About approval of Regulations about credit transfer, direct debiting and assignment of the IBAN codes
Based on part (3) the Art. 49, the item b) parts (2) Art. 93 and the item c) parts (1) Art. 94 of the Law No. 114/2012 on payment services and electronic money (Monitorul Oficial al Republicii Moldova, 2012, No. 193-197, the Art. 661), with subsequent changes, the Executive committee of National Bank of Moldova DECIDES:
1. Approve Regulations about credit transfer, direct debiting and assignment of the IBAN codes it (is applied).
2. Declare invalid Item 2 and appendix No. 2 to the Resolution of Executive committee of National Bank of Moldova "About approval, change, amendment and cancellation of some regulations of National Bank of Moldova" No. 157/2013 (to Monitorul Oficial al Republicii Moldova, 2013, No. 191-197, the Art. 1370) registered in the Ministry of Justice of the Republic of Moldova on August 20, 2013 at No. 936.
3. This resolution becomes effective on August 5, 2023.

to the Resolution of National Bank of the Republic of Moldova of June 8, 2023 No. 108
1. These Regulations establish procedure of credit transfer and direct debiting by payment service providers, and also procedure for assignment of the IBAN codes by payment service providers and participants of the automated interbank payment system (further - ASMP).
2. Items 1, of 3, the 4th subitems of 2)-9), 12)-14), 16), and 22), 5, Chapter V, Chapter VI and appendix No. 6 are applied to credit transfers and direct debiting in euro within the Single zone of payments in euro (further - SEPA) when both the payment service provider of the payer, and the payment service provider of the receiver of payment joined the payment schemes SEPA or when the single payment service provider participating in transaction joined the payment schemes SEPA.
3. For the purpose of these regulations the following reducings designate:
1) BIC (Business Identifier Code) - the commercial identification code which is unambiguously identifying the payment service provider whose elements are provided by ISO 9362;
2) IBAN (International Bank Account Number) - the sequence of symbols which unambiguously identifies the payment customer account opened at the payment service provider and which structure corresponds specified in Item 55;
3) ISO (International Organization for Standardization) - International Organization for Standardization;
4) SWIFT (Society for Worldwide Interbank Financial Telecommunications) - the network allowing to send and obtain information on financial transactions;
5) XML (Extensible Markup Language) - extensible markup language.
4. The concepts and expressions used in these regulations matter, specified in the Law No. 114/2012 on payment services and electronic money (further - the Law No. 114/2012) and in other regulations published by National Bank of Moldova. In addition, for the purpose of these regulations the following concepts are used:
1) the Obligation on direct debiting - the agreement signed between the beneficiary and the payment service provider of the receiver of payment which includes the obligatory elements specified in appendix No. 5, and which includes responsibility of the receiver of payment concerning the obligations, and also provided by the payment service provider of the receiver of payment of the acceptance concerning implementation by the receiver of payment of transactions on direct debiting;
2) Collection - part of transaction on direct debiting from the moment of its initiation by the receiver of payment before completion of transaction on debiting of the payment account of the payer;
3) Settlement date - completion date of obligations on money transfer between the payment service provider of the payer and the payment service provider of the receiver of payment;
4) the Single identifier - the code assigned by the payment service provider for the client / user for the purpose of its identification in the direct relation;
5) the Order on direct debiting - the expression of consent and permission provided by the payer to the receiver of payment and the payment service provider of the payer (directly or indirectly through the receiver of payment) to allow the receiver of payment to initiate collection for debiting of the specified account of the payer and for permission to the payment service provider of the payer to observe these instructions;
