CONSTITUTIONAL LAW OF THE REPUBLIC OF UZBEKISTAN

About the Constitution of the Republic of Uzbekistan

This Constitutional Law of the Republic of Uzbekistan is adopted by national vote on the referendum of the Republic of Uzbekistan held on April 30, 2023.

Article 1. Bring in the Constitution of the Republic of Uzbekistan adopted on December 8, 1992 at the eleventh session of the Supreme Council of the Republic of Uzbekistan of the twelfth convocation (Sheets of the Supreme Council of the Republic of Uzbekistan, 1993, No. 1, Art. 4; 1994, No. 1, Art. 5; Sheets of Oliy Majlis of the Republic of Uzbekistan, 2003, No. 3-4, of Art. 27; Sheets of chambers of Oliy Majlis of the Republic of Uzbekistan, 2007, No. 4, Art. 162; 2008, No. 12, Art. 637; 2011, No. 4, Art. 100, No. 12/1, Art. 343; 2014, No. 4, Art. 85; 2017, No. 4, Art. 134, No. 5, Art. 200, No. 8, Art. 383; 2018, No. 10, Art. 674; 2019, No. 2, Art. 47, No. 3, Art. 162, No. 9, Art. 588; 2021, No. 2, the Art. of the Art. 139, of 140), changes and amendments, having approved its following new edition (appendix is applied).

Article 2. This Constitutional Law becomes effective from the date of official publication of results of referendum by Central Election Commission of the Republic of Uzbekistan.

Article 3. The laws and other regulatory legal acts existing in the territory of the Republic of Uzbekistan before entry into force of this Constitutional Law are applied in the part which is not contradicting the Constitution of the Republic of Uzbekistan in edition of this Constitutional Law.

Article 4. Regulations of the Constitution of the Republic of Uzbekistan in edition of this Constitutional Law are effective directly from coming into force of this Constitutional Law and irrespective of acceptance or availability of the relevant laws and other regulatory legal acts.

Article 5. The legislative house and the Senate of the Oliy Majlis of the Republic of Uzbekistan of the operating convocation perform the activities according to the powers provided by the Constitution of the Republic of Uzbekistan in editions of this Constitutional Law from the moment of its introduction in force.

Provisions of part three of article 92 of the Constitution of the Republic of Uzbekistan in the editions of this Constitutional Law establishing the number of the elected (appointed) members of the Senate of the Oliy Majlis of the Republic of Uzbekistan, become effective since the beginning of forming of the Senate of the next convocation in 2024.

Article 6. Due to the need of preparation of the corresponding regulatory framework, ensuring succession and going concern of representative and executive bodies of the government on positions of part three of article 120 of the Constitution of the Republic of Uzbekistan in the editions of this Constitutional Law providing that person holding position of hokim of area, area, city cannot hold at the same time position of the chairman Kengash of People's Deputies become effective in the relation:

representative and executive bodies of the government of areas and the city of Tashkent - following the results of regular elections of deputies regional and Tashkent city Kengasha of People's Deputies in 2024;

representative and executive bodies of the government of areas and the cities - since January 1, 2026.

Article 7. The provisions of this Constitutional Law changing and (or) otherwise the mentioning terms of office, procedure and (or) conditions of election (appointment) of officials of the government, are applied to persons holding these positions at the time of entry into force of this Constitutional Law, and these persons have the right to be elected (to be appointed) on an equal basis with other citizens of the Republic of Uzbekistan to the specified positions according to requirements of the Constitution of the Republic of Uzbekistan, including in edition of this Constitutional Law, and regardless of number of terms in a row during which specified persons borrowed and (or) hold these positions at the time of entry into force of this Constitutional Law.

Effective judges of the Constitutional court of the Republic of Uzbekistan concerning whom new conditions of election and term of office are entered continue to perform the powers before the expiration to which they were elected. Vacant positions of judges of the Constitutional court of the Republic of Uzbekistan are replaced according to the procedure, established by the Constitution of the Republic of Uzbekistan in edition of this Constitutional Law.

Article 8. Changes and amendments in edition of this Constitutional Law can be brought in this Constitutional Law and the Constitution of the Republic of Uzbekistan by the constitutional law adopted by the majority, at least than two thirds of total number according to deputies of Legislative house and members of the Senate of the Oliy Majlis of the Republic of Uzbekistan or referendum of the Republic of Uzbekistan.

Article 9. To the Cabinet of Ministers of the Republic of Uzbekistan:

in two-month time together with the interested state bodies to develop and introduce in chambers of Oliy Majlis of the Republic of Uzbekistan the program of measures for reduction of the legislation in compliance with the Constitution of the Republic of Uzbekistan in edition of this Constitutional Law;

in three-months time to develop and approve the program of measures for ensuring implementation of the social and economic obligations of the state enshrined in the Constitution of the Republic of Uzbekistan in edition of this Constitutional Law including taking into account review of tasks and functions of republican executive bodies within the administrative reforms performed in the country;

annually by preparation of the bill on the Government budget of the Republic of Uzbekistan for the next year to provide the direction of necessary means for implementation of the social and economic obligations of the state enshrined in the Constitution of the Republic of Uzbekistan in edition of this Constitutional Law.

Article 10. To chambers of Oliy Majlis of the Republic of Uzbekistan:

in a month to provide reissuing and replication of the text of the Constitution of the Republic of Uzbekistan in edition of this Constitutional Law;

in two-month time to develop and provide realization of package of measures for finishing and explanation to the general public, especially to youth, essences and values of the Constitution of the Republic of Uzbekistan in edition of this Constitutional Law;

to quarterly consider course of execution of the program of measures for reduction of the legislation in compliance with the Constitution of the Republic of Uzbekistan in edition of this Constitutional Law.

Article 11. To the Supreme Court of the Republic of Uzbekistan for the purpose of the correct and uniform application of the constitutional regulations by courts when implementing justice in three-months time to accept the resolution of the Plenum of the Supreme Court on single court practice of hearing of cases by courts of all instances on application of regulations of the Constitution of the Republic of Uzbekistan in edition of this Constitutional Law as the act of direct action.

 

Constitution of the Republic of Uzbekistan

This new edition of the Constitution of the Republic of Uzbekistan is accepted by national vote on the referendum of the Republic of Uzbekistan held on April 30, 2023.

Preamble

We, single people of Uzbekistan,

solemnly proclaiming the commitment to human rights and freedoms, national and universal values, the principles of the state sovereignty,

confirming the fidelity to ideals of democracy, freedom and equality, social justice and solidarity,

realizing high responsibility before present and future generations for creation of the humane democratic state, open and fair society in which the supreme value is the person, his life, freedom, honor and advantage,

relying on more than three-thousand-year historical experience of development of our statehood, and also scientific, cultural and spiritual heritage of the great ancestors who made invaluable contribution to world civilization

the full of determination to increase and preserve for present and future generations invaluable natural wealth of the country and to keep the healthy environment,

based on the conventional principles and rules of international law,

aiming at strengthening and development of friendship of Uzbekistan with the world community, first of all, with neighboring states, on the basis of cooperation, mutual support, peace and harmony,

setting as the purpose providing worthy life of citizens, interethnic and interfaith concord, wellbeing and prosperity of multinational native Uzbekistan,

we accept and proclaim this Constitution.

Section first. Basic principles

Chapter I. State sovereignty

Article 1.

Uzbekistan - the sovereign, democratic, constitutional, social and secular state with the republican form of government.

Names of the state Republic of Uzbekistan and Uzbekistan are equivalent.

Article 2.

The state expresses will of the people, serves its interests. State bodies and officials are responsible before society and citizens.

Article 3.

The Republic of Uzbekistan determines the national-state and administrative-territorial structure, system of public authorities, pursues the domestic and foreign policy.

The frontier and the territory of Uzbekistan are inviolable and indivisible.

Article 4.

State language of the Republic of Uzbekistan is Uzbek.

The Republic of Uzbekistan provides respect for languages, customs and traditions of the nations and nationalities living in its territory, creates conditions for their development.

Article 5.

The Republic of Uzbekistan has the state symbols - the flag, the coat of arms, the anthem approved by the law.

The state symbols are under protection of the state.

Article 6.

The capital of the Republic of Uzbekistan - the city of Tashkent.

Chapter II. Democracy

Article 7.

The people are the single source of the government.

The government in the Republic of Uzbekistan is performed for the benefit of the people and exclusively by the bodies authorized on that by the Constitution of the Republic of Uzbekistan and the laws adopted on its basis.
