About modification and amendments in some orders of the Minister of Energy of the Republic of Kazakhstan

I ORDER:

1. Approve the enclosed list of some orders to which changes and additions are made.

2. To provide to department of gas and oil and gas chemistry of the Department of Energy of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Department of Energy of the Republic of Kazakhstan after its official publication;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Department of Energy of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. To impose control of execution of this order on the supervising vice-Minister of Energy of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

The list of some orders of the Minister of Energy of the Republic of Kazakhstan to which changes and additions are made

1. In the order of the Minister of Energy of the Republic of Kazakhstan of November 3, 2014 No. 96 "About approval of Rules of retail sale and use of the commodity and liquefied oil gas" (it is registered in the Register of state registration of regulatory legal acts for No. 9936):

be reworded as follows Item 1:

"1. These rules of retail sale and use of the commodity and liquefied oil gas (further – Rules) are developed according to the subitem 14) of article 6 of the Law of the Republic of Kazakhstan "About gas and gas supply" (further – the Law) and determine procedure for retail sale and use of the commodity and liquefied oil gas.";

in Item 1-1:

2) to be reworded as follows the subitem:

"2) average daily regulation of delivery (consumption) of gas – the gas amount determined by division of monthly amount of the gas established by the contract of retail sale of gas between the supplier and the consumer on the number of calendar days of the corresponding month;";

"10) settlement period – the period for which the amount of delivered gas is determined settlement between the supplier, the gas transmission, gas-distributing organizations, persons specified in Item 11 of article 27-1 of the Law and the consumer for delivered gas is made. 1) from the residential customer – availability of the project of gas supply, the passport of the gas-consuming equipment, the acceptance act of gas-consuming system in operation, the construction passport of the gas pipeline, the act of inspection of ventilating channels and flues, and also the signed agreement of maintenance of gas-consuming systems;

2) from other consumers – availability of the project of gas supply, the passport of the gas-consuming equipment, the acceptance act of gas-consuming system in operation, the construction passport of the gas pipeline, the act of inspection of ventilating channels and flues, the order on appointment of person responsible for safe operation of objects of gas supply systems, and also the signed agreement of maintenance of gas-consuming systems.

The consumers specified in the subitem 2) of this Item provide the documents confirming readiness for gas supply, in case of reference of their objects of gas consumption to technically and (or) technologically difficult objects determined by the Rules of determination of general procedure for reference of buildings and constructions to technically and (or) technologically difficult objects approved by the order of the Minister of national economy of the Republic of Kazakhstan of February 28, 2015 No. 165 (it is registered in the Register of state registration of regulatory legal acts for No. 10666).

3) from the supplier – availability of the supporting document about the corresponding amount of gas (the agreement of purchase of gas).";

"36. When using of the commodity and liquefied oil gas are not allowed:
