Based on Item a) article 7 of the Law No. 132/2012 on safe implementation of nuclear and radiological activities (The official monitor of the Republic of Moldova, 2012, Art. No. 229-233, 739), with subsequent changes, DECIDES: the Government

1. Approve Regulations on radiation monitoring of metal materials, good for reuse, throughout complete cycle of collection, realization and processings it (is applied).

2. To impose control over the implementation of provisions of this resolution on National agency on regulation of nuclear and radiological activities under the Ministry of the environment.

3. This resolution becomes effective after 6 months from the date of publication in the Official monitor of the Republic of Moldova.

Regulations on radiation monitoring of metal materials, good for reuse, throughout complete cycle of collection, realization and processing

Chapter I Purpose and scope of application

1. This Provision establishes requirements to radiation control of metal materials, good for reuse, throughout complete cycle of collection, realization and processing for the purpose of ensuring radiation safety of the population, workers and the environment established by provisions of the Law No. 289/2022 on the main requirements in the field of radiation safety (further - the Law No. 289/2022) and international treaties which party is the Republic of Moldova.

2. In this Provision concepts which are determined in the Law No. 289/2022, and also the following concepts are used:

the consignee - any legal entity receiving expedition;

the freight forwarder - any legal entity preparing expedition from the point of view of transportation;

expedition - any packaging, set of packagings or any load containing materials or goods which the consignor transfers to carrier for transportation;

metal materials, good for reuse, - the metal materials of ferrous and non-ferrous metals intended for secondary conversion and/or industrial use;

it is radioactive the contaminated metal materials, good for reuse, / metal materials, good for reuse, with content of radioactive components - the metal materials, good for reuse, contaminated by radioactive materials or activated as a result of nuclear reactions or containing radioactive sources or is radioactive the contaminated materials;

radiation level measurement - measurement of ambient dose of gamma radiation or radioactive pollution (availability of the radionuclides which are letting out alpha, beta, gamma or neutron emission) for determination of availability of radioactive material on expedition (batch) of metal materials, good for reuse;

radiation monitoring - one or several methods of determination of radioactive pollution: administrative control, survey and/or measurement of radiation level;

transport operator - the company performing motor or rail haulings on paid basis by own or any other vehicles;

alarm threshold - the level established on the device for measurement of radiation in case of which exceeding researches for check of expedition for the purpose of identification of possible availability of radioactive sources shall be begun and/or it is radioactive the contaminated materials in metal materials, good for reuse;

ownerless source - radioactive source which activity at the time of its detection exceeds the withdrawal level provided in the Law No. 132/2012 on safe implementation of nuclear or radiological activities (further - the Law No. 132/2012), and which is not under control of the National agency on regulation of nuclear and radiological activities or because it never was under control or because he was left, lost, incorrectly placed, stolen or given to the new owner without proper notice of the National agency on regulation of nuclear and radiological activities and the corresponding informing the consignee.

3. For the purposes of this provision the general concept metal materials, good for reuse, includes also secondary raw materials received as a result of recovery of the metal materials which are subject to conversion.

4. Regulations of this provision extend to the metal materials, good for reuse, arriving from:

1) the operators having nuclear and/or radiological installations with radioactive sources and/or radioactive materials;

2) the operators having installations on production or conversion of radioactive natural materials which can concentrate during engineering procedure;

3) the operators taking the installations specified in subitems 1) and 2) out of service;

4) the operators managing metal materials, good for reuse, namely - operators, metal materials, performing collection, sale, purchase or use good for reuse;
