About approval of Rules of voluntary resettlement of persons for increase in labor force mobility

(as amended on 12-03-2025)

According to the paragraph seven the subitem 5) of Article 12 and the subitem 1) of item 4 of article 112 of the Social code of the Republic of Kazakhstan I ORDER:

1. Approve the enclosed Rules of voluntary resettlement of persons for increase in labor force mobility according to appendix 1 to this order.

2. Declare invalid some orders and structural elements of orders of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan according to appendix 2 to this order.

3. To provide to committee on migration of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on official Internet resource of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan after its official publication;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item;

4) bringing this order to data of akimats of areas and the cities of Astana, Almaty and Shymkent for management in work.

4. To impose control of execution of this order on the first vice-Minister of Labour and Social Protection of the population of the Republic of Kazakhstan.

5. This order becomes effective since July 1, 2023 and is subject to official publication.

Rules of voluntary resettlement of persons for increase in labor force mobility

Chapter 1. General provisions

1. These rules of voluntary resettlement of persons (further – Rules) are developed for increase in labor force mobility according to the subitem 5) of Article 12 and item 4 of article 112 of the Social Code of the Republic of Kazakhstan (further – the Social code) and determine procedure for voluntary resettlement of persons for increase in labor force mobility, and also provision to persons and members of their families of financial support according to the subitem 1) of item 4 of article 112 of the Social code of the Republic of Kazakhstan.

2. No. 281 is excluded according to the Order of the Minister of Labour and Social Protection of the population of the Republic of Kazakhstan of 30.07.2024

3. In these rules the following basic concepts are used:

1) The Government for Citizens State corporation (further - the State corporation) - the legal entity created according to the decision of the Government of the Republic of Kazakhstan for rendering the state services according to the legislation of the Republic of Kazakhstan, the organization of work on reception of applications on rendering the state services and issue of their results to uslugopoluchatel by the principle of "one window", ensuring rendering the state services electronically;

2) unified information system in the field of social protection – the object of informatization intended for automation of activities of authorized state body, local executive bodies concerning social protection and employment of the population, the centers of labor mobility, career centers, the Center of development of manpower and interdepartmental interaction for the purpose of provision of the state services to the population in the social and labor sphere;

3) the social contract – the agreement determining the rights and obligations of the Parties between the participant of active measures of assistance of employment and the center of labor mobility (career center), and in the cases provided by the Social code with the physical persons or legal entities involved in the organization of active measures of assistance of employment and also about rendering the government address public assistance;

4) vacancy – free workplace (position) at the employer;

5) the employer (lessee) – the party in the employment contract of the dwelling receiving the dwelling or its part in permanent or temporary ownership and use;

5-1) close relatives – parents (parent), children, adoptive parents (adopters), the adopted (adopted), full and not full brothers and sisters, the grandfather, the grandmother, grandsons;

6) the center of labor mobility – the legal entity created by local executive body of area, city of republican value and the capital for the purpose of development and implementation of measures of assistance of employment;

7) utilities – the services provided to the consumer, including water supply, water disposal, gas supply, electric utility service, heat supply, rubbish disposal, servicing of elevators for providing safe and comfortable conditions of accommodation (stay);

8) кандас – the ethnic Kazakh and (or) members of his family of the Kazakh nationality who were earlier not consisting in the nationality of the Republic of Kazakhstan, received the corresponding status according to the procedure established by authorized body concerning population shift;

9) the Commission on acceptance of kandas – the commission for consideration of the application of ethnic Kazakhs on assignment or prolongation of the status of kandas, and in regions of resettlement in addition on inclusion in regional quota of acceptance of kandas;

10) the center of adaptation and integration of kandas – the legal entity established by local executive body of areas, cities of republican value, the capital according to the legislation of the Republic of Kazakhstan and intended for rendering to kandasa, members of their families of adaptation and integration services and temporary residence;

11) regional quota of acceptance of kandas – limiting number of kandas or kandas and members of their families arriving for permanent residence to the regions determined by the subitem 2) of Item 3 of article 112 of the Social Code which are provided with the measures of the state support provided to participants of active measures of assistance of employment according to the Social code;

12) the immigrant – the internal migrant who moved to the regions determined by the subitem 2) of Item 3 of article 112 of the Social Code;

13) regional quota of acceptance of immigrants – limiting number of immigrants or immigrants and members of their families arriving for permanent residence to the regions determined by the subitem 2) of Item 3 of article 112 of the Social Code which are provided with the measures of the state support provided to participants of active measures of assistance of employment according to the Social code;

14) the office dwelling – the dwelling with particular legal regime provided from housing stock of public institution and intended for settling by citizens of the Republic of Kazakhstan for accomplishment by them of the obligations connected with nature of their employment relationships, including when implementing rotation of government employees, and also participating in active measures of assistance of employment according to the Social code;

15) career center – the branch of the center of labor mobility performing accomplishment of its functions in areas, the cities of regional and republican value, the capital;

16) the monotown – the city where the main part (20% and more) industrial production and able-bodied population is concentrated at one or several (few) city-forming companies, as a rule, of one profile and raw orientation (monospecialization) which at the same time determine all economic and social processes happening in the city;

17) intraregional resettlement – resettlement within one area from villages with low economic potential to the cities of regional (district) value in case of possibility of allocation of the dwelling from the state housing stock and employment on permanent workplace or in development of entrepreneurial initiative;

18) the district (city) commission concerning employment of the population – the interdepartmental commission under local executive body of the area (city) concerning implementation of the development plan for area regarding employment of the population, the regional card of employment and the public assistance;

19) local executive body concerning social protection and employment of the population – the local executive body of area, the cities of republican value, the capital determining the directions in the field of social protection and employment of the population;

20) regional commission concerning employment of the population – the interdepartmental commission under local executive body of area (the city of republican value, the capital) concerning implementation of the development plan for area regarding employment of the population, the regional card of employment and the public assistance;

21) interregional resettlement – resettlement to the regions determined by the subitem 2) of Item 3 of article 112 of the Social Code within regional quotas of acceptance of immigrants and kandas according to the Social code and the Law of the Republic of Kazakhstan "About population shift";

22) authorized body for architecture, town planning and construction – the central state body performing management in the field of public administration of architectural, town-planning and construction activities;

23) employment (lease) of the dwelling – provision of the dwelling or part to his employer (lessee) in permanent or temporary ownership and use for a fee;

24) the employment contract of the dwelling – the agreement according to which the lessor grants right to use by the dwelling or its part to the employer for a fee;

25) the strong rural settlement – the well-planned rural settlement (further – SNP) in which infrastructure for providing with the state and social services to the population living in it and inhabitants of the adjacent SNP constituting rural cluster is created;

26) authorized body concerning population shift – the central executive body performing within the competence management in the field of population shift, regulation of migratory processes, coordination of work and realization of state policy in the field of population shift;

27) the small city – the city with population to 50 thousand people;

28) the border territories – the territories of the administrative-territorial educations and settlements located at distance to 50 kilometers from Frontier of the Republic of Kazakhstan;

29) foreign institutions of the Republic of Kazakhstan – the diplomatic and equated to them representations being abroad, and also consular establishments of the Republic of Kazakhstan.

30) the centers of economic growth – the specific settlements performing function of source of innovations and progress in region economy, being thanks to "scale effect" poles of attraction (concentration) of production factors and where the companies of dynamically developing industries making new goods and services are placed;
