About modification and amendments in some regulatory legal acts of the Republic of Kazakhstan concerning insurance
Board of the Agency of the Republic of Kazakhstan on regulation and development of the DECIDES: financial market
1. Approve the List of regulatory legal acts of the Republic of Kazakhstan concerning insurance to which changes and additions are made (further – the List), according to appendix to this resolution.
2. To provide to department of the insurance market and actuarial calculations in the procedure established by the legislation of the Republic of Kazakhstan:
1) together with Legal department state registration of this resolution in the Ministry of Justice of the Republic of Kazakhstan;
2) placement of this resolution on official Internet resource of the Agency of the Republic of Kazakhstan on regulation and development of the financial market after its official publication;
3) within ten working days after state registration of this resolution submission to Legal department of data on execution of the action provided by the subitem 2) of this Item.
3. To impose control of execution of this resolution on the supervising vice-chairman of the Agency of the Republic of Kazakhstan on regulation and development of the financial market.
4. This resolution becomes effective after ten calendar days after day of its first official publication, except for paragraphs of the fifteenth and sixteenth List which become effective since January 1, 2024.

to the Resolution of Board of the Agency of the Republic of Kazakhstan on regulation and development of the financial market of August 31, 2023 No. 69
1. Bring in the resolution of Board of National Bank of the Republic of Kazakhstan of January 28, 2016 No. 14 "About approval of Requirements to the specialized software and Rules of determination of the extent of the harm done to the vehicle" (it is registered in the Register of state registration of regulatory legal acts at No. 13460) the following changes and amendments:
in the Rules of determination of the extent of the harm done to the vehicle approved by the specified resolution:
state Items 2 and 3 in the following edition:
"2. Calculation of the extent of the harm done to the vehicle (further – calculation of the extent of harm) is perfromed by the insurer or the appraiser using the licensed specialized software (further – SPO) based on the statement for determination of the extent of the harm done to property containing data according to appendix 1 to Rules.
Survey of the damaged vehicle is drawn up by creation of the inspection report which is containing the data provided by appendix 2 to Rules, including information on possible defects which can be determined by results of survey.
Inspection is performed at service stations upon the demand of the injured (beneficiary).
Carrying out additional survey of the vehicle, including with the hidden defects is performed also based on the statement for determination of the extent of the harm done to property containing data according to appendix 1 to Rules. At the same time survey of the damaged vehicle is performed by the insurer and drawn up by creation of the inspection report containing the data provided by appendix 2 to Rules. Adjustment of calculation of the extent of harm with the hidden defects is drawn up in the form of amendment to the report on the extent of harm.
The injured (beneficiary) or their representative to whose vehicle harm is done from the date of representation by it or the insurer (insured) of the statement for determination of the extent of the harm done to property specified in part one of this Item of Rules keeps the damaged property in such condition in what it was after transport incident and gives opportunity to the insurer to make calculation of the extent of harm.
3. Terms of implementation by the insurer of survey and creation of the inspection report, determination of the extent of the harm done to property are regulated by Item 3 of article 22 of the Law.
Upon termination of the procedure of calculation of the extent of harm the insurer represents to the injured (beneficiary) or their representatives the report on the extent of harm for acquaintance.
The injured (beneficiary) or their representative within 3 (three) working days from the date of receipt of the report on the extent of harm specifies in the received report mark about consent or disagreement with results of the carried-out calculation of the extent of harm with indication of disagreement reasons.
The insurer within 3 (three) working days after receipt of mark about disagreement with results of the carried-out calculation of the extent of harm provides adjustment of calculation in the form of amendment to the report on the extent of harm, or directs the written answer about correctness of the report on the extent of harm with explanations.
The report on the extent of harm is constituted by the insurer and includes calculation of determination of the extent of the harm done to the vehicle which is created in SPO. The report layout about the extent of harm is performed according to appendix 3 to Rules.
In case of failure to provide by the insurer the report on the extent of harm to the injured (beneficiary) or their representative within 5 (five) working days from the date of implementation by the insurer of survey of the damaged vehicle, the injured (beneficiary) or their representative receives insurance payment in the amount of, determined according to Item 3-1 of article 22 of the Law.";
add with Item 3-1 of the following content:
"3-1. Terms of implementation by the insurer of survey and creation of the inspection report, the determinations of the extent of harm specified in Item 3 of Rules are not applied in case of the simplified registration of transport incident according to article 22-2 of the Law."
add with Item 4-1 of the following content:
"4-1. The insurer in case of determination of the extent of harm by the appraiser involved with it based on the service provision agreement presents to the victim or his representative at choice at least two appraisers."
state Item 10 in the following edition:
"10. The insurer in case of creation of calculation of the extent of the harm done to the vehicle in case of need of replacement of detail applies market value of new detail without depreciation in the following cases:
1) concerning the vehicle which owner is the physical person, in case of simultaneous compliance to the following conditions:
the vehicle is not subject to obligatory technical inspection;
annual average vehicle mileage does not exceed 15 thousand kilometers;
the replaced detail of the vehicle was not earlier damaged and was not exposed to repair;
2) concerning the vehicle which owner is the legal entity, in case of simultaneous compliance to the following conditions:
the vehicle is on guarantee maintenance;
annual average vehicle mileage does not exceed 20 thousand kilometers;
the replaced detail of the vehicle was not earlier damaged and was not exposed to repair.
In this case the beneficiary transfers to the possession of the insurer the replaced detail upon the demand of the insurer.";

"11. The insurance ombudsman and insurers provides possibility of calculation of depreciation depreciation on the Internet resource in case of cost determination of the extent of the harm done to the vehicle.";

in Requirements to content and procedure for execution of the insurance policies approved by the specified resolution:
add with Item 6-1 of the following content:
"6-1. The insurance policy on compulsory insurance of civil responsibility of owners of vehicles in addition to the data specified in Item 2 of Requirements contains information on years of service of driving of the insurer and insured (insured) (more than two years, less than two years) and about date of issue of the vehicle (vehicles).".

Statement for determination of the extent of harm
The statement for determination of the extent of the harm done to the vehicle contains the following data:
1) about date and time of receipt of the statement;
2) about the property/vehicle (brand, model), the state registration number (cadastral number, identification number).

Report layout about the extent of the harm done to the vehicle
1. The report on the extent of the harm done to the vehicle contains the following data:
The title page contains 1):
number of the report;
date of creation;
specifying of brand, model and state registration number of the vehicle;
date of survey of object;
full name or surname, name, middle name (in case of its availability) the applicant (beneficiary);
information about the insurer determining the extent of harm: full name, BIN, bank details, legal address;
it is certified by seal (in the presence) with indication of surname, name, middle name (in case of its availability) and the signature of person approving the report;
general information and description of object;
2) settlement part:
calculation of depreciation depreciation;
3) specifying of cost of the replaced details taking into account depreciation *, specifying of amounts and cost of recovery work, material cost specifying specifying of total cost of recovery repair;
4) appendices to the report are contained:
the calculation constituted in SPO;
photos of object;
basic data for calculation creation: the statement on carrying out calculation, the inspection report based on which other documents the report is constituted.
2. The final size of cost is expressed in currency of the Republic of Kazakhstan (tenge) and is reflected in type of the figure rounded to tenge with written disaggregation of the amount in brackets.
3. Marks are provided in the report on the extent of harm:
1) about consent or disagreement with results of the carried-out calculation of the extent of harm;
2) about lack of claims and claims in case of execution of requirements of legal acts of the Republic of Kazakhstan by the insurer.
4. The report on the extent of harm affirms the head of insurance company or person authorized by it.
5. The report is created and provided to the beneficiary in paper or electronic type in the format which is not allowing to make any changes.
* - depreciation is not applied in the cases specified in Item 10 of Rules.
