About approval of standards of rendering special social services in the field of social protection of the population

According to the paragraph of the subitem 5) of article 12 of the Social code of the Republic of Kazakhstan I ORDER the fifth:

1. Approve:

1) the Standard of rendering special social services in the field of social protection of the population in the conditions of hospital according to appendix 1 to this order;

2) the Standard of rendering special social services in the field of social protection of the population in the conditions of semi-hospital according to appendix 2 to this order;

3) the Standard of rendering special social services in the field of social protection of the population in the conditions of rendering services at home according to appendix 3 to this order;

4) the Standard of rendering special social services in the field of social protection of the population in the conditions of temporary stay according to appendix 4 to this order.

2. Recognize invalid some orders of the Ministry of Labour and Social Protection of the population and the Ministry of health and social development of the Republic of Kazakhstan of the Republic of Kazakhstan according to appendix 7 to this order.

3. To provide to social services department of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan after its official publication;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

4. To impose control of execution of this order on the supervising vice-Minister of Labour and Social Protection of the population of the Republic of Kazakhstan.

5. This order becomes effective since July 1, 2023 and is subject to official publication.

The standard of rendering special social services in the field of social protection of the population in the conditions of hospital

Chapter 1. General provisions

1. The standard of rendering special social services in the field of social protection of the population in the conditions of hospital (further – the Standard) is developed according to the paragraph the fifth the subitem 5) of article 12 of the Social code of the Republic of Kazakhstan (further - the Social code).

2. This Standard establishes quality requirements, to amount and conditions of provision of special social services in the organizations of stationary type of the state and non-state patterns of ownership (further – the organizations of stationary type) intended for the round-the-clock permanent or temporary residence in the conditions of hospital determines conditions of acceptance, content, the statement (assignment), temporary disposal and transfer from the organization of stationary type:

1) children with disability with psychoneurological pathologies from three to eighteen years (further – children);

2) children with disability with violations of the musculoskeletal device from three to eighteen years (further – children with violations the ODE);

3) persons with disability is more senior than eighteen years with psychoneurological diseases (further – persons are more senior than eighteen years);

4) persons with disability of the first and second groups (further – persons with disability);

5) persons not capable to independent servicing in connection with old age (further – aged).

The categories stated above jointly hereinafter are referred to as receivers of services.

Chapter 2. Conditions of provision of special social services in the organizations of stationary type

3. Provision of special social services in the organizations of stationary type is performed according to the decision of departments of employment and social programs of areas, cities of regional and republican value (capital) (further – departments of employment) at the place of residence of the receiver of services.

4. It is excluded according to the Order of the deputy. The Minister of Labour and Social Protection of the population of the Republic of Kazakhstan of 06.03.2025 No. 72

5. Persons (family) recognized by persons in need in special social services addresses to department of employment behind provision of the guaranteed amount of special social services in the place of residence by giving:

1) the statement of the receiver of services, and for minor and incapacitated persons – the written application of the legal representative (one of parents, the adoptive father (adopter), the guardian or the custodian, the adoptive parent, the foster tutor and other persons replacing them performing according to the Code of the Republic of Kazakhstan "About scrap (matrimony) and family" (further – the Code), care, education, education, protection of the rights and interests of the child, person is more senior than eighteen years) (further – the legal representative) in form, according to appendix 1 to this Standard;

2) the identity document or the electronic document from service of digital documents of the receiver of services with availability of individual identification number (further – IIN) for identification;

3) the medical record in form, according to appendix 2 to this Standard with the statement from the out-patient card or the clinical record.

The department of employment in case of reception of an application creates requests on IIN in information systems of state bodies and (or) organizations through lock of "the electronic government" (further – information systems) for receipt of the following data:

1) about the identity document;

2) about disability establishment;

3) about developed actions in the individual program of abilitation and rehabilitation of person with disability (further – the International Party of Russia);

4) for persons is more senior than eighteen years – about the judgment in case of recognition of person incapacitated (in the presence);

5) about retirement age for persons of retirement age;

6) about availability of the status of the veteran of the Great Patriotic War, the combat veteran in the territory of other states, and also the veteran equated on privileges to veterans of the Great Patriotic War, family of the died military personnel listed in the subitem 1) of article 8 of the Law of the Republic of Kazakhstan "About veterans" (further – the Law) (for veterans of the Great Patriotic War, combat veterans in the territory of other states, and also the veterans equated on privileges to veterans of the Great Patriotic War, family of the died military personnel listed in the subitem 1) of article 8 of the Law).

In the absence of data from information systems are enclosed to the application for persons is more senior than eighteen years – the copy of the judgment about recognition of person incapacitated (in the presence).

6. In case of compliance of document package specified Item 5 of this Standard, the specialist of department of employment enters into the automated information system "E-social security" (further – AIS "E-social security") the data from the statement of the addressed person (family) recognized by persons in need in special social services.

7. Within two working days from the date of pronouncement by local executive body of the decision on provision of special social services, the department of employment of the residence of the receiver of services directs to the receiver of services the notification on document creation to rendering special social services and about need of authorization and choice of the organization of stationary type on the portal of social services (http://aleumet.egov.kz) (further – the portal).

In the presence of data on subscriber number of the receiver of services in base of mobile citizens, to the receiver of services the notification on need of authorization and the choice of the organization of stationary type on the portal with AIS "E-social security" in addition goes to the telephone number of the subscriber structure of cellular communication registered on the web portal of "the electronic government" by means of transfer of the SMS notification.

After receipt of the notification the receiver of services within ten working days will become authorized on the portal by means of the EDS and chooses the organization of stationary type.

In case of absence at the receiver of services of access to Internet resource, the receiver of services addresses to the sector of self-service of department of employment.

In the presence of empty seat the receiver of services within fifteen working days arrives to the organization of stationary type. In case of physical inability (disease, hospitalization) of the receiver of services to be in the organization of stationary type at the scheduled time, the receiver of services notifies the organization of stationary type and it is given opportunity to postpone once arrival effective period in addition up to thirty calendar days.

The notification on physical inability of the receiver of services to be in the organization of stationary type at the scheduled time in connection with disease, hospitalization goes to the organization of the stationary type through the portal in electronic form signed by the EDS of the receiver of services, the legal representative (for minor and incapacitated persons).

In case of non-arrival of the receiver of services into the organization of stationary type at the scheduled time the queue passes to the following receiver of services.

In case of lack of empty seats in the chosen organization of stationary type, the receiver of services independently stands in line by authorization on the portal by means of the EDS.

In case of release of the place the SMS notification on need within ten working days of arrival in the organization of stationary type goes to the organizations of stationary type to the receiver of services consisting the first in line.

The receivers of services standing in queue on the portal with the expired term of the International Party of Russia undergo re-examination and are registered on the portal with preserving the previous queue (in the presence of the International Party of Russia on provision of special social services in the organization of stationary type).

The orphan children and children without parental support who reached eighteen-year age and living in the organization of stationary type are accepted in the organization of stationary type providing special social services aged to persons with disability and (or) to persons is more senior than eighteen years out of turn.

If from the date of statement on queue passed more than a month, then in case of registration of the receiver of services in the organization of stationary type the receiver of services needs to have repeatedly medical examination in form according to appendix 2 to this Standard. In case of availability at the receiver of services of medical contraindications, the decision of local executive body on provision of special social services stops before provision by the receiver of services of the medical record in form, according to appendix 2 to this Standard, testimonial of absence at it medical contraindications.

8. Within one working day from the date of arrival of the receiver of services in the organization of stationary type on the portal of social services the card of the receiver of services with the following documents is created:

1) decision of local executive body on provision of special social services;

2) the medical record in form, according to appendix 2 to this Standard with the statement from the out-patient card or the clinical record;

3) in case of lack of data from information systems – the documents specified in the paragraph 3 Items 5 of this Standard.

9. By transfer to administration of the organization of stationary type of children and (or) children with violations the ODE and (or) persons is more senior than eighteen years needing rendering special social services in the conditions of hospital, the legal representative provides originals of the following documents:

for persons is more senior than eighteen years – the identity document with IIN availability, the judgment about recognition of person incapacitated (in the presence);

for children – the certificate of birth with availability IIN and the card of preventive inoculations in form, according to the Forms of accounting documentation in the field of health care approved by the order of the acting minister of health care of the Republic of Kazakhstan of October 30, 2020 No. KR DSM-175/2020 "About approval of forms of accounting documentation in the field of health care" (it is registered in the Register of state registration of regulatory legal acts for No. 21579).

10. And also to the veterans equated on privileges to veterans of the Great Patriotic War, families of the died military personnel listed in the subitem 1) of article 8 of the Law in the organizations of stationary type services in first-priority procedure are provided to veterans of the Great Patriotic War, combat veterans in the territory of other states.

11. The decision on provision of services of the independent accompanied accommodation at department of the independent accompanied accommodation by design capacity from 6 to 30 places (further – Department) is accepted by the organization of stationary type, on the basis of complex assessment and monitoring of specialists of the organization of stationary type.

Contraindication to accommodation in Department is the inability of the receiver of services to self-service and (or) to independent movement and complete dependence from other persons determined according to the Rules of assessment and determination of need for special social services approved by authorized state body according to the paragraph the twenty seventh the subitem 5) of article 12 of the Social code.

12. When rendering special social services by the organizations of stationary type it is observed:

1) ensuring integrity of human beings and safety of receivers of services;

2) creation of favorable moral and psychological climate;

3) rendering special social services taking into account individual needs of receivers of the services oriented to increase in level of their personal development, socialization and integration;

4) improvement of quality and efficiency of the provided special social services;

5) socialization of persons with disability, their support as much as possible independence in the organization of life, labor employment, leisure and interaction in open society;

6) providing with living space, including for bedrooms at least four square meters on the child, the child with violations the ODE and at least five square meters is one person more senior than eighteen years, person with disability, aged

7) confidentiality of the receiver of services;

8) providing with clothes, footwear, bed linen, personal care products, firm stock and technical supportive (compensatory) means, and also special vehicles according to the minimum standards of dress, footwear, bed linen, personal care products, firm stocks and technical supportive (compensatory) means and special vehicles provided to persons which do not have disability, on doctor's orders and also terms their socks and uses for the organizations of stationary type according to appendix 3 to this Standard;

9) ensuring duration of training in the organizations of stationary type for children, children with violations of the musculoskeletal device and persons is more senior than eighteen years according to appendix 4 to this Standard.

12-1. Special social services are rendered according to the list of the special social services rendered in hospital conditions according to appendix 5 to this Standard.

13. The statement of receivers of services from the organization of stationary type is performed:

1) according to the written application of receivers of services, and for minor and incapacitated – according to the written application of the legal representative;

2) in case of removal of disability or establishment of the third group of disability (to persons is more senior than eighteen years and to persons with disability), recognition of improvement of the state of health of person by the medical organization with disability, allowing it to perform labor activity without assistance and in the presence at receivers of services of living space and means of livelihood;

3) on reaching age of majority of children and children with violations the ODE, except for orphan children and children without parental support;

4) in case of agreement cancelation about provision of paid special social services;

5) in case of the death of the receiver of services.

14. Temporary disposal (for up to three months) receivers of services in personal motives is allowed taking into account the conclusion of the doctor of the organization of stationary type based on the written application of person with disability and aged in administration of the organization of stationary type, and for children and persons is more senior than eighteen years – according to the written application of legal representatives, the close relative.

15. For the period of absence of receivers of services, special social services to which are rendered at the expense of budgetary funds removal and statement on allowance is drawn up by the relevant order of the head of the organization of stationary type.

16. Transfer of receivers of the services containing at the expense of budgetary funds from the organization of stationary type located in one region in the organization of stationary type located in other region is performed in coordination with regional, the cities of Astana, Almaty and Shymkent authorized bodies in the field of social protection of the population (further – authorized bodies) the respective regions.

17. The decision on the direction of receivers of services for up to one year for further rehabilitation in other organization is made by administration of the organization of stationary type taking into account the conclusion of the cross-disciplinary commission of the organization of stationary type and in the presence of the commitment letter of the host party on content of receivers of services and ensuring necessary care of them.

18. In the presence of medical contraindications to accommodation at the organizations of stationary type receivers of services go to the specialized medical organization for carrying out inspection and the solution of question of stationary or out-patient treatment.

19. In case of achievement of sixteen years by the child the administration of the organization of stationary type provides execution of the identity certificate.
