About maintaining the state register of objects of cumulative harm to the environment
According to article 80.2 of the Federal law "About Environmental Protection" Government of the Russian Federation decides:
1. Approve the enclosed Rules of maintaining the state register of objects of cumulative harm to the environment.
2. Recognize to invalid:
the order of the Government of the Russian Federation of April 13, 2017 No. 445 "About approval of Rules of maintaining the state register of objects of cumulative harm to the environment" (The Russian Federation Code, 2017, No. 17, the Art. 2568);
Item of 1 changes which are made to acts of the Government of the Russian Federation, approved by the order of the Government of the Russian Federation of December 25, 2019 No. 1834 "About cases in case of which identification of objects of cumulative harm to the environment and the organization of liquidation of cumulative harm to the environment are performed by the federal executive bodies authorized by the Government of the Russian Federation or federal state budgetary institutions, state-owned federal state institutions subordinated to them, and also about introduction of amendments to some acts of the Government of the Russian Federation" (The Russian Federation Code, 2020, No. 1, the Art. 36).
3. To the Ministry of Natural Resources and Environmental Protection of the Russian Federation in time, No. 449-FZ which is not exceeding 30 working days from the date of receipt of information from Federal Service for the Oversight of Consumer Protection and Welfare according to Item 3 of article 5 of the Federal Law of August 4, 2023 "About modification of separate legal acts of the Russian Federation" to make the decision on updating of information on object of cumulative harm to the environment, to perform prioritization of such object taking into account level and amount of its negative impact on life and health of citizens and to enter corresponding changes in the state register of objects of cumulative harm to the environment.

1. These rules determine procedure for maintaining the state register of objects of cumulative harm to the environment (further respectively - object, the state register), including criteria of determination of objects, cumulative harm to the environment on which is subject to liquidation in first-priority procedure (further - criteria of determination of objects).
2. Maintaining the state register includes consideration of results of the inventory count of objects which is carried out according to article 80.2 of the Federal law "About Environmental Protection", decision making about inclusion of objects in the state register or about refusal in inclusion of objects in the state register, determination of objects, updating of information on object (further - updating) and exception of objects of the state register.
3. The state register is kept by the Ministry of Natural Resources and Environmental Protection of the Russian Federation based on results of inventory count of objects. The state register contains:
a) sequence number of object;
b) name of object;
c) description of location of object;
d) the area of the territory (water area) on which cumulative harm to the environment is revealed;
e) quantity of the population living in the territory in which environment can be subject to negative impact of object;
e) date of inclusion of object in the state register;
g) date of exception of object of the state register;
h) value of general influence of the object determined by results of prioritization of object taking into account level and amount of negative impact of object on the environment and also on life and health of citizens (further - prioritization of object).
4. The data containing in the state register are placed in federal state information system of state of environment and on the official site of the Ministry of Natural Resources and Environmental Protection of the Russian Federation on the Internet in open access.
5. Applicants in these rules are understood as the public authorities of the Russian Federation, public authorities of subjects of the Russian Federation or local government bodies specified in Item 5 of article 80.1 of the Federal law "About Environmental Protection".
6. The application for inclusion of object in the state register is submitted by the applicant to the Ministry of Natural Resources and Environmental Protection of the Russian Federation in writing or electronically, signed by the strengthened qualified digital signature, according to the standard application form established by the Ministry of Natural Resources and Environmental Protection of the Russian Federation.
The results of inventory count of object specified in Item 2 of these rules are enclosed to the application for inclusion of object in the state register.
7. By results of consideration of the application makes the decision on inclusion of object in the state register or on refusal in inclusion of object in the state register with indication of causes of failure on inclusion of object in the state register and results of inventory count of the objects provided by the applicant, the Ministry of Natural Resources and Environmental Protection of the Russian Federation in time, which is not exceeding 30 working days from the date of receipt of the statement.
8. The bases for refusal in inclusion of object in the state register is submission of unreliable, incomplete information and (or) materials, stipulated in Item 6 these rules.
9. After inclusion of object in the state register by the Ministry of Natural Resources and Environmental Protection of the Russian Federation within 30 working days prioritization of object based on criteria of determination of objects according to appendix is performed.
General influence of object on the environment, and also on life and health of citizens is determined by summing of the received values of criteria of determination of objects (1 - 12), provided by appendix to these rules.
Information on results of prioritization of object joins in the state register.
10. In case of change of information on object containing in the state register, public authorities of the Russian Federation, public authorities of subjects of the Russian Federation or local government bodies according to which statement object is included in the state register within 30 working days from the moment of receipt of such information send to the Ministry of Natural Resources and Environmental Protection of the Russian Federation the staticized information on object according to standard form, stipulated in Item 6 these rules.
If the project of liquidation of cumulative harm to the environment provides step-by-step carrying out liquidation of cumulative harm to the environment, public authorities of the Russian Federation, public authorities of subjects of the Russian Federation or local government bodies according to which statement object is included in the state register, within 30 working days from the moment of completion of each stage of liquidation of cumulative harm to the environment can send to the Ministry of Natural Resources and Environmental Protection of the Russian Federation the staticized information on object according to standard form, stipulated in Item 6 these rules, with appendix of the act of acceptance of stage of liquidation of cumulative harm on object and the positive conclusion of Federal Nature Management Supervision Service about liquidation of cumulative harm on object.
11. The Ministry of Natural Resources and Environmental Protection of the Russian Federation in time, not exceeding 30 working days from the date of receipt from the applicant of the staticized information, makes the decision on updating of information on object and enters corresponding changes in the state register or makes the decision on refusal in updating of information on object with indication of causes of failure.
12. The basis for refusal in updating of information containing in the state register is submission of unreliable, incomplete information and (or) materials, stipulated in Item 6 these rules.
13. After updating of information containing in the state register, the Ministry of Natural Resources and Environmental Protection of the Russian Federation within 30 calendar days performs (in case of need) prioritization of object based on criteria of determination of object.
Information on results of prioritization of object following the results of updating joins in the state register.
Prioritization of object in case of step-by-step carrying out liquidation of cumulative harm to the environment is not performed.
14. The bases for object exception of the state register are:
a) liquidation of cumulative harm to the environment on object;
b) transfer to the third parties of right of possession and (or) use of the object which is in the state-owned or municipal property.
15. In the case specified in the subitem "an" of Item 14 of these rules, the application for object exception of the state register is submitted by the public authorities of the Russian Federation, public authorities of subjects of the Russian Federation or local government bodies specified in Item 2 of article 80.3 of the Federal law "About Environmental Protection" with indication of sequence number of object and its name in the state register.
Are enclosed the act of acceptance of liquidation of cumulative harm on object to the application for object exception of the state register and the positive conclusion of Federal Nature Management Supervision Service about liquidation of cumulative harm on object.
16. In the case specified in the subitem "b" of Item 14 of these rules, the application for object exception of the state register is submitted by the public authorities of the Russian Federation, public authorities of subjects of the Russian Federation or local government bodies specified in Item 5 of article 80.1 of the Federal law "About Environmental Protection" with indication of sequence number of object and its name in the state register.
The materials confirming transfer to the third parties of rights of possession and (or) uses of the object which is in the state-owned or municipal property are enclosed to the application for object exception of the state register.
17. The statement for object exception of the state register with appendix of the materials specified in Items 15 and 16 of these rules goes the applicant to the Ministry of Natural Resources and Environmental Protection of the Russian Federation in writing or electronically, signed by the strengthened qualified digital signature.
18. By results of consideration of the application about object exception of the state register, information and the materials provided by the applicant according to Items 15 and 16 of these rules, the Ministry of Natural Resources and Environmental Protection of the Russian Federation in time, not exceeding 30 working days from the date of receipt of the statement, makes the decision on object exception of the state register or on refusal in object exception of the state register with indication of causes of failure.
19. The basis for refusal in object exception of the state register is submission of unreliable, incomplete information and (or) materials according to Items 15 and 16 of these rules.
20. If the organization of liquidation of cumulative harm is performed by the Ministry of Natural Resources and Environmental Protection of the Russian Federation or federal state budgetary institutions, state-owned federal state institutions subordinated to it, the object exception of the state register is performed by the Ministry of Natural Resources and Environmental Protection of the Russian Federation in time, not exceeding 30 working days from the date of signing of the act of acceptance of liquidation of cumulative harm on object.

c) criterion 3 - the level and amount of negative impact on the environment. The specified criterion is estimated depending on exceeding of the established values of standard rates of quality of the environment, including the threshold limit values (TLV) of chemicals in waters of water objects, atmospheric air and the soil (further - standard rates of quality), according to the following table:

In case of identification of simultaneous exceeding of several established standard rates of quality value of criterion 3 is determined by the maximum size of standard rates of quality;
d) criterion 4 - availability on objects of cumulative harm to the environment of dangerous substances, including radioactive materials, highly toxic substances, the substances having cancerogenic, mutagen properties (substances I, II of classes of danger) which concentration exceeds the established standard rates of quality and (or) sanitary and hygienic standard rates, including threshold limit values of chemicals in waters of water objects, atmospheric air and the soil. The specified criterion accepts zero value in case of lack of the specified substances or accepts the value equal to 0,1, in the presence of the specified substances;
e) criterion 5 - arrangement of object of cumulative harm to the environment in borders of the settlement having the status of the city according to the regulatory legal act accepted by the subject of the Russian Federation. The specified criterion accepts zero value in case of arrangement of object of cumulative harm to the environment beyond the borders of the city or accepts the value equal 1, in case of its arrangement in city borders;
e) criterion 6 - quantity of the population living in the territory in which environment can be subject to negative impact of object of cumulative harm to the environment. The specified criterion is estimated according to the following table:

g) criterion 7 - arrangement of object of cumulative harm to the environment in the Arctic zone of the Russian Federation. The specified criterion accepts the value equal to 0,5, in case of arrangement of such object in borders of the Arctic zone of the Russian Federation or accepts zero value in case of absence in borders of the specified zone of such object;
h) criterion 8 - category of risk of harmful effects of object of cumulative harm to the environment on life and health of citizens. The specified criterion is estimated according to the following table:

i) criterion 9 - arrangement of object of cumulative harm to the environment on lands of especially protected natural territories, in the conservation zone of especially protected natural territory (the national natural park, national park, the natural park, nature sanctuary), in the district of sanitary (mountain and sanitary) protection of medical and improving areas, resorts and natural medical resources. The specified criterion accepts the value equal to 0,5, in case of arrangement of such object on lands of especially protected natural territories, in the conservation zone of especially protected natural territory (the national natural park, national park, the natural park, nature sanctuary), in the district of sanitary (mountain and sanitary) protection of medical and improving areas, resorts and natural medical resources or accepts zero value in case of absence in borders of the specified lands of such object;
j) criterion 10 - arrangement of object of cumulative harm to the environment in the Baikal natural territory. The specified criterion accepts the value equal to 0,5, in case of arrangement of such object in borders of the Baikal natural territory or accepts zero value in case of absence in borders of the specified zone of such object;
k) criterion 11 - arrangement of object of cumulative harm to the environment in the water protection zone of water object, coastal protective strip, zone of sanitary protection of sources of drinking and economic and household water supply, fishery reserved zone. The specified criterion accepts the value equal to 0,5, in case of arrangement of such object in the water protection zone of water object, coastal protective strip, zone of sanitary protection of sources of drinking and economic and household water supply, fishery reserved zone or accepts zero value in case of absence in the specified zone of such object;
l) criterion 12 - arrangement of object of cumulative harm to the environment on which solid utility waste is placed, in borders of the first - the sixth aerodrome environs subbands. The specified criterion accepts the value equal to 0,5, in case of arrangement of such object in borders of the first - the sixth subbands of aerodrome environs or accepts zero value in case of absence in the specified borders of such object.
