About introduction of amendments to the order of the Minister of Agriculture of the Republic of Kazakhstan of March 15, 2019 No. 108 "About approval of Rules of subsidizing of development of breeding livestock production, increase in productivity and product quality of livestock production"
I ORDER:
1. Bring in the order of the Minister of Agriculture of the Republic of Kazakhstan of March 15, 2019 No. 108 "About approval of Rules of subsidizing of development of breeding livestock production, increase in productivity and product quality of livestock production" (it is registered in the Register of state registration of regulatory legal acts No. 18404, it is published on March 28, 2019 in Reference control bank of regulatory legal acts of the Republic of Kazakhstan) the following changes:
state preamble in the following edition:
"According to the subitem 41) of Item 1 of article 6 of the Law of the Republic of Kazakhstan of July 8, 2005 "About state regulation of development of agro-industrial complex and the rural territories", the subitem 2) of Item 3 of article 16 of the Law of the Republic of Kazakhstan of March 19, 2010 "About the state statistics" and the subitem 1) of article 10 of the Law of the Republic of Kazakhstan of April 15, 2013 "About the state services" I ORDER:";
The rules of subsidizing of development of breeding livestock production, increase in productivity and product quality of livestock production approved by the specified order to be reworded as follows according to appendix to this order.
2. To provide to department of production and conversion of livestock products of the Ministry of Agriculture of the Republic of Kazakhstan in the procedure established by the legislation:
1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;
2) placement of this order on Internet resource of the Ministry of Agriculture of the Republic of Kazakhstan after its official publication.
3. To impose control of execution of this order on the supervising vice-Minister of Agriculture of the Republic of Kazakhstan.
4. This order becomes effective after 10 (ten) calendar days after day of its first official publication.

1. These rules of subsidizing of development of breeding livestock production, increase in productivity and product quality of livestock production (further – Rules) are developed according to the subitem 41) of Item 1 of article 6 of the Law of the Republic of Kazakhstan of July 8, 2005 "About state regulation of development of agro-industrial complex and the rural territories", the subitem 1) of article 10 of the Law of the Republic of Kazakhstan of April 15, 2013 "About the state services" (further – the Law) and determine procedure for provision of budget subsidies (further – subsidies) for the account and within the means provided in the local budget for the corresponding financial year, and also procedure for rendering the state service "Subsidizing on Development of Breeding Livestock Production, Increase in Productivity and Product Quality of Livestock Production" (further – the state service).
2. In these rules the following basic concepts are used:
1) the special commission – the commission created at the level of areas, the cities of republican value and the capital which is created of representatives: regional chamber of entrepreneurs of National chamber of entrepreneurs of the Republic of Kazakhstan of Atameken (further – NPP Atameken), the public industry unions / associations / republican chambers and specialists of structural division of local executive body of areas, the cities of republican value, the capital (further - local executive body (service provider)), and performing reconciliation on availability of the corresponding infrastructure at producers;
2) the special account – the account of financial institution in bank of the second level on which the amount of subsidies is credited;
3) the feedlot – the subject of agro-industrial complex having the specialized platform with a capacity at least 1000 heads of cattle / 5000 the heads of small cattle one-timely and performing purchase of bull-calves/cowslip for further fattening;
4) the operator in meat cattle breeding – the feedlot with a capacity at least 1000 heads one-timely performing transfer to lease of breeding manufacturing bulls to commodity and public herds, and also performing purchase of bull-calves for further fattening;
5) financial institution – the financial organizations having licenses for the right of banking operations, and also leasing companies, credit partnerships and the microfinancial organizations in the field of agro-industrial complex;
6) public herd – the herd of cattle created from livestock of personal subsidiary farms;
7) the operator in sheep breeding – economy with livestock of ewes from 3000 heads, performing transfer to lease of breeding manufacturing rams to commodity flocks, and also performing purchase of cowslip for further fattening;
8) domestic agricultural producer (further – producer) - physical person or legal entity, going in for breeding livestock production and (or) production of agricultural products;
9) the request – the electronic request for obtaining by producer of subsidies;
10) target use of the acquired animals – use of the acquired and pro-subsidized animals for the purpose of reproduction on conditions and in the terms specified in these rules;
11) information base of selection and breeding work (further – IBSPR) – the automated system of collection, accumulating and data processing about breeding animals in subjects of breeding livestock production and about the animals involved in selection process, used for enhancement of herd and increase in genetic potential of animals, accompanied with the operator determined by authorized body according to the subitem 34) of article 1 of the Law of the Republic of Kazakhstan of July 9, 1998 "About breeding livestock production";
12) the uterine livestock participating in selection and breeding work – livestock of female individuals of the animals who reached polovozrely age (on cattle breeding: breeding animals – of 13 months, commodity animals – of 18 months, on horse breeding – of 36 months, on camel husbandry – 36 months, on sheep breeding – of 12 months, on maralovodstvo (reindeer breeding) – of 24 months, on pig-breeding – of 8 months), used for reproduction of herd;
13) information system of subsidizing (further – ISS) – the organizational arranged set of information and communication technologies of the placed on the Internet, service personnel and technical documentation intended for rendering services in accomplishment of processes of subsidizing giving interaction opportunity with the web portal of "the electronic government", registration of the request for receipt of subsidies, and also its processings by means of automatic verification of the request for the compliance to subsidizing conditions which is IBSPR subsystem;
14) the electronic register of requests for subsidizing (further – the register) – set of data on requests for subsidizing, and also about borrowers, financial institutions, and other data reflected in ISS;
15) commodity herd / flock – the herd of the large horned cattle / flock of sheep created from livestock of the economy or agricultural cooperative performing conducting selection and breeding work with uterine livestock of the large horned cattle / sheep;
16) pedigree transformation – improvement of pedigree and productive qualities of uterine livestock by use in reproduction of breeding producers;
17) sluchny season – the period of reproduction of farm animals;
18) the web portal of "the electronic government" – the information system representing single window of access to all consolidated government information including the regulatory legal base, and to the state services, services in issue of specifications on connection to the networks of subjects of natural monopolies and services of subjects of the quasi-public sector rendered electronically;
19) the digital signature (further – the EDS) – set of electronic digital symbols created by means of the digital signature and confirming reliability of the electronic document, its accessory and invariance of content.
3. Subsidizing is performed according to the list of the directions and standard rates of subsidizing established in appendix 1 to these rules.
Payment of subsidies is performed based on the submitted application corresponding to criteria to the producers applying for receipt of subsidies (further – criteria), specified in appendix 2 to these rules at the time of giving.
4. The resolution of local executive body (service provider), with amounts of subsidies in the directions of subsidizing is sent by local executive body (service provider) for approval in the Ministry of Agriculture of the Republic of Kazakhstan (further – the Ministry) by means of the Internet portal of state bodies no later than January 20 of the corresponding year.
Amounts of subsidies are determined by the directions of subsidizing according to the priority purposes and indicators of the state and government programs.
5. The ministry within five working days considers the provided subsidizing amounts on compliance to the purposes and indicators of the state and government programs.
In case of the positive decision, the Ministry approves the draft of the resolution of local executive body (service provider) no later than January 25 of the corresponding year. In case of the negative decision, the Ministry no later than January 25 of the corresponding year directs motivated reasons.
The modifed draft of the resolution of local executive body (service provider) is provided on repeated approval in the Ministry no later than January 30 of the corresponding year.
6. Amounts of subsidies within a month after maintaining in action of these rules and in subsequent annually, no later than February 5 affirm the resolution of local executive body (service provider).
After approval of the resolution the local executive body (service provider) within 2 (two) working days places it in ISS and on the official Internet resource.
7. The local executive body (service provider) within 3 (three) working days after approval of monthly funding plan on subsidizing of development of breeding livestock production, increase in productivity and product quality of livestock production (further – the Funding plan) places it in ISS.
8. In case of change of the amounts between the directions of subsidizing corresponding changes and (or) amendments according to the procedure, provided by Items 4, of 5 and 6 these rules are made to the resolution of local executive body (service provider). At the same time, reducing amounts of subsidies in the priority directions according to the purposes and indicators of the state and government programs is not allowed.
9. Subsidies are paid to producers.
10. Subsidies are paid in case of observance of the following conditions:
1) applications in electronic form by means of interaction of the web portal of "the electronic government" with ISS:
on receipt of subsidies for acquisition: breeding uterine number of cattle (milk, milk and meat, meat and meat-and-milk breeds), domestic breeding manufacturing bulls of meat and meat-and-milk breeds, the imported uterine number of cattle, corresponding to pedigree origin, breeding sheep, breeding manufacturing stallion of the productive direction, breeding manufacturing camel, breeding livestock of pigs, breeding uterine livestock of goats, breeding daily young growth parent / прародительской forms of the meat direction of birds and daily young growth of final form of the egg referral got from breeding bird in form 1 according to appendix 3 to these rules;
on receipt of subsidies for content of the breeding manufacturing bulls used for reproduction of herd in form 2 according to appendix 3 to these rules;
on receipt of subsidies for content of the breeding manufacturing rams used for reproduction of commodity flock in form 3 according to appendix 3 to these rules;
on receipt of subsidies for services in artificial insemination of uterine number of cattle in peasant farms and agricultural cooperatives, and also uterine livestock of sheep in farms and agricultural cooperatives in form 4 according to appendix 3 to these rules;
on receipt of subsidies for conducting selection and breeding work with commodity uterine number of cattle in form 5 according to appendix 3 to these rules;
on receipt of subsidies for conducting selection and breeding work with breeding uterine number of cattle in form 6 according to appendix 3 to these rules;
on receipt of subsidies for conducting selection and breeding work with breeding uterine livestock of sheep in form 7 according to appendix 3 to these rules;
on receipt of subsidies for conducting selection and breeding work with commodity uterine livestock of sheep in form 8 according to appendix 3 to these rules;
on receipt of subsidies for conducting selection and breeding work with uterine livestock of marals (deer) in form 9 according to appendix 3 to these rules;
on receipt of subsidies for conducting selection and breeding work with bee colonies in form 10 according to appendix 3 to these rules;
on receipt of subsidies for conducting selection and breeding work with uterine and repair livestock of pigs in form 11 according to appendix 3 to these rules;
on receipt of subsidies for the acquired same-sex and bisexual seed of breeding bulls of milk and milk and meat breeds in form 12 according to appendix 3 to these rules;
on receipt of subsidies for reductions in cost of acquisition value of embryos of cattle and sheep in form 13 according to appendix 3 to these rules;
on receipt of subsidies for reduction in cost of manufacturing cost of fowl (fowl, meat of turkey, waterfowl), food egg, (egg), milk (cow, mare's, camel), and also the procurements of beef by the meat-processing companies which are engaged in face and primary conversion of meat of cattle in form 14 according to appendix 3 to these rules;
on receipt of the subsidies for reduction in cost of cost of the bull-calves/cowslip realized or moved on fattening to feedlots with a capacity at least 1000 heads of the large horned cattle / at least 5000 heads of sheep one-timely or the meat-processing companies with lethal capacity at least 50 heads of cattle a day / at least 300 heads of sheep a day in form 15 according to appendix 3 to these rules;
on receipt of subsidies for reduction in cost of cost of costs for forages of farm animals in form 16 according to appendix 3 to these rules;
on transfer of subsidies for the special account on form 17 according to appendix 3 to these rules;
on receivable subsidies for the acquisition of the imported breeding uterine livestock of the large horned cattle / sheep or the imported uterine number of cattle corresponding to pedigree origin in form 18 according to appendix 3 to these rules;
2) registration of the submitted application in ISS with use of the EDS;
3) request compliance to the criteria established in appendix 2 to these rules.
The list of the main requirements to receipt of subsidies including characteristics of process, form, content and result of provision of subsidies, and also other data taking into account features of provision of subsidies are stated in the standard of the state service "Subsidizing on Development of Breeding Livestock Production, Increase in Productivity and Product Quality of Livestock Production" according to appendix 4 to these rules.
The local executive body (service provider) provides entering of the subsidies granted about stage of obtaining into information system of monitoring of rendering the state services according to the subitem 11) of Item 2 of article 5 of the Law.
Information exchange of the web portal of "the electronic government" and ISS is performed according to article 43 of the Law of the Republic of Kazakhstan of November 24, 2015 "About informatization".
11. Producers before application for receipt of subsidies fill in data in ISS:
1) gross production of livestock products following the results of previous year according to the statistic report;
2) labor productivity according to the statistic report;
3) total areas of pastures and livestock of farm animals.
12. Order taking is performed in the place of stay/registration of farm animals in the terms provided in criteria according to appendix 2 to these rules.
Requests are accepted within the means provided on the corresponding directions according to the approved resolution of local executive body (service provider).
13. For provision of access to data of the register through the web portal (further – the Personal account) the producer needs to have the EDS for independent registration in ISS.
14. For registration in the Personal account the producer specifies the following data:
1) for physical persons and individual entrepreneurs: individual identification number (further – IIN), surname, name and middle name (in case of its availability);
2) for legal entities: business and identification number, full name; surname, name and middle name (in case of its availability) and IIN of the first head;
3) contact information (postal address, phone, e-mail address);
4) current account details of bank of the second level.
In case of change of the above-stated data, producer within 1 (one) working day change the data entered in the Personal account.
15. Forming and registration of the request of producer is made in the Personal account in the following procedure:
1) the request with introduction in it of the data necessary for check of ISS of criteria of subsidizing is created;
2) the request is registered in ISS by its signing of the EDS of producer and becomes available in the Personal account of local executive body (service provider). The electronic notice on revenues to consideration of the request goes to the e-mail address of local executive body (service provider).
16. The executive in charge of local executive body (service provider) within 2 (two) working days from the moment of registration of the request performs verification of the request for completeness of the data specified in appendix 3 to these rules. And also directs the notification on results of consideration of the request for receipt of subsidies, or the motivated answer on refusal in rendering the state service.
17. The executive in charge of local executive body (service provider) creates in ISS of accounts for payment on payment of subsidies loaded into information system "Treasury Client" within 2 (two) working days after confirmation of adoption of the request.
According to requests in which the amount of subsidies exceeds amount of the budgetary funds provided in the Funding plan for the corresponding month payment of subsidies is performed next month, on priority according to receipt date of requests.
18. The financial institution within the signed agreement of crediting on the security of the acquired imported breeding uterine livestock of the large horned cattle / sheep or the imported uterine number of cattle, corresponding to pedigree origin submits to local executive body (service provider) the request for transfer of subsidies for the special account on form 17 according to appendix 3 to these rules.
