I ORDER:

1. Bring in the order of the acting minister on investments and development of the Republic of Kazakhstan of June 26, 2015 No. 727 "About approval of Rules of issue, storage, withdrawal of registration certificates and confirmations of accessory and reality of open key of the digital signature by root certification center of the Republic of Kazakhstan, certification center of state bodies and national certification center of the Republic of Kazakhstan (it is registered in the Register of state registration of regulatory legal acts at No. 12181) the following changes:

The rules of issue, storage, withdrawal of registration certificates and confirmation of accessory and reality of open key of the digital signature by root certification center of the Republic of Kazakhstan approved by the specified order to be reworded as follows according to appendix 1 to this order;

The rules of issue, storage, withdrawal of registration certificates and confirmation of accessory and reality of open key of the digital signature by certification center of state bodies of the Republic of Kazakhstan approved by the specified order to be reworded as follows according to appendix 2 to this order;

The rules of issue, storage, withdrawal of registration certificates and confirmation of accessory and reality of open key of the digital signature by national certification center of the Republic of Kazakhstan approved by the specified order to be reworded as follows according to appendix 3 to this order.

2. To department of digital decisions of the Ministry of digital development, innovations and aerospace industry of the Republic of Kazakhstan in the procedure established by the legislation to provide:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of digital development, innovations and the aerospace industry of the Republic of Kazakhstan;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry of digital development, innovations and the aerospace industry of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. To impose control of execution of this order on the supervising vice-minister of digital development, innovations and the aerospace industry of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication, except for the paragraph four Items 1 of this order which becomes effective since April 30, 2024.

Rules of issue, storage, withdrawal of registration certificates and confirmation of accessory and reality of open key of the digital signature by root certification center of the Republic of Kazakhstan

Chapter 1. General provisions

1. These rules of issue, storage, withdrawal of registration certificates and confirmation of accessory and reality of open key of the digital signature by root certification center of the Republic of Kazakhstan (further – Rules) are developed according to the subitem 12) of Item 1 of article 5 of the Law of the Republic of Kazakhstan "About the electronic document and the digital signature" (further – the Law), and determine procedure for issue, storage, withdrawal of registration certificates and confirmation of accessory and reality of open key of the digital signature by root certification center of the Republic of Kazakhstan.

2. In these rules the following basic concepts are used:

1) means of cryptographic information security (further – SKZI) – the software or the hardware and software realizing algorithms of cryptographic transformations, generation, forming, distribution or management of enciphering keys;

2) the list of the withdrawn registration certificates (further – SORS) – the part of the register of registration certificates containing data on registration certificates which are terminated their serial numbers, date and the reason of recall (cancellations);

3) certification center – the legal entity certifying compliance of open key of the digital signature to the closed key of the digital signature, and also confirming reliability of the registration certificate;

4) root certification center of the Republic of Kazakhstan (further – KUTs) – the certification center performing confirmation of accessory and reality of open keys of the digital signature of certification centers;

5) the applicant – certification center, except for KUTs;

6) the user – the owner of the registration certificate of certification center except for KUTs;

7) the registration certificate – the electronic document issued by the certification center for confirmation of conformity of the digital signature to requirements established by the Law;

8) withdrawal of the registration certificate – the procedure of recognition of the registration certificate invalid in KUTs;

9) the owner of the registration certificate – physical person or legal entity addressed to which the registration certificate legally owning the closed key corresponding to the open key specified in the registration certificate is granted;

10) the digital signature (further – the EDS) – set of electronic digital symbols created by means of the digital signature and confirming reliability of the electronic document, its accessory and invariance of content;

11) electronic document management system (further – EDMS) – system of exchange of electronic documents, the relations between which participants are governed by the Law and other regulatory legal acts of the Republic of Kazakhstan.

Chapter 2. Procedure for issue of the registration certificate to certification center

3. For issue to certification center the registration certificate the reallotted KUTs, the applicant represents to KUTs by means of mail or special mail service, purposely, or through EDMS the following documents:

1) the statement on issue of the registration certificate to certification center in form, according to appendix 1 to these rules;

2) copy of the certificate on accreditation of certification center;

3) the registration certificate of certification center in electronic form.

4. After consideration of documents KUTs makes issue of the registration certificate to certification center and registers it in the register of registration certificates.

KUTs reallots the registration certificate of certification center, by provision of the new registration certificate where in structure of the registration certificate, in the field the Publisher, is appropriated data KUTs.

5. Issue of the registration certificate to certification center, is performed by means of mail or special mail service, purposely, or through EDMS within fifteen working days, after submission of documents, the these rules specified in Item 3.

6. KUTs refuses to certification center issue of the registration certificate in the following cases:

1) incompleteness of the submitted documents;

2) submissions of false information;

3) according to the judgment which took legal effect;

4) not achievements of sixteen-year age by person.

The written motivated answer about refusal in issue of the registration certificate to certification center, goes to the applicant by means of mail or special mail service, purposely, or through EDMS within fifteen working days from the date of the address of the applicant to KUTs.

7. Effective period of the registration certificate, does not exceed effective period of the registration certificate KUTs.

Chapter 3. Procedure for storage of the registration certificates granted by KUTs

8. Document storage about creation and cancellation of the EDS is performed according to the List of the standard documents which are formed in activities of the state and non-state organizations, with indication of storage duration, to No. 263 approved by the order of the Minister for Culture and Sports of the Republic of Kazakhstan performing obligations of September 29, 2017 (it is registered in the Register of state registration of regulatory legal acts for No. 15997).

9. After fifteen years, documents on creation and cancellation of the EDS, arrive on archive storage in National Archive Fund according to Regulations of Admission, storages, accounting and use of documents of National Archive Fund and other archive documents by departmental and private archives approved by the order of the Minister for Culture and Sports of the Republic of Kazakhstan of August 25, 2023 No. 235 (it is registered in the Register of state registration of regulatory legal acts for No. 33338).

Chapter 4. Procedure for withdrawal of the registration certificate of certification center

10. The withdrawal of registration certificates of certification center, is performed in the following cases:

1) upon the demand of the owner of the registration certificate, or his representative based on the statement on withdrawal of the registration certificate in form, according to appendix 2 to these rules;

2) in case of factual determination of submission of false information or incomplete document package in case of receipt of the registration certificate;

3) changes of the name, reorganization, liquidation of the legal entity – the owner of the registration certificate, change of the head of the legal entity;

4) provided by the agreement between certification center and the owner of the registration certificate;

5) on the judgment which took legal effect.

11. For withdrawal of the registration certificate of certification center, the applicant represents to KUTs by means of mail or special mail service, purposely, or through EDMS the official letter with the supporting document of approach of one of cases, stipulated in Item 10 these rules.

12. The withdrawal of the registration certificate of certification center is performed within one working day from the moment of registration of the official letter for withdrawal of the registration certificate.

13. After consideration of documents KUTs makes records in the register of registration certificates on cancellation of the registration certificate with indication of date, the reason and time of withdrawal of the registration certificate of certification center within one working day from the date of receipt of the relevant information.

14. KUTs publishes data on the withdrawn registration certificates, their serial numbers and the reason of recall in SORS KUTs on Internet resource to the address www.root.gov.kz.

The SORS updating is made with frequency at least once a month.

Chapter 5. Procedure for confirmation of accessory and reality of open key of the digital signature

15. The user of KUTs in case of receipt of the registration certificate, performs its check on confirmation of accessory and reality of open key of the EDS with use of SKZI of certification center, by accomplishment of the following checks:

1) registration certificate of the KUTs EDS certification center;

2) effective period of the registration certificate of certification center;

3) otozvannost of the registration certificate of certification center.
