus concerning functioning of the Eurasian Economic Union (further, unless otherwise specified, – EEU), interactions with the Eurasian economic commission (further, unless otherwise specified, – ECE);

regulating authorities – the republican state bodies and other organizations subordinated to the Government of the Republic of Belarus and also other state bodies and the organizations realizing state policy on the fields of activity of ECE assigned to them according to appendix;

the member of council of ECE from the Republic of Belarus – the official given the President of the Republic of Belarus authority of the representative from the Republic of Belarus in Council of ECE.

3. Determine that:

3.1. member of council of ECE from the Republic of Belarus:

approves the generalized line items concerning the agenda of meeting of Council of ECE, if necessary approves them with the Prime Minister of the Republic of Belarus;

makes the final decision according to matters of argument in case of disagreements between coordinating and regulating authorities;

in case of need can establish other terms of preparation of materials for meetings of the Supreme Eurasian economic council (further, unless otherwise specified, – the Supreme council), Eurasian intergovernmental council (further, unless otherwise specified, – Intergovernmental council), Council of ECE and Board of ECE;

performs other functions according to this resolution;

3.2. the coordinating body is the Ministry of Economics;

3.3. the coordinating body:

has the right to convene coordination meetings on functioning of EEU, interactions with ECE, participation in which is obligatory for regulating authorities;

has the right to request required materials from the interested state bodies (organizations) for functioning of EEU, interaction with ECE, including on the questions which are not determined in the fields of activity of ECE assigned to regulating authorities according to appendix;

returns on completion to regulating authorities the materials brought by them prepared in an inadequate way;

submits for consideration of the member of council of ECE from the Republic of Belarus the decision developed by it according to matters of argument in case of disagreements with regulating authorities;

agrees if necessary on matters of argument with the Deputy prime minister of the Republic of Belarus;

determines need of approval of the generalized line items concerning the agenda of meetings of Council of ECE with the Prime Minister of the Republic of Belarus and the relevant proposal brings to the member of council of ECE from the Republic of Belarus;

independently determines order of interaction with ECE in each case;

performs interaction with Embassies of the Republic of Belarus in state members of EEU;

performs preparation of materials for participation of the member of council of ECE from the Republic of Belarus in meetings of Council of ECE according to Regulations of consideration of documents and materials, preparation of the generalized line items for the meetings of Council of the Eurasian economic commission approved by this resolution;

performs other functions according to this resolution;

3.4. regulating authorities:

perform development and entering into the Ministry of Foreign Affairs of materials concerning the agenda of meetings of the Supreme council, Intergovernmental council according to Regulations of consideration of documents and materials, preparation of line items for the meetings of the Supreme Eurasian economic council, Eurasian intergovernmental council approved by this resolution;

perform development and entering into the coordinating body of materials concerning the agenda of meeting of Council of ECE and line items concerning the agenda of meeting of Board of ECE according to Regulations of consideration of documents and materials, preparation of the generalized line items for meetings of Council of the Eurasian economic commission and the Regulations of consideration of documents and materials, preparation of the generalized line items for meetings of Board of the Eurasian economic commission approved by this resolution;

agree if necessary on matters of argument with the Deputy prime minister of the Republic of Belarus;

introduce in accordance with the established procedure in Council of Ministers of the Republic of Belarus the project of record of sentence on the questions specified in paragraphs the second or fifth item 4 of this resolution on which signing of decisions of Council of ECE requires approval of Presidium of Council of Ministers of the Republic of Belarus;

if necessary introduce for consideration at meetings of Board and (or) Council of ECE initiative offers according to the Regulations of preparation of initiative offers for consideration at meetings of Board and (or) Council of the Eurasian economic commission, Eurasian intergovernmental council, the Supreme Eurasian economic council approved by this resolution;

carry out monitoring of the acts adopted by the Supreme council, Intergovernmental council, Council and Board of ECE in fields of activity in which are authorized to realize state policy, and also in the fields of activity of ECE assigned to regulating authorities according to appendix regarding compliance of such acts to national interests, practice and effects of their application;

if necessary make offers on cancellation or change of decisions of Board of ECE according to Regulations of preparation of offers on cancellation or change of the decisions made by Board of the Eurasian economic commission, the approved this resolution;

provide creation on the official sites on the global computer Internet of the special Sections devoted to EEU on which if necessary place references to the acts of the Supreme council, Intergovernmental council, Council and Board of ECE posted on the website ECE, and the comment to these acts which are within their competence;

perform other functions according to this resolution;

3.5. The Ministry of Foreign Affairs performs preparation of documents and materials for participation of the President of the Republic of Belarus, the Prime Minister of the Republic of Belarus in meetings of the Supreme council, Intergovernmental council based on the materials prepared by regulating authorities according to Regulations of consideration of documents and materials, preparation of line items for the meetings of the Supreme Eurasian economic council, Eurasian intergovernmental council approved by this resolution.

4. Determine that line items according to drafts of the decisions made by Council of ECE are subject without fail to approval of Council of Ministers of the Republic of Belarus by Presidium if raise the questions:

customs and tariff regulation, including establishment and change of rates of import customs duties concerning goods items;

provisions of privileges on customs duties, full conditional release of temporarily imported goods from customs duties, taxes, including conditions of such release and its deadlines;

establishments of the tariff quotas, and also distributions of amounts of the tariff quotas for commodity importation in the territory of state members of EEU;

introductions and applications on customs area of EEU concerning the third countries of single measures of non-tariff regulation, special protective, anti-dumping and countervailing measures, decision making about application of measures of protection of the domestic market on bilateral basis, other than special protective, anti-dumping and countervailing measures, including concerning import of agricultural goods if the international treaty of EEU with the third party about establishment of free trade regime provides the right to application of the specified measures.

5. To the republican state bodies and other organizations subordinated to the Government of the Republic of Belarus, and also other state bodies and the organizations to take measures for implementation of this resolution.

6. To make to the Ministry of Economics, the Ministry of Foreign Affairs explanations concerning application of this resolution.

7. Recognize invalid:

the resolution of Council of Ministers of the Republic of Belarus of September 27, 2016 No. 772 "About questions of consideration, preparation and cancellation of acts of separate bodies of the Eurasian Economic Union";

the resolution of Council of Ministers of the Republic of Belarus of February 9, 2019 No. 80 "About modification and amendments in the resolution of Council of Ministers of the Republic of Belarus of September 27, 2016 No. 772".

8. This resolution becomes effective after its official publication.
