About introduction of amendments to some acts of the Government of the Russian Federation

1. Approve the enclosed changes which are made to acts of the Government of the Russian Federation.

2. Determine that Item 7 provisions (1) Rules of payment of compensation by the public company "Fund of Development of the Territories" to citizens - to the participants of construction having requirements about transfer of the premises, parking places and non-residential premises approved by the order of the Government of the Russian Federation of October 7, 2017 No. 1233 "About approval of Rules of payment of compensation by the public company "Fund of Development of the Territories" to citizens - the participants of construction having requirements about transfer of premises, parking places and non-residential premises" (in edition of this resolution), and Item 14 provisions (1) Rules of payment of compensation to the citizens who are members of housing cooperative or other specialized consumer cooperative which is created according to article 201.10 of the Federal law "About Insolvency (Bankruptcy)" and to which the rights of the builder to object of construction in progress and the parcel of land, approved by the order of the Government of the Russian Federation of December 14, 2019 No. 1680 "About approval of Rules of payment of compensation to the citizens who are members of housing cooperative or other specialized consumer cooperative which is created according to article 201.10 of the Federal law "About Insolvency (Bankruptcy)" were transferred and to which the rights of the builder to object of construction in progress and the parcel of land were transferred" (in edition of this resolution), regarding representation by citizens and citizens - members of cooperative of statements for payment of compensation and other necessary documents through the federal state information system "Single Portal of the State and Municipal Services (Functions)" become effective after 6 months from the date of official publication of this resolution.

Changes which are made to acts of the Government of the Russian Federation

1. In the order of the Government of the Russian Federation of October 7, 2017 No. 1233 "About approval of Rules of payment of compensation by the public company "Fund of Protection of the Rights of Citizens — Participants of Shared-equity Construction" to citizens - to the participants of construction having requirements about transfer of premises, parking places and non-residential premises" (The Russian Federation Code, 2017, No. 42, Art. 6171; 2019, No. 46, Art. 6485; 2020, No. 43, Art. 6799; 2022, No. 16, Art. 2686):

a) in the name and in the text of the word "the public company "Fund of Protection of the Rights of Citizens — Participants of Shared-equity Construction" shall be replaced with words "the public company "Fund of Development of the Territories";

b) in Rules of payment of compensation by the public company "Fund of Protection of the Rights of Citizens — Participants of Shared-equity Construction" to citizens - to the participants of construction having requirements about transfer of the premises, parking places and non-residential premises approved by the specified resolution:

in the name of the word "the public company "Fund of Protection of the Rights of Citizens — Participants of Shared-equity Construction" shall be replaced with words "the public company "Fund of Development of the Territories";

in Item 2 of the word "the public company "Fund of Protection of the Rights of Citizens — Participants of Shared-equity Construction" shall be replaced with words "the public company "Fund of Development of the Territories";

in Item 3 of the word "The Federal Law "About the Public Company on Protection of the Rights of Citizens — Participants of Shared-equity Construction in case of Insolvency (Bankruptcy) of Builders and about Modification of Separate Legal Acts of the Russian Federation" shall be replaced with words "The Federal Law "About the Public Company "Fund of Development of the Territories" and about Modification of Separate Legal Acts of the Russian Federation";

add with Item 7 (1) the following content:

"7(1). The citizen has the right to submit the application for payment of compensation and other necessary documents through personal account of the applicant on the official site of Fund on the Internet (further - personal account of the applicant) if technically possible acceptance of the corresponding statement or through the federal state information system "Single Portal of the State and Municipal Services (Functions)" (further - the single portal).

Access to personal account of the applicant is provided after passing of procedures of registration, identification, authentication and authorization with use of the federal state information system "Single System of Identification and Authentication in the Infrastructure Providing Information and Technological Interaction of the Information Systems Used for Provision of the State and Municipal Services Electronically" (further - single system of identification and authentication).

For the purpose of receipt of access to personal account of the applicant with the consent of physical persons the single system of identification and authentication by interaction with information system of Fund provides automatic transfer to Fund of the following information about the physical person:

surname, name and middle name (in the presence);

birth date;

series, number and date of issue of the identity document of the citizen;

the insurance number of the individual ledger account of insured person in system of the personified accounting of the Pension Fund of the Russian Federation;

identification taxpayer number (in the presence);

contact telephone number;

e-mail address;

postal address (in the presence);

registration address at the place of residence.

The statement for payment of compensation and other necessary documents submitted through personal account of the applicant or through the single portal are signed by the citizen the digital signature.

When signing the statement for payment of compensation and other necessary documents submitted through personal account of the applicant, the citizen can be used:

the strengthened qualified digital signature;

the strengthened unqualified digital signature of physical person which certificate of key of check is created and is used in the infrastructure providing information and technological interaction of the information systems used for provision of the state and municipal services electronically in the procedure established by the Government of the Russian Federation;

the simple digital signature which key is received according to the rules of use of the simple digital signature established by the Government of the Russian Federation in case of the request for receipt of the state and municipal services electronically.

Signing by the citizen of the statement for payment of compensation and other necessary documents submitted through the single portal is performed by the strengthened qualified digital signature.";

in Items 9 and 10 of the word "The Federal Law "About the Public Company on Protection of the Rights of Citizens — Participants of Shared-equity Construction in case of Insolvency (Bankruptcy) of Builders and about Modification of Separate Legal Acts of the Russian Federation" shall be replaced with words "The Federal Law "About the Public Company "Fund of Development of the Territories" and about Modification of Separate Legal Acts of the Russian Federation";

c) in appendix to the specified Rules:

in numerical heading of the word "the public company "Fund of Protection of the Rights of Citizens — Participants of Shared-equity Construction" shall be replaced with words "the public company "Fund of Development of the Territories";

in Item 2 of the word "The Federal Law "About the Public Company on Protection of the Rights of Citizens — Participants of Shared-equity Construction in case of Insolvency (Bankruptcy) of Builders and about Modification of Separate Legal Acts of the Russian Federation" shall be replaced with words "The Federal Law "About the Public Company "Fund of Development of the Territories" and about Modification of Separate Legal Acts of the Russian Federation";

in paragraph six of the subitem "an" of Item 3:

"the public company "Fund of Protection of the Rights of Citizens — Participants of Shared-equity Construction" shall be replaced with words words "the public company "Fund of Development of the Territories" (further - Fund)";

In the order of the Government of the Russian Federation of December 14, 2019 No. 1680 "About approval of Rules of payment of compensation to the citizens who are members of housing cooperative or other specialized consumer cooperative which is created according to article 201.10 of the Federal law "About Insolvency (Bankruptcy)" and to which the rights of the builder to object of construction in progress and the parcel of land" (The Russian Federation Code, 2019, No. 51, Art. 7646 were transferred; 2020, No. 43, Art. 6799; 2021, No. 16, Art. 2786; 2022, No. 16, Art. 2686):

a) in word preamble "The Federal Law "About the Public Company on Protection of the Rights of Citizens — Participants of Shared-equity Construction in case of Insolvency (Bankruptcy) of Builders and about Modification of Separate Legal Acts of the Russian Federation" shall be replaced with words "The Federal Law "About the Public Company "Fund of Development of the Territories" and about Modification of Separate Legal Acts of the Russian Federation";

in the subitem "b" of Item 8 of the word "The Federal Law "About the Public Company on Protection of the Rights of Citizens — Participants of Shared-equity Construction in case of Insolvency (Bankruptcy) of Builders and about Modification of Separate Legal Acts of the Russian Federation" shall be replaced with words "The Federal Law "About the Public Company "Fund of Development of the Territories" and about Modification of Separate Legal Acts of the Russian Federation";

add with Item 14 (1) the following content:

"14(1).
