About modification of some Decisions of the Commission of the Customs union and Council of the Eurasian economic commission

According to article 52 of the Agreement on the Eurasian Economic Union of May 29, 2014 and Item 29 of appendix № 1 to the Regulations of work of the Eurasian economic commission approved by the Decision of the Supreme Eurasian economic council of December 23, 2014 № 98, Council of the Eurasian economic commission decided:

1. Bring in decisions of the Commission of the Customs union and Council of the Eurasian economic commission of change according to appendix.

2. Determine that requirements for the veterinary medicines specified in appendix 5(1) to the technical regulation of the Customs union "About safety of food products" (to TR CU 021/2011) accepted by the Decision of the Commission of the Customs union of December 9, 2011 No. 880 (further - the technical regulation), determination methods in which food products of animal origin are absent, become effective after development and inclusion in the list of the international and regional (interstate) standards, and in case of their absence - the national (state) standards containing rules and methods of researches (testing) and measurements, including the rules of sampling necessary for application and execution of requirements of the technical regulation and implementation of assessment of conformity of objects of technical regulation, the corresponding interstate standards or national (state) standards containing rules and methods of researches (testing) and measurements, including the rules of sampling necessary for application and execution of these requirements, and also techniques of researches (testing) and measurements certified (validirovanny) and approved according to the legislation of state members of the Eurasian Economic Union (further - state members).

3. Boards of the Eurasian economic commission based on the texts provided by state member in accordance with the established procedure (validirovanny) and approved according to the legislation of this state techniques of researches (testing) and measurements of residual amounts of the veterinary medicines (pharmacological active agents and their metabolites) which are not specified in appendices 3 and 5 certified (1) to the technical regulation, and (or) pharmacological the active agents and their metabolites which are part of the veterinary medicines which are not registered in the territories of state members, data on which are entered in information funds or catalogs of standards of state members, within 14 working days to perform their consideration with participation of the interested authorized bodies of state members and to make the decision on modification of the list of the international and regional (interstate) standards, and in case of their absence - the national (state) standards containing rules and methods of researches (testing) and measurements, including the rules of sampling necessary for application and execution of requirements of the technical regulation and implementation of assessment of conformity of objects of technical regulation.

4. Declare invalid the Decision of Board of the Eurasian economic commission of February 13, 2018 No. 28 "About the most admissible levels of remaining balance of veterinary medicines (pharmacological active agents) which can contain in not processed food products of animal origin, including in raw materials, and techniques of their determination".

5. This Decision becomes effective after 12 months from the date of its official publication.

Appendix

to the Decision of Council of the Eurasian economic commission of June 23, 2023 No. 70

The changes made to decisions of the Commission of the Customs union and Council of the Eurasian economic commission

1. In the technical regulation of the Customs union "About safety of food products" (TR CU 021/2011) accepted by the Decision of the Commission of the Customs union of December 9, 2011 No. 880:

a) in Article 7:

regarding 2 words "4 and 6" shall be replaced with words "4, 5(1) and 6";

regarding 3 figures "4, 6" shall be replaced with words "4, 5(1) and 6";

regarding 4 words "4 and 6" shall be replaced with words "4, 5(1) and 6";

b) add Chapter 2 with Article 9 (1) the following content:

"Article 9 (1). Safety requirements of food products of animal origin, including not processed food products of animal origin, including food (food) staples of animal origin, regarding requirements to content of residual amounts of veterinary medicines (pharmacological active agents and their metabolites)

1. Residual amounts of veterinary medicines (pharmacological active agents and their metabolites) in food products of animal origin, including in not processed food products of animal origin, including food (food) staples of animal origin, shall not exceed the most admissible levels established by appendices 3 and 5 (1) to this technical regulation.
