Concerning approval of the Regulations on the consular fee of Ukraine

According to article 57 of the Consular charter of Ukraine approved by the Presidential decree of Ukraine of April 2, 1994 N 127, with changes I ORDER:

1. Approve Regulations on the consular fee of Ukraine which are applied.

2. To submit to department of consular service the order on state registration to the Ministry of Justice of Ukraine.

3. This order becomes effective in 10 days from the date of state registration in the Ministry of Justice of Ukraine.

4. Declare invalid the order the Ministry of Foreign Affairs of Ukraine of 15.12.99 N217 "About Approval of the Regulations on the Consular Fee of Ukraine" registered in the Ministry of Justice of Ukraine 23.12.99 for N910/4203, with changes.

5. I impose control of execution of this order on the director of the department of consular service B. M. Bazilevsky.

Regulations on the consular fee of Ukraine

1. The consular fee is collected for making of consular actions which are performed abroad and in the territory of Ukraine, according to the subitem "o" of Item 6 of article 3 of the Decree of the Cabinet of Ministers of Ukraine "About the state fee" of 21.01.93 N7-93, with changes.

2. The consular fee in the territory of Ukraine collect Department of consular service of the Ministry of Foreign Affairs of Ukraine and representative office of the Ministry of Foreign Affairs of Ukraine in the territory of Ukraine, abroad - diplomatic representations and consular establishments of Ukraine abroad (further - organizations).

3. Rates of the consular fee in the territory of Ukraine and beyond its limits for execution of visa documents for entry into Ukraine and transit through the territory of Ukraine are collected in sizes which are established according to Item 6 of article 3 of the Decree of the Cabinet of Ministers of Ukraine of January 21, 1993 N7-93 "About the State Fee" and the resolution of the Cabinet of Ministers of Ukraine of August 9, 1999 N1457 "About Approval of Rates of the Consular Fee Which Is Collected for Execution of Visa Documents for Entry into Ukraine", with changes.

4. According to Item 10 of the Regulations on the passport of the citizen of Ukraine for the trip abroad approved by the Presidential decree of Ukraine of October 28, 1993 N491 (with changes), for issue and prolongation of effective period of the passport of the citizen of Ukraine for trip abroad in the territory of Ukraine the state fee, and abroad - the consular fee is collected.

5. Rates of the consular fee which is collected for making of consular actions in the territory of Ukraine by Department of consular service and representations the Ministry of Foreign Affairs of Ukraine in the territory of Ukraine are established in tax-free minima of the income of citizens and collected in hryvnias (appendix 1). In cases, stipulated by the legislation Ukraine, the consular fee in the territory of Ukraine can be levied from nonresidents also in any freely converted currency which concerns to the I group of classification of currencies of the NBU, on the official rate of the NBU of national currency of Ukraine to the corresponding foreign currency on the date of the address concerning making of consular action.

6. Basic fares of the consular fee which are collected for making of consular actions by diplomatic representations and consular establishments of Ukraine abroad are established in US dollars (appendix 2), except for the consular fees specified in Item 3 of the Regulations on the consular fee of Ukraine (daleepolozheniye).

7. Rates of the consular fee for making of consular actions by organizations of Ukraine abroad are established within basic fares of the consular fee and based on provisions of the resolution of the Cabinet of Ministers of Ukraine "About approval of rates of the consular fee which is collected for execution of visa documents for entry into Ukraine" of August 9, 1999 N 1457, with changes, and in currency of the country of stay and affirm the Ministry of Foreign Affairs of Ukraine on representation of heads of the relevant diplomatic representations of Ukraine as US dollars abroad. 8. The consular fee which is collected for making of consular actions outside Ukraine can be levied at the request of the applicant in currency of the country of stay or in US dollars.

9. In case of accreditation of the head of diplomatic representation of Ukraine in several states having different national currencies, and implementation of exit consular servicing by organization in the territory of these states in the Ministry of Foreign Affairs of Ukraine also the project of rates of the consular fee which will be collected in these states goes for approval.

10. Rates of the consular fee which are collected abroad annually exchange glances with diplomatic representations of Ukraine abroad, proceeding from the principle of reciprocity and economic country situation of stay (change of the exchange rate of national currency to US dollar, the rate of inflation, consumer price index and so forth), and are sent to approval to the Ministry of Foreign Affairs of Ukraine no later than November 15 every year.

11. In case of essential change of the exchange rate or other essential factors the head of diplomatic representation submits for approval in the Ministry of Foreign Affairs of Ukraine the project of rates of the consular fee according to Item 12 of this Provision.

12. The project of rates of the consular fee which are collected abroad is signed by the head of organization and the consular official. Need of change of the separate tariff charges in detail is proved in explanatory note to the project of rates, and also the exchange rate of local currency to US dollar established by the Central (national) Bank of the country of stay on the date of preparation of the project of rates is specified.

13. After obtaining by organization of the rates approved by the Ministry of Foreign Affairs of Ukraine, the head of organization issues the administrative document in which are determined start date of application of new rates (as a rule, on January 1 the next year), terms of accomplishment of passport and visa transactions, and also legalizations of documents in regular and urgent procedures.

14. In the presence of consular establishments of Ukraine in the territory of foreign state they are guided by the rates of the consular fee approved by the Ministry of Foreign Affairs of Ukraine for the relevant diplomatic representation of Ukraine.

15. The amount of the consular fee is levied before making of consular action.

16. The amount of the consular fee is levied in non-cash type. As exception if the amount of the consular fee cannot be collected in non-cash type (day off or holiday in the country of stay, time off, urgency of making of consular action), then according to the written permission of the head of diplomatic representation or consular establishment of Ukraine the amount of collection is levied by cash with obligatory execution of the relevant documents according to the current legislation of Ukraine.
