About introduction of amendments to some acts of the Government of the Russian Federation

The government of the Russian Federation decides:

1. Approve the enclosed changes which are made to Regulations on attraction by the specialized non-profit organization performing the activities aimed at providing carrying out capital repairs of common property in apartment houses, contract organizations for rendering services and (or) performance of works on capital repairs of common property in the apartment house approved by the order of the Government of the Russian Federation of July 1, 2016 No. 615 "About procedure for involvement of contract organizations for rendering services and (or) performance of works on capital repairs of common property in the apartment house and procurement procedure of goods, works, services for the purpose of accomplishment of functions of the specialized non-profit organization performing the activities aimed at providing carrying out capital repairs of common property in apartment houses" (The Russian Federation Code, 2016, No. 28, Art. 4740; 2017, No. 38, Art. 5629; 2019, No. 16, Art. 1944; 2020, No. 30, Art. 4898; 2021, No. 40, Art. 6865; 2022, No. 19, Art. 3228).

2. Paragraph two (in the part concerning paragraph two of the subitem "b" of Item 38) and the paragraph third the subitem "b" of Item of 22 changes which are made to Regulations on attraction by the specialized non-profit organization performing the activities aimed at providing carrying out capital repairs of common property in apartment houses, contract organizations for rendering the services and (or) performance of works on capital repairs of common property in the apartment house approved by the order of the Government of the Russian Federation of September 9, 2017 No. 1092 "About modification of the Regulations on attraction by the specialized non-profit organization performing the activities aimed at providing carrying out capital repairs of common property in apartment houses contract organizations for rendering services and (or) performance of works on capital repairs of common property in the apartment house" (Russian Federation Code, 2017, No. 38, Art. 5629), to recognize invalid.

3. This resolution becomes effective after 7 days from the date of its official publication, except for the paragraph of the third Item of 1 changes approved by this resolution which becomes effective since July 1, 2024.

Changes which are made to Regulations on attraction by the specialized non-profit organization performing the activities aimed at providing carrying out capital repairs of common property in apartment houses, contract organizations for rendering services and (or) performance of works on capital repairs of common property in the apartment house

1. In the text:

the words "executive body of the subject" in the corresponding number and case shall be replaced with words "executive body of the subject" in the corresponding number and case;

3. In Item 38:

a) in the subitem "b":

declare paragraph two invalid;

in paragraph three of the word "the copy of license for activities on preserving objects of cultural heritage (historical and cultural monuments) the people of the Russian Federation in accordance with the legislation of the Russian Federation about licensing of separate types of activity" shall be replaced with words "the statement from the register of licenses for activities on preserving objects of the cultural heritage (historical and cultural monuments) the people of the Russian Federation provided in electronic form, signed by the strengthened qualified digital signature of the licensing body or in case of maintaining the specified register of licenses in information system which operator is the federal executive body, the digital signature of the specified information system";

add with the paragraph of the following content:

"copies of the documents confirming compliance of skill level of the worker specified in the subitem "p" of Item 23 this provision, to the level established by the corresponding professional standard approved by the federal executive body performing functions on development and realization of state policy and normative legal regulation in the field of work (in case of carrying out preliminary selection on inclusion in the register of qualified contract organizations in the subject of electronic auction provided by the subitem "v" of Item 8 of this provision);";

b) add with the subitem "v" of the following content:

"c) consent to processing of personal data according to the Federal Law "About Personal Data" of each worker which personal data contain in the application for participation in preliminary selection.".

4. In Item 66:

a) add the subitem "l" with the words "or non-presentations by contract organization in case of change of the data on contract organization containing in the register of qualified contract organizations, in body for maintaining the document register, specified in Item 69 of this provision, at the scheduled time";

b) add with the subitem "m" of the following content:

"l) inclusions of information on the contract organization included in the register of qualified contract organizations by results of new preliminary selection before the expiration of the period for which the contract organization was included in the register of qualified contract organizations, - regarding the information containing in the register of qualified contract organizations and included in it by results of earlier made preliminary selection.".

5. In the paragraph the second Item 69 of the word "paragraphs the second and eighth" shall be replaced with words "the paragraph the eighth".

6. Add Item 157 with the subitem "e" of the following content:

"e) application concerning contract organization self-regulatory organization of measure of disciplinary impact in the form of suspension of the right to carry out engineering researches, to perform preparation of the project documentation, construction, reconstruction, capital repairs, demolition of capital construction projects.".

7. Add Item 220 with the subitem "g" of the following content:

"d) factual determination, the Item 157 of this provision specified in the subitem "e", concerning person with whom the agreement on carrying out capital repairs shall be signed.".

8. In Item 276 of the word of "orders of legislative (representative) public authority of the subject of the Russian Federation, offers and requests of the management official of the subject of the Russian Federation (the head of the supreme executive body of the government of the subject of the Russian Federation)" shall be replaced with words "orders of legislature of the subject of the Russian Federation, offers and requests of the management official of the subject of the Russian Federation".

9. In Item 281 of the word "Executive Body of the Subject" shall be replaced with words "Executive body of the subject".
