The Cabinet of Ministers of Ukraine decides:

1. Approve the ensuring separate categories of the population with technical and other means of rehabilitation and forming of the corresponding state order enclosed the Procedure, the list of such means.

2. This resolution becomes effective since January 1, 2007.

Procedure for ensuring separate categories of the population with technical and other means of rehabilitation and forming of the corresponding state order

General part

1. This Procedure determines the mechanism:

free ensuring separate categories of the population with technical and other means of rehabilitation;

forming, placements and financings of the state order on production, delivery and repair of technical and other means of rehabilitation.

Action of this Procedure does not extend to persons whose disability is connected with labor mutilation which was caused by labor accident or occupational disease which procedure for ensuring rehabilitation with technical and other means is established by board of Social Insurance Fund from labor accidents and occupational diseases.

2. Treat technical and other means of rehabilitation:

means for movement;

special means for self-service and leaving;

special means for orientation, communication and exchange of information;

prosthetic products (including prosthetic and orthopedic products, orthopedic footwear).

Disabled people and handicapped children are provided with technical and other means of rehabilitation. Noted means (except means for movement) provide also children aged up to 18 years with shortcomings of hearing, sight, the musculoskeletal device (to dalshedet aged up to 18 years).

Veterans of military service, veterans of law-enforcement bodies and veterans of the state fire protection are provided with prosthetic and orthopedic products and special means for self-service and leaving which are obligatory for application in case of providing with prosthetic products.

Women after mastectomy are provided with prostheses of mammary glands, bodices, compression sleeves.

Persons of advanced years are provided with prostheses of the upper and lower extremities and special means for self-service and leaving which are obligatory for application in case of providing with prosthetic products.

3. Disabled people, handicapped children, children aged up to 18 years, veterans of military service, veterans of law-enforcement bodies and veterans of the state fire protection, persons of advanced years, women after mastectomy (further - disabled people and other persons) have the right to free ensuring rehabilitation with technical and other means according to the Laws of Ukraine "About bases of social security of disabled people in Ukraine", "About child care", "About the status of veterans of war, guarantees of their social protection", "About the status of veterans of military service, veterans of law-enforcement bodies and some other persons and their social protection", "About rehabilitation of disabled people in Ukraine", "About general secondary education" and "About the basic principles of social protection of veterans of work and other citizens of advanced years in Ukraine".

4. Disabled people, handicapped children and children aged up to 18 years are provided with technical means of rehabilitation without the right of their sale, donation and transfer during the term for which such means is issued.

5. Technical and other means of rehabilitation for free providing disabled people and other persons at the expense of means of the government budget are produced, delivered and repaired by business entities, their separated structural divisions which statutory provisions provide production, delivery and repair of noted means and which received according to the legislation the corresponding state order (further - the companies).

Requirements concerning the organization of production technical and other means of rehabilitation, evaluating their quality are determined by the legislation.

6. Disabled people and other persons are provided with technical and other means of rehabilitation at the expense of the means of the government budget provided to Social Security Fund of disabled people on noted purpose.

In case when there is need for difficult prosthetics, cost of prosthetic and orthopedic products which list is approved by Minsotspolitiki, is paid at the expense of means which arrived as a result of application of administrative sanctions of Social Security Fund of disabled people. The issue of cost recovery of the product made for the disabled person is resolved by the head of territorial department of noted fund within estimate appointments by the conclusion of the contract with the company.

Persons whose disability is connected with the labor mutilation which was caused labor accident or occupational disease are provided with technical and other means of rehabilitation by fund of social insurance from labor accidents and occupational diseases, and those from them which are not subject to ensuring rehabilitation with technical and other means by fund, are provided with such means according to this Procedure based on the certificate of territorial department of Fund of refusal in providing with noted means.

7. Day of receipt of technical and other tool of rehabilitation day of its issue in use to the disabled person and other person, and in case of departure by mail - the day celebrated in the notification on its delivery to the disabled person and other person, their legal representatives is considered.

8. Need for ensuring rehabilitation with technical and other means is determined:

disabled people - medico-social commissions of experts (MSEK) with execution of the individual program of rehabilitation;
