About the state fee

The Parliament adopts this organic law.

Article 1. State fee

The state fee is the sum of money levied by state bodies and others, specially authorized on that subjects from physical persons and legal entities for the benefit of which actions are performed or documents are issued.

Article 2. Stamp tax

(1) the Stamp tax is the sum of money levied once from physical persons and legal entities for initiation of judicial proceedings on civil case, administrative dispute and also for each claim to the solution of the stating subject in production about offense, both in the first instance, and in the course of appeal.

(2) the Sum of money paid as the stamp tax is not compensated, except as specified, provided by this law.

(3) In departure from part (1) the stamp tax is not levied from bodies of the public power and public organizations within claims which subject is collection of sums of money for benefit of the national public budget.

(4) the Stamp tax constitutes 200 lei.

Article 3. Subject to taxation by the state fee

Are assessed with the state fee:

a) actions for declaration, counter actions, declarations of accession to process, the statements of appeal, cassation statements and other statements provided by appendix 1, of the statement for contest of acts and actions of the legal executive and also issue of copies (duplicates) of documents by degree of jurisdiction, according to appendix 1;

b) state registration of the facts and events of civil status and issue of documents of civil status;

c) the statement for loss of the passport of the citizen of the Republic of Moldova, consideration of the application for receipt of nationality of the Republic of Moldova owing to recognition, naturalization, for the benefit of the republic and recovery in nationality of the Republic of Moldova; issue of the invitation to the Republic of Moldova; issue or prolongation of visas; consideration of the application about provision or prolongation of the right to temporary stay; consideration of the application about provision of the right to permanent stay; provision or prolongation of the right to temporary stay for the purpose of labor activity; consideration of the application about provision or prolongation of the right to stay; issue of confirmation about repatriation; issue of the temporary or permanent residence permit; certification of the personality for stateless persons; issue of the travel document for stateless persons; test of assessment of level of proficiency in Romanian;

d) registration at the place of residence and/or in the place of temporary stay;

e) registration of the organizations providing audiovisual media services;

f) issue of permissions to the right of hunting and fishing;

g) pledge registration, issue of the statement from the Register of pledges of personal estate or provision of any other information on pledge registration;

h) making by notaries and other representatives law persons of notarial acts;

i) issue of permission to use of official or historical state in the trademark and/or service mark, and also in the industrial drawing or model;

j) putting down of apostille on the document issued addressed to or for the benefit of physical persons (citizens of the Republic of Moldova, foreign citizens and stateless persons) and legal entities;

k) issue of the diploma about registration of public symbol, and also copies and statements from the General armorial of the Republic of Moldova addressed to or for the benefit of owners;

l) provision of permission to use of official or historical state or abbreviations or derivative of official or historical state in the name of the legal entity pursuing revenue generating purpose;

m) submission of claims by economic operators within the procedures of the public, industry and concessionary procurements.

Article 4. Sizes of rates of the state fee

The sizes of rates of the state fee are provided in appendix 1.

Article 5. Exemptions of the state fee and stamp tax

(1) Exemptions of the state fee and the stamp tax are provided in appendix 2.
