About introduction of amendments to the order of the Minister of ecology, geology and natural resources of the Republic of Kazakhstan of July 12, 2021 No. 245 "About approval of qualification requirements to the licensed type of activity in the field of environmental protection on their subspecies"

I ORDER:

1. Bring in the order of the Minister of ecology, geology and natural resources of the Republic of Kazakhstan of July 12, 2021 No. 245 "About approval of qualification requirements to the licensed type of activity in the field of environmental protection" (it is registered in the Register of state registration of regulatory legal acts for No. 23511) the following change:

The qualification requirements to the licensed type of activity in the field of environmental protection approved by the specified order to be reworded as follows according to appendix to this order.

2. To provide to committee of ecological regulation and control of the Ministry of Ecology and Natural Resources of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Ecology and Natural Resources of the Republic of Kazakhstan after its official publication;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of Ecology and Natural Resources of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. To impose control of execution of this order on the supervising vice-minister of ecology, geology and natural resources of the Republic of Kazakhstan.

4. This order becomes effective after sixty calendar days after day of its first official publication.

4	program complex by calculation of standard rates of issues to the environment	Form of data with indication of: 1) names of the program complex which is in property or in legal use; 2) the producer of program complex it is filled according to appendix to Qualification requirements to the licensed type of activity in the field of environmental protection.

5	availability at the head of the applicant of the highest or secondary special education	Form of the data containing information with indication of: 1) specialties and qualifications, numbers and dates, places of issue of the diploma, name of educational institution; 2) numbers and dates of the order on acceptance for work as the head and/or numbers and dates of the individual employment contract are filled in according to appendix to Qualification requirements to the licensed type of activity in the field of environmental protection.
6	at least two specialists who are working in staff of this legal entity, having the corresponding higher education on profile with practical experience of work in the field of environmental protection at least three years	Form of data with indication of: 1) surname name middle name (in case of its availability); 2) the positions held by them; 3) length of service in the field of environmental protection (length of service, posts, number and date of the order on acceptance for work and/or number and date of the individual employment contract); 4) specialties and qualifications, numbers and dates of diplomas, names of educational institutions are filled in according to appendix to Qualification requirements to the licensed type of activity in the field of environmental protection.

To activities for conversion, neutralization, utilization and (or) destruction of dangerous wastes for physical persons and legal entities include availability:
9	availability in staff of the ecologist (by training) the having practical experience of work in the field of environmental protection at least one year	Form of the data containing information with indication of: 1) surname name middle name (in case of its availability) the specialist, occupied position, specialties and qualifications, numbers and dates, places of issue of the diploma, the name of educational institution; 2) numbers and dates of the order on acceptance for work and/or numbers and dates of the individual employment contract are filled in according to appendix to Qualification requirements to the licensed type of activity in the field of environmental protection.
10	availability in property or lease at the owner of production facility (the building, structure, construction, the room and/or polygon of dangerous wastes) intended for conversion, neutralization, utilization and (or) destructions of dangerous wastes (in administrative and territorial unit – the area, the city of republican value or the capital where acceptance and transactions on management of dangerous wastes are made)	Form of the data containing information with indication of: 1) technical data sheet (F-2) and the information about the owner confirming availability in property of production facility with buildings, structures, constructions, rooms and/or polygon of dangerous wastes for conversion, neutralization of utilization and (or) destruction of dangerous wastes is filled according to appendix to Qualification requirements to the licensed type of activity in the field of environmental protection; The lessee to above-mentioned documents in addition provides the lease agreement.

14	the transport of the company managing dangerous wastes, occupied with their transportation is equipped with the GPS device (tracker)	Form of the data containing information with indication of: 1) model (brand) of the established GPS devices; 2) number and date of technical data sheet on the vehicle is filled in according to appendix to Qualification requirements to the licensed type of activity in the field of environmental protection. In case of lease of the vehicle, the lease agreement is in addition provided.

Note: The territorial subdivision performs verification of the submitted documents on compliance to qualification requirements with departure on object of the applicant and submission of the conclusion following the results.

According to Item 7 of article 129 of the Entrepreneurial code of the Republic of Kazakhstan in case of departure on the applicant's object registration in bodies of prosecutor's office is not required.
