1. Bring in the order of the Minister of Agriculture of the Republic of Kazakhstan of March 15, 2019 No. 108 "About approval of Rules of subsidizing of development of breeding livestock production, increase in productivity and product quality of livestock production" (it is registered in the Register of state registration of regulatory legal acts No. 18404) the following changes:

"According to the subitem 41) of Item 1 of article 6 of the Law of the Republic of Kazakhstan "About state regulation of development of agro-industrial complex and the rural territories", the subitem 2) of Item 3 of article 16 of the Law of the Republic of Kazakhstan "About the state statistics" and the subitem 1) of article 10 of the Law of the Republic of Kazakhstan "About the state services" I ORDER:";

in the Rules of subsidizing of development of breeding livestock production, increase in productivity and product quality of livestock production approved by the specified order:

state Item 1 in the following edition:

"1. These rules of subsidizing of development of breeding livestock production, increase in productivity and product quality of livestock production (further – Rules) are developed according to the subitem 41) of Item 1 of article 6 of the Law of the Republic of Kazakhstan "About state regulation of development of agro-industrial complex and the rural territories", the subitem 1) of article 10 of the Law of the Republic of Kazakhstan "About the state services" (further – the Law) and determine procedure for provision of budget subsidies (further – subsidies) for the account and within the means provided in the local budget for the corresponding financial year, and also procedure for rendering the state service "Subsidizing on Development of Breeding Livestock Production, Increase in Productivity and Product Quality of Livestock Production" (further – the state service).";

state Item 2 in the following edition:

"2. In these rules the following basic concepts are used:

1) the special commission – the commission created at the level of areas, the cities of republican value and the capital which is created of representatives: regional chamber of entrepreneurs of National chamber of entrepreneurs of the Republic of Kazakhstan of Atameken (further – NPP Atameken), the public industry unions / associations / republican chambers and specialists of structural division of local executive body of areas, the cities of republican value, the capital (further - local executive body (service provider)), and performing reconciliation on availability of the corresponding infrastructure, issue and withdrawal of the conclusions at producer;

2) the special account – the account of financial institution in bank of the second level on which the amount of subsidies is credited;

3) the database on identification of farm animals (further – ISZh) – the part of veterinary accounting providing single, multi-level data recording system about individual number of animal, about its veterinary processings, including results of diagnostic testings, and also data on the animal owner, performed by the state veterinary organizations created by local executive bodies, and used by authorized body in the field of veterinary science;

4) agricultural producer (further – producer) - physical person or legal entity, engaged in production of agricultural products, including reproduction of animals high genetic potential, their preserving and cultivation;

5) the feedlot – the subject of agro-industrial complex having the specialized platform and performing purchase of the large horned cattle / small cattle of men's individuals for further fattening;

6) the operator in meat cattle breeding – the feedlot performing transfer to lease of breeding manufacturing bulls to commodity and public herds, and also performing purchase of cattle of men's individuals for further fattening;

7) the agreement of crediting - the agreement signed between financial institution and the borrower (uslugopoluchatel) under the terms of which the financial institution provides the credit/microcredit and includes the framework agreement, the agreement on opening of credit line, the credit agreement, the credit agreement, the loan agreement, the agreement on provision of the microcredit, and also other agreements meeting the requirements to the loan agreement;

8) financial institution – the financial organizations having licenses for the right of banking operations, and also credit partnerships and the microfinancial organizations in the field of agro-industrial complex;

9) public herd – the herd of cattle created from livestock of personal subsidiary farms;

10) the operator in sheep breeding – the feedlot performing transfer to lease of breeding manufacturing rams to commodity flocks, and also performing purchase of small cattle of men's individuals for further fattening;

11) the request – the electronic request for obtaining by producer of subsidies;

12) target use of the acquired animals – use of the acquired and pro-subsidized animals for the purpose of reproduction on conditions and in the terms specified in these rules;

13) information base of selection and breeding work (further – IBSPR) – the automated system of collection, accumulating and data processing about breeding animals in subjects of breeding livestock production and about the animals involved in selection process, used for enhancement of herd and increase in genetic potential of animals, accompanied with the operator determined by authorized body according to the subitem 34) of article 1 of the Law of the Republic of Kazakhstan "About breeding livestock production";

14) the uterine livestock participating in selection and breeding work – the livestock which reached polovozrely age (on cattle breeding: breeding animals – of 13 months, commodity animals – of 18 months, on horse breeding – of 36 months, on camel husbandry – 36 months, on sheep breeding – of 12 months, on maralovodstvo (reindeer breeding) – of 24 months, on pig-breeding – of 8 months), used for reproduction of herd;

15) information system of subsidizing (further – ISS) – the organizational arranged set of information and communication technologies of the placed on the Internet, service personnel and technical documentation intended for rendering services in accomplishment of processes of subsidizing giving interaction opportunity with the web portal of "the electronic government", registration of the request for receipt of subsidies, and also its automated processing in electronic form, IBSPR which is subsystem;

16) the electronic register of requests for subsidizing (further – the register) – set of data on requests for subsidizing, and also about borrowers, financial institutions, and other data reflected in ISS;

17) commodity herd / flock – the herd of the large horned cattle / flock of sheep created from livestock of the economy or agricultural cooperative performing conducting selection and breeding work with uterine livestock of the large horned cattle / sheep;

18) pedigree transformation – improvement of pedigree and productive qualities of uterine livestock by use in reproduction of breeding producers;

19) sluchny season – the period of reproduction of farm animals;

20) the web portal of "the electronic government" – the information system representing single window of access to all consolidated government information including the regulatory legal base, and to the state services and other services rendered electronically;

21) the digital signature (further – the EDS) – set of electronic digital symbols created by means of the digital signature and confirming reliability of the electronic document, its accessory and invariance of content.";

state Item 10 in the following edition:

"10. Subsidies are paid in case of observance of the following conditions:

1) applications in electronic form by means of interaction of the web portal of "the electronic government" with ISS:

on receipt of subsidies for acquisition: breeding uterine number of cattle (milk, milk and meat, meat and meat-and-milk breeds), breeding manufacturing bulls of meat and meat-and-milk breeds, the imported uterine number of cattle, corresponding to pedigree origin, breeding sheep, breeding manufacturing stallion of the productive direction, breeding manufacturing camel, breeding livestock of pigs, breeding uterine livestock of goats, breeding daily young growth parent / прародительской forms of the meat direction of birds and daily young growth of final form of the egg referral got from breeding bird in form 1 according to appendix 3 to these rules;

on receipt of subsidies for content of the breeding manufacturing bulls used for reproduction of herd in form 2 according to appendix 3 to these rules;

on receipt of subsidies for content of the breeding manufacturing rams used for reproduction of commodity flock in form 3 according to appendix 3 to these rules;

on receipt of subsidies to the breeding and distribyyuterny centers for services in artificial insemination of uterine number of cattle in peasant farms and agricultural cooperatives, and also uterine livestock of sheep in farms and agricultural cooperatives in form 4 according to appendix 3 to these rules;

on receipt of subsidies for conducting selection and breeding work with commodity uterine number of cattle in form 5 according to appendix 3 to these rules;

on receipt of subsidies for conducting selection and breeding work with breeding uterine number of cattle in form 6 according to appendix 3 to these rules;

on receipt of subsidies for conducting selection and breeding work with breeding uterine livestock of sheep in form 7 according to appendix 3 to these rules;

on receipt of subsidies for conducting selection and breeding work with commodity uterine livestock of sheep in form 8 according to appendix 3 to these rules;

on receipt of subsidies for conducting selection and breeding work with uterine livestock of marals (deer) in form 9 according to appendix 3 to these rules;

on receipt of subsidies for conducting selection and breeding work with bee colonies in form 10 according to appendix 3 to these rules;

on receipt of subsidies for conducting selection and breeding work with uterine and repair livestock of pigs in form 11 according to appendix 3 to these rules;

on receipt of subsidies for the acquired same-sex and bisexual seed of breeding bulls of milk and milk and meat breeds in form 12 according to appendix 3 to these rules;

on receipt of subsidies for reductions in cost of acquisition value of embryos of cattle and sheep in form 13 according to appendix 3 to these rules;

on receipt of subsidies for reduction in cost of manufacturing cost of fowl (fowl, meat of turkey, waterfowl), food egg, (egg), milk (cow, mare's, camel), and also the procurements of beef by the meat-processing companies which are engaged in face and primary conversion of meat of cattle in form 14 according to appendix 3 to these rules;

on receipt of subsidies for reduction in cost of cost of cattle (including breeding men's individuals of milk or milk and meat breeds) / small cattle of the men's individuals realized or at least 50 heads of cattle moved on fattening to feedlots or the meat-processing companies with lethal capacity a day / at least 300 heads of sheep a day in form 15 according to appendix 3 to these rules;

on receipt of subsidies for reduction in cost of cost of costs for forages to uterine livestock of farm animals in form 16 according to appendix 3 to these rules;

on transfer of subsidies for the special account on form 17 according to appendix 3 to these rules;

on receivable subsidies for the acquisition of the imported breeding uterine livestock of the large horned cattle / sheep or the imported uterine number of cattle corresponding to pedigree origin in form 18 according to appendix 3 to these rules;

2) registration of the submitted application in ISS with use of the EDS;

3) request compliance to the criteria established in appendix 2 to these rules.

The list of the main requirements to receipt of subsidies including characteristics of process, form, content and result of provision of subsidies and also other data taking into account features of provision of subsidies is stated in the standard of the state service "Subsidizing on Development of Breeding Livestock Production, Increase in Productivity and Product Quality of Livestock Production" according to appendix 4 to these rules.

The local executive body (service provider) provides entering of the subsidies granted about stage of obtaining into information system of monitoring of rendering the state services according to the subitem 11) of Item 2 of article 5 of the Law.

Information exchange of the web portal of "the electronic government" and ISS is performed according to article 43 of the Law of the Republic of Kazakhstan "About informatization".

Till December 20, 2022 inclusive the standard rate of subsidies for reduction in cost of manufacturing cost of meat of turkey constitutes 200 tenges, since January 1, 2023 the standard rate of 100 tenges is effective.

Standard rates of subsidies, criteria to receivers of subsidies, and submission due dates of the request for receipt of subsidies for reduction in cost of cost of costs for forages to uterine livestock of farm animals affirm the resolution of local executive body of areas, cities of republican value, the capital.";

state Item 12 in the following edition:

"12. Order taking is performed in the place of stay/registration of farm animals in the terms provided in criteria according to appendix 2 to these rules.

Requests are accepted within the means provided on the corresponding directions according to the approved resolution of local executive body (service provider).

In case of shortage of the means provided on the corresponding directions according to the approved resolution of local executive body (service provider), requests arrive in reserve (waiting list).";

15, of 16, of 17, of 18, 19 and 20 to state Items in the following edition:

"15. Forming and registration of the request of producer is made in the Personal account in the following procedure:

1) the request with introduction in it of the data specified in appendix 3 to these rules is created;

2) the request is registered in ISS by its signing of the EDS of producer and becomes available in the Personal account of local executive body (service provider). The electronic notice on revenues to consideration of the request goes to the e-mail address of local executive body (service provider).

16. The executive in charge of local executive body (service provider) within 2 (two) working days from the moment of registration of the request performs verification of the request for completeness of the data specified in appendix 3 to these rules. And also directs the notification on results of consideration of the request for receipt of subsidies, or the motivated answer on refusal in rendering the state service.

17. The executive in charge of local executive body (service provider) creates in ISS of accounts for payment on payment of subsidies loaded into information system "Treasury Client" within 2 (two) working days after confirmation of adoption of the request.

According to the requests which arrived in reserve (waiting list), payment of subsidies is performed on priority according to date and time of receipt of requests, in case of allocation of additional budgetary funds in the following financial year based on the approved resolution of local executive body (service provider), with amounts of subsidies in the directions of subsidizing.

18. The financial institution within the agreement of crediting signed according to the civil legislation of the Republic of Kazakhstan submits to local executive body (service provider) the request for transfer of subsidies for the special account on form 17 according to appendix 3 to these rules.

For receipt of subsidies for the special account, financial institution to the request loads in electronic format "PDF (the scanned version of paper option with the written signature or certified with the EDS (QR code)): positive decision of credit committee of financial institution, agreement of crediting.

Within 3 (three) working days from registration date of the request in ISS subsidies are transferred into the special account of financial institution in bank of the second level within the signed contract with payment deferral (with partial payment) or agreements of crediting for the acquisition of the imported breeding uterine livestock of the large horned cattle / sheep or the imported uterine number of cattle corresponding to pedigree origin.

The producer upon acquisition of the imported breeding uterine livestock of the large horned cattle / sheep or the imported uterine number of cattle, corresponding to pedigree origin enters in ISS the data specified in the request in form 18 according to appendix 3 to these rules.

In the absence of the fact of acquisition of the imported breeding uterine livestock of the large horned cattle / sheep or the imported uterine number of cattle, corresponding to pedigree origin, the producer confirmed by registration of the large horned cattle / sheep in IBSPR and application for receivable subsidies for the acquisition of the imported breeding uterine livestock of the large horned cattle / sheep or the imported uterine number of cattle corresponding to pedigree origin in form 18 according to appendix 3 to these rules, the financial institution within 120 (hundred twenty) days from the moment of receipt of the amount of subsidies returns them in local executive body (service provider).

19. Poultry farms/feedlots / milk and commodity farms / the meat-processing companies with lethal capacity from 50 heads of cattle or 300 heads of sheep receive the decision of the special commission on compliance of infrastructure of the producer applying for receipt of subsidies (further – the conclusion) according to appendix 5 to these rules. The procedure of forming and work of the commission is regulated by the decision of NPP Atameken.

20. The special commission verifies availability of the corresponding infrastructure of the companies to the criteria specified in appendix 2 to these rules and issues the conclusion in form according to appendix 5 to these rules. The scanned copy and data from the conclusion are entered by local executive body (service provider) in ISS within 2 (two) working days from the date of provision of the signed conclusion by the special commission.

Determination of compliance of producer to criteria is performed within 5 (five) working days on a grant basis based on the written notice of producer in regional chamber of entrepreneurs of NPP Atameken. The term of consideration is prolonged for no more than 5 (five) working days, in coordination with producer.

The reconciliation of compliance of producers to criteria is performed by the special commission once in three years, or in case of change of the criteria established by these rules.

The special commission is authorized to carry out monitoring of activities of the producers who received the decision on compliance to criteria and requirements for each type of subsidizing and in case of identification of violations to withdraw the conclusion at producer.

To producer the notification on results of consideration of the request for receipt of subsidies in electronic form according to appendix 6 to these rules goes. The notification goes to the e-mail address specified by producer in case of registration in ISS, also in ISS "personal account"".;

state Item 22 in the following edition:

"22. Consideration of the claim concerning rendering the state services is made by higher administrative authority, the official, authorized body by assessment and control of quality of rendering the state services (further – the body considering the claim).

The claim is submitted to the service provider and (or) the official whose decision, action (failure to act) is appealed.

The service provider, the official, whose decision, action (failure to act) is appealed, no later than 3 (three) working days from the date of receipt of the claim send it and administrative case to the body considering the claim.

At the same time the service provider, the official whose decision, action (failure to act) is appealed, has the right not to send the claim to the body considering the claim if he within 3 (three) working days makes the decision, will make administrative action, completely meeting requirements specified in the claim.

If other is not provided by the law, appeal to the court is allowed after appeal in pre-judicial procedure.";

2. To provide to department of production and conversion of livestock products of the Ministry of Agriculture of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Agriculture of the Republic of Kazakhstan after its official publication.

3. To impose control of execution of this order on the supervising vice-Minister of Agriculture of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.
