About modification of some regulations
The Parliament adopts this organic law.
Art. I. - In article 13 of the Law on the Highest trial chamber No. 64/2023 (The official monitor of the Republic of Moldova, 2023, Art. No. 117-118, 190) to make the following changes:
in Items a) and b) parts (the words "from the date of entry into force of this law" shall be replaced with words 2) "from start date of activities in new structure according to part provisions (4)";
add Article with parts (4) - (7) the following content:
"(4) the Highest trial chamber begins the activities in new structure according to provisions of this law and with the competences established by it from the date of appointment as the President of the Republic of Moldova according to the offer of the Supreme council of magistracy of nine judges estimated according to provisions of the Law on external assessment of judges and candidates for judgeship of the Highest trial chamber No. 65/2023.
(5) the Highest trial chamber continues to function in present structure and considers the cases referred according to the law to its competence before date of appointment as the President of the Republic of Moldova according to the offer of the Supreme council of magistracy of nine judges estimated according to provisions of the Law on external assessment of judges and candidates for judgeship of the Highest trial chamber No. 65/2023.
(6) Before selection of the chairman and the vice-chairman of the Highest trial chamber according to the procedure, established by this law, to the Supreme council of magistracy to designate person who will perform powers of the chairman of the Highest trial chamber according to provisions of the Law on judicial system No. 514/1995 from among judges of the Highest trial chamber.
(To the Government prior to activities of the Highest trial chamber in new structure to provide 7) to Parliament of the offer on reduction of the current legislation to compliance with this law.".
