At the request of Coordination council of the Commonwealth public organization (Union) of the organizations of veterans of the independent states

The coordination council of "Commonwealth (Union) of the Organizations of Veterans of the Independent States" public organization appealed to Economic Court of the Commonwealth of Independent States with request about interpretation of application of the Agreement on mutual recognition of the rights to preferential journey for disabled people and participants of the Great Patriotic War, and also persons equated to them, of March 12, 1993 and giving explanation whether the having the right State Parties of this agreement the national regulatory legal acts to cancel or reduce the amount of privileges provided by this Agreement. In reasons for request the Coordination council refers to cancellation in a number of the states of privileges on journey on transport, suspense in the State Parties of the Agreement of March 12, 1993 of question of providing disabled people and participants of the Great Patriotic War according to article 7 of the Agreement coupons on the preferential drive by railway, air, water or international road transport for 2001-2005, and also claims of citizens of Bagirov I. F. (Azerbaijan Republic), Katysheva E. U. (Republic of Kazakhstan) and Arapova K. F. (Russian Federation) on the fact that they were not granted the right of preferential journey from one state of the CIS to another.

Having researched the materials brought into Economic Court, having studied the legislation of the State Parties of the Agreement of March 12, 1993 including accepted for the purpose of implementation of the reached agreements and having analyzed it taking into account provisions of the Vienna convention on the right of international treaties of 1969 and other international legal acts, according to Item 127 of Regulations the Economic Court draws the following conclusion.
