Based on part (11) article 19 of the Aviation code of the Republic of Moldova No. 301/2017 (The official monitor of the Republic of Moldova, 2018, Art. No. 95-104, 189), with subsequent changes, DECIDES: the Government

1. Approve Regulations on registration of civil aircrafts and maintaining the Aviation register of the Republic of Moldova it (is applied).

2. To the ministry of infrastructure and regional development and Organa of civil aviation in 6-month time from the effective date of this resolution to approve the regulations provided by the specified Provision.

3. From the effective date this resolution to recognize invalid the Aviation rules RAC-47 - Registration of civil aircrafts, approved by the order of the CEO of Public administration of civil aviation No. 46/GEN of May 3, 2001 (The official monitor of the Republic of Moldova, 2001, No. 120, the Art. 279), with subsequent changes.

4. To impose control over the implementation of this resolution on the Ministry of infrastructure and regional development.

5. This resolution becomes effective after 6 months from the date of publication in the Official monitor of the Republic of Moldova.

Regulations on registration of civil aircrafts and maintaining the Aviation register of the Republic of Moldova

Chapter I General provisions

1. The regulations on registration of civil aircrafts and maintaining the Aviation register of the Republic of Moldova (further - the Provision) determine the general requirements and ministerial procedures concerning:

1) entering into the Aviation register of the Republic of Moldova / exception of the Aviation register of the Republic of Moldova (further - the Aviation register) civil aircrafts;

2) issues, changes, suspensions of action or withdrawal of the registration certificate;

3) issues of the certificate on exception of the register;

4) assignments and drawings national and registration signs, aircraft addresses;

5) maintaining the Aviation register.

2. For the purpose of application of this provision the detailed requirements and ministerial procedures concerning registration of civil aircrafts and maintaining the Aviation register are determined in the rules of civil aviation approved by the Ministry of infrastructure and regional development and the subordinate technical documents approved by Body of civil aviation (further - RSA).

3. Requirements of this provision are applied to all civil aircrafts, except for the following categories:

1) state aircrafts;

2) the aerostats used only in the meteorological purposes and pilotless uncontrollable aerostats without payload;

3) the aircrafts starting with legs (hang-gliders, paraplanes, motor-paraplanes, etc.);

4) the pilotless aircrafts which are not answering to the conditions provided in item 4;

5) the aircrafts provided in appendix 2 to the Aviation code of the Republic of Moldova No. 301/2017.

4. The owner of the pilotless aircraft which project is subject to certification shall register the corresponding aircraft if it answers any of the following requirements:

1) its size constitutes at least 3 m, and it is designed for operation over accumulations of people;

2) it is designed for transportation of persons;

3) it is designed for transportation of dangerous goods and requires the increased durability level for decrease in risks for the third parties in case of aviation incident.

5. The ministry of infrastructure and regional development approves the rules of civil aviation containing requirements to registration / determination of categories of the aircrafts specified in subitems of 3)-5) of Item 3, and the RSA approves procedures, the instructions, other documents of technical nature necessary for application of rules of civil aviation.

6. For the purpose of this provision the following concepts are determined:

the aircraft address - the individual combination from 24 bits appropriated to RSA to the aircrafts registered in the Republic of Moldova for the purpose of ensuring communication "air - the earth", navigation and observation;

the registration certificate - the individual document issued to RSA on each separately taken aircraft in confirmation of its registration in the Aviation register;

the certificate on exception of the register - the individual document confirming aircraft exception of the Aviation register;

the certificate of type - the valid document issued by RSA or foreign body under which jurisdiction there is standard project of aviation product approved, recognized or confirmed to RSA which certifies compliance of the standard project of the aircraft, the engine or screw specified in the document, to requirements of the certified base applicable to the corresponding aviation product registered in files of data of the certificate of type;

the owner of the aircraft - the legal entity or physical person which acquired right to use and performing ownership of the aircraft based on the stipulated by the legislation term of the contract;

registration sign - the sign consisting of group of letters or figures, appropriated to RSA to each aircraft which is entered in the Aviation register;

national sign - the sign consisting of group of letters, specifying the state in which the aircraft is registered;
