About modification of some presidential decrees of the Republic of Kazakhstan

I DECIDE:

1. Make changes to the following presidential decrees of the Republic of Kazakhstan:

1) in the Presidential decree of the Republic of Kazakhstan of March 28, 2003 No. 1050 "About formation of Committee on legal statistics and special accounting of the Prosecutor General's Office of the Republic of Kazakhstan":

To be reworded as follows the regulations on Committee on legal statistics and special accounting of the Prosecutor General's Office of the Republic of Kazakhstan approved by the above-named Decree according to appendix 1 to this Decree;

2) for office use;

3) in the Presidential decree of the Republic of Kazakhstan of October 13, 2017 No. 563 "About some questions of bodies of prosecutor's office of the Republic of Kazakhstan":

state preamble in the following edition:

"According to the subitem 1) of Item 2 of article 17-1 of the Constitutional law of the Republic of Kazakhstan of December 26, 1995 "About the President of the Republic of Kazakhstan" and item 4 of article 44 of the Constitutional law of the Republic of Kazakhstan of November 5, 2022 "About prosecutor's office" I DECIDE:";

To be reworded as follows the regulations on the Prosecutor General's Office of the Republic of Kazakhstan approved by the above-named Decree according to appendix 3 to this Decree;

to state the structure of the Prosecutor General's Office of the Republic of Kazakhstan approved by the above-named Decree in the following edition:

the list of positions of system of bodies of prosecutor's office to which class ranks, and also limiting class ranks corresponding to them are appropriated to be reworded as follows according to appendix 4 to this Decree (marked "For office use").

2. This Decree becomes effective from the date of its signing.

Regulations on Committee on legal statistics and special accounting of the Prosecutor General's Office of the Republic of Kazakhstan

Chapter 1. General provisions

1. The committee on legal statistics and special accounting of the Prosecutor General's Office of the Republic of Kazakhstan (further - Committee) is the department performing within competence of the Prosecutor General's Office of the Republic of Kazakhstan functions and powers of state body on forming of the state legal statistics and conducting special accounting.

2. The committee performs the activities according to the Constitution of the Republic of Kazakhstan, the Constitutional law of the Republic of Kazakhstan "About prosecutor's office" (further - the Constitutional law), the international treaties ratified by the Republic of Kazakhstan, the laws, other regulatory legal acts, and also this Provision.

3. The committee is legal entity in form of business of public institution, has seals and stamps with the name on Kazakh and other languages, forms of the established sample, according to the legislation of the Republic of Kazakhstan of the account in bodies of treasury.

4. The committee enters the civil relations from own name.

5. The committee has the right to act as the party of the civil relations on behalf of the state if it is authorized on it according to the legislation of the Republic of Kazakhstan.

6. The committee on questions of the competence of the procedure established by the legislation of the Republic of Kazakhstan makes the decisions which are drawn up by orders of the chairman of Committee and other acts, stipulated by the legislation the Republic of Kazakhstan.

7. The structure and limit of the number of staff of Committee affirm according to the legislation of the Republic of Kazakhstan.

9. Full name of Committee - public institution "Committee on legal statistics and special accounting of the Prosecutor General's Office of the Republic of Kazakhstan".

Chapter 2. Tasks, rights and obligations of Committee

13. Tasks:

1) effective and sufficient information support of state bodies, physical persons and legal entities about condition of legality and law and order in the country on the basis of the single statistical principles and standards;

2) enhancement and development of the state legal information statistical system.

14. Powers:

1) rights:

receive gratuitously from subjects of legal statistics and special accounting legal statistical information concerning the state legal statistics and conducting special accounting, the departmental reporting, documents and forms of primary accounting, and also other information for production of statistical information and conducting special accounting;

demand from subjects of legal statistics and special accounting of completeness and reliability of acts of primary accounting and the reporting, their representation in the terms determined by regulatory legal acts of the Attorney-General of the Republic of Kazakhstan (further - the Attorney-General);

exercise supervision of integrity, objectivity, reliability and sufficiency of the legal statistical information provided by subjects of legal statistics and special accounting without intervention in their activities which are not connected with forming of the state legal statistics and conducting special accounting;

perform respecting the rule of law, the analysis of condition of legality, assessment of the acts which became effective in the field of the state legal statistics and special accounting;

bring according to the procedure, determined by the Constitutional law and other laws of the Republic of Kazakhstan, and also the Attorney-General, acts of prosecutor's office;
