Some questions of ensuring rehabilitation with supportive applications

The Cabinet of Ministers of Ukraine decides:

1. Bring in the resolution of the Cabinet of Ministers of Ukraine of April 5, 2012 No. 321 "About approval of the Procedure for ensuring rehabilitation with supportive applications (technical and other means of rehabilitation) of persons with disability, children with disability and other separate categories of the population and payment of monetary compensation of cost for independently acquired such means, their list" (The Official Bulletin of Ukraine, 2012, No. 31, Art. 1146; 2018, No. 31, Art. 1087; 2021, No. 33, Art. 1943, No. 46, Art. 2856, No. 78, Art. 4911; 2022, No. 34, the Art. 1852, No. 97, the Art. 6053) the enclosed changes.

2. Determine that:

supportive applications of rehabilitation (technical and other means of rehabilitation) (further - means of rehabilitation) which are stored in structural divisions concerning social protection of the population district, district in Kiev and Sevastopol of public administrations, executive bodies of city, district councils in the cities (further - social security authorities of the population) and are unsuitable to further use, are subject to write-off according to the procedure, determined by the Ministry of social policy, family and unity;

means of rehabilitation which are not subject to write-off and are stored in social security authorities of the population, are subject to transfer to rental centers of means of rehabilitation, offices of assistivny technologies of healthcare institutions for the location of social security authority of the population according to the procedure, established by the Ministry of social policy, family and unity in coordination with the Ministry of Health;

means of rehabilitation with which persons with disability, children with disability, other persons it was provided temporarily for production of the ordered means of rehabilitation or carrying out repair of the issued means of rehabilitation before entry into force of this resolution are subject to return to social security authorities of the population after the period for which they were issued (except means of rehabilitation which useful life expired).

3. To the ministry of social policy within three months from the date of the termination or cancellation of warlike situation to develop procedure for return of means of rehabilitation, providing with which is carried out according to the resolution of the Cabinet of Ministers of Ukraine of April 5, 2012 No. 321 "About approval of the Procedure for ensuring rehabilitation with supportive applications (technical and other means of rehabilitation) of persons with disability, children with disability and other separate categories of the population and payment of monetary compensation of cost for independently acquired such means, their list" (The Official Bulletin of Ukraine, 2012, No. 31, Art. 1146; 2022, No. 34, Art. 1852).

Changes which are made to the resolution of the Cabinet of Ministers of Ukraine of April 5, 2012 No. 321

1. Third Item 1 of the resolution after the words "separate categories of the population" to add the paragraph with the words "or for acquisition of which the monetary compensation is paid".

The procedure for ensuring rehabilitation with supportive applications (technical and other means of rehabilitation) of persons with disability, children with disability and other separate categories of the population and payment of monetary compensation of cost for independently acquired such means approved by the specified resolution to state in the following edition:

General questions

1. This Procedure establishes the mechanism:

1) free ensuring rehabilitation with supportive applications (technical and other means of rehabilitation) (further - means of rehabilitation):

persons with disability and children with disability;

children with violations of the musculoskeletal device;

persons on whom operation of the Law of Ukraine "On the status of veterans of military service, veterans of law-enforcement bodies, veterans of National police and some other persons and their social protection" expatiates;

women, girls after mastectomy, sectoral resection of mammary gland, kvadrantektomiya and with violations of development of mammary glands;

elderly people;

the military personnel (reservists, persons liable for call-up, volunteers Sil of territorial defense) Armed Forces, National guard, the SSU, Service of foreign intelligence, State frontier service, State special transservice, the military personnel of military prosecutor's offices, faces of the private and the commanding structure of divisions of operational providing anti-terrorist operation zones of GNS, State Customs Service, police officers, faces of the private and the commanding structure, the military personnel of the Ministry of Internal Affairs, Management of the state protection, Gosspetssvyaz, GSChS, the Public penitentiary service formed according to the laws of other military forming, the persons which were part of voluntary forming of territorial community, protecting independence, sovereignty and territorial integrity of Ukraine and which were directly involved in anti-terrorist operation, being directly in areas of conducting anti-terrorist operation during its carrying out, in implementation of actions for ensuring national security and defense, repulse and control of the armed aggression of the Russian Federation in the Donetsk and Luhansk regions, being directly in areas and during implementation of the specified actions, in the actions necessary for ensuring defense of Ukraine, protection of safety of the population and interests of the state in connection with military aggression of the Russian Federation against Ukraine (further - the military personnel);

employees of the companies, organizations, the organizations which were attracted and were directly involved in ensuring conducting anti-terrorist operation, being directly in areas and during its carrying out, in ensuring implementation of actions for ensuring national security and defense, repulse and control of the armed aggression of the Russian Federation in the Donetsk and Luhansk regions, being directly in areas and during implementation of the specified actions, in the actions necessary for ensuring defense of Ukraine, protection of safety of the population and interests of the state in connection with military aggression of the Russian Federation against Ukraine, and also the civilians living in areas of conducting anti-terrorist operation, in areas of implementation of actions for ensuring national security and defense, repulse and control of the armed aggression of the Russian Federation in the Donetsk and Luhansk regions under condition, that by such persons it is not made criminal offenses, persons concerning whom established fact of deprivation of personal liberty owing to the armed aggression of the Russian Federation against Ukraine, and also persons who in the period of warlike situation in Ukraine or its certain areas during service, labor and other activity, accommodation in the corresponding territory were wounded, contusion, mutilation or disease owing to military aggression of the Russian Federation against Ukraine, being directly in areas of carrying out military (fighting) operations or in the areas which were exposed to bombings, airstrikes and other armed attacks (further - victims);

victims of labor accidents or occupational diseases;

persons with disability from among the foreigners, persons without citizenship who are constantly living in Ukraine and persons recognized as the refugees or persons needing additional protection;

2) payments of monetary compensation of cost for independently acquired means of rehabilitation (further - compensation) to persons determined by the subitem of 1 this Item;

3) non-cash transfer (compensation) of means to the subjects of managing which executed individual requests of persons determined by the subitem of 1 this Item for production of means of rehabilitation, rendering services in their repair.

2. Treat means of rehabilitation which provide persons determined by the subitem of 1 Item of 1 this Procedure (further - persons):

prosthetic and orthopedic products, including orthopedic footwear;

special means for self-service and leaving;

supportive applications for personal mobility, movement and rise;

means for movement;

furniture and equipment;

special means for orientation, communication and exchange of information.

3. Persons have the right to free ensuring rehabilitation with means according to the laws of Ukraine "About bases of social security of persons with disability in Ukraine", "About child care", "About the status of veterans of war, guarantees of their social protection", "About the status of veterans of military service, veterans of law-enforcement bodies, veterans of National police and some other persons and their social protection", "About rehabilitation of persons with disability in Ukraine", "About rehabilitation in the field of health care", "About the basic principles of social protection of veterans of work and other citizens of advanced age in Ukraine", "About social and legal protection of persons concerning whom established fact of deprivation of personal liberty owing to the armed aggression against Ukraine, and members of their families".
