According to the paragraph to the twelfth the subitem 5) of article 12 of the Social code of the Republic of Kazakhstan, the subitem 2) of Item 3 of article 16 of the Law of the Republic of Kazakhstan "About the state statistics", I ORDER:

1. Approve the enclosed Rules of use by the centers of rendering special social services of retirement benefits in age, for long service and the public social benefits according to appendix 1 to this order.

2. Recognize invalid some orders of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan according to appendix 2 to this order.

3. To provide to social services department of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan after its official publication;

3) within ten working days after state registration of this order submission to Department of legal service of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

4. To impose control of execution of this order on the supervising vice-Minister of Labour and Social Protection of the population of the Republic of Kazakhstan.

5. This order becomes effective since July 1, 2023 and is subject to official publication.

Rules of use by the centers of rendering special social services of retirement benefits in age, for long service and public social benefits

Chapter 1. General provisions

1. These rules of use by the centers of rendering special social services of retirement benefits in age, for long service and the public social benefits (further – Rules) are developed according to the paragraph the twelfth the subitem 5) of article 12 of the Social code of the Republic of Kazakhstan and determine procedure for use by the centers of rendering special social services in the conditions of hospital (further – TsOSSU) retirement benefits by age and for long service (further – retirement benefits) and the public social benefits (further – benefits) aged, persons with disability (further – persons) sponsored recognized as court incapacitated and needing guardianship (further – sponsored), living in TsOSSU and being on complete state providing.

2. Retirement benefits and benefits of persons and sponsored are listed:

of 30% for current accounts of persons and sponsored;

of 70% for the separate bank account or control accounts of cash (further – KSN) TsOSSU.

Chapter 2. Procedure for use by the centers of rendering special social services of retirement benefits and benefits

3. According to Item 2 of Article 26 of the Civil code of the Republic of Kazakhstan and item 4 of article 122 of the Code of the Republic of Kazakhstan "About scrap (matrimony) and family" for use of retirement benefits and benefits of incapacitated persons by the guardian the head of TsOSSU is appointed (further – the guardian).

For opening of the current account the guardian represents to authorized organization for issue of pensions and benefits the copy of the judgment about recognition of person incapacitated, the decision of guardianship and custody body on establishment over incapacitated person of guardianship, and also the documents provided by the Rules of opening, maintaining and closing of bank accounts of clients approved by the resolution of Board of National Bank of the Republic of Kazakhstan of August 31, 2016 No. 207 (it is registered in the Register of state registration of regulatory legal acts No. 14422).

The current account is opened to sponsored by the guardian in the banks of the second level, the organizations having licenses of authorized body on regulation and supervision of the financial market and the financial organizations on the corresponding types of banking activities, territorial subdivisions of Kazpochta joint-stock company (further – authorized organization for issue of pensions and benefits).

4. For use of retirement benefits and benefits in TsOSSU the commission is created.

The commission consists of odd number, but at least 7 people. The head of TsOSSU or its deputy, representatives of local executive body (the cities of republican value, the capital) concerning employment and social programs (further – authorized body) and non-governmental the organizations in the field of special social services, the manager of medical department, the accountant, the dietary food nurse, the specialist in social work of TsOSSU is part of the commission.

The commission chairman is elected from among members of the commission.

Commission session is considered competent in the presence of at least two thirds of its structure.

The employee of TsOSSU who does not take part in vote is appointed the secretary of the commission.

The commission sits at least 1 time a month, and determines requirement:

persons and sponsored – in objects of sanitary hygiene, in the medicines and medical services which are not entering the list of the guaranteed amount of free medical care (further – objects of sanitary hygiene, medicines and medical services), No. approved by the order of the Government of the Republic of Kazakhstan of October 16, 2020 672, articles of clothing, footwear and bed linen, technical supportive applications and firm stock (further – clothes, footwear and bed linen, technical supportive applications and firm stock);

sponsored – in additional food, in necessities (further – personal needs).

The decision of the commission is deemed accepted if it was supported by at least two thirds of all acting its structure.

By results of carrying out commission sessions within one working day the protocol signed by the chairman and the secretary of the commission is constituted.

In case of introduction of emergency state and (or) restrictive actions, including quarantine, emergency situation of social, natural and technogenic nature, members of the commission take part in commission session in online the mode. In this case, their line items concerning use of retirement benefits and benefits (for personal needs sponsored and acquisition of clothes, footwear and bed linen, technical supportive applications and firm stock) go to TsOSSU within one working day from the date of carrying out commission session, by means of single system of electronic document management of state bodies or in writing to e-mail of the secretary of the commission.

5. The retirement benefits and benefits which are on the current accounts sponsored are spent by the guardian for personal needs of sponsored.

The decision of the commission on use of retirement benefits and benefits, for personal needs of sponsored is drawn up in form according to appendix 1 to these rules.

Data on use of retirement benefits and benefits, for personal needs of sponsored are reflected in the magazine according to appendix 2 to these rules.

6. The retirement benefits and benefits which are on current accounts of persons are spent independently.

7. The separate bank account or KSN TSOSSU opens TsOSSU in territorial authority of treasury in its location.

8. Retirement benefits and benefits of persons and sponsored, arrived on KSN, are used on acquisition of clothes, footwear and the bed linen, technical supportive applications and firm stock specified in appendix of 3 these rules and objects of sanitary hygiene, medicines and medical services.

Acquisition of clothes, footwear and the bed linen, technical supportive applications and firm stock specified in appendix of 3 these rules and objects of sanitary hygiene, medicines of medical services is performed according to the Law of the Republic of Kazakhstan "About public procurements".

For implementation of payment on acquisition of clothes, footwear and the bed linen, technical supportive applications and firm stock specified in appendix of 3 these rules the responsible specialist applies (attaches) the copy of the decision of the commission and the copy of the document (invoices or delivery note about delivery of goods).

The decision of the commission on use of the retirement benefits and benefits which are on the separate bank account or KSN TSOSSU is drawn up in form according to appendix 4 to these rules.

Data on use of the retirement benefits and benefits which are are reflected in the separate bank account or KSN TSOSSU in the magazine according to appendix 5 to these rules.

9. In case of insufficiency of funds for acquisition of clothes, footwear, and the bed linen, technical supportive applications and firm stock specified in appendix of 3 these rules and (or) their cost which cannot be provided at the expense of the means which are available on KSN local executive bodies provide additional expenses on their acquisition.

10. The head of TsOSSU monthly to the 10th following reporting submits in authorized body the report on use of the received retirement benefits and benefits of persons and sponsored in form according to appendix 6 and the retirement benefits and benefits sponsored in form according to appendix 7 to these rules.

Copies of the decision of the commission and the copy of documents are attached to the report on use of retirement benefits and benefits (invoices or delivery note about delivery of goods).
