About modification of the Order of the Government No. 198/2013 about approval of the Regulations on procedure for transfer of irrigating systems to free use (free use) to irrigational associations

Based on the article II of the Law No. 344/2022 on introduction of amendments to the Law No. 171/2010 on irrigational associations (The official monitor of the Republic of Moldova, 2023, No. 9, the Art. 25) DECIDES: the Government

In the Order of the Government No. 198/2013 about approval of the Regulations on procedure for transfer of irrigating systems to free use (free use) to irrigational associations (Official monitor of the Republic of Moldova, 2013, Art. No. 56-59, 248), with subsequent changes, to make the following changes:

1) in the resolution:

a) state Items 2 and 3 in the following edition:

"2. / executive body of the local public authority exercising control on behalf of states / administrative and territorial units of the irrigational and/or drainage infrastructure which is public property or the owner of the irrigational and/or drainage infrastructure which is private property to provide to the agency of the state services in the written request of administrative body according to the legislation statement on the cadastral registration of the real estate which is in public and private property, being component of irrigational and/or drainage systems.

3. The expenses connected with registration of the property right to the real estate constituting irrigational and/or drainage infrastructure, being in property of state / administrative and territorial unit are performed for the account and within the assignments approved on these purposes in the state budget / budget of administrative and territorial unit. Registration of the property right to the real estate constituting irrigational and/or drainage infrastructure, being in private property is performed at the expense of his owner.";
