About modification and the amendments in some legal acts of the Republic of Uzbekistan directed to further enhancement of procedure for elections and referendum

In recent years for the purpose of deepening of democratic reforms and upgrade of the country the large-scale reforms directed to strengthening of role of parliament and political parties, further enhancement of procedure for elections and referendum are performed.

At the same time there is need for further expansion of role of political parties for activities of parliament and local representative bodies, increase in responsibility and activity of deputies and senators, elected to representative bodies, for activities of parliament and local representative bodies, enhancement and increase in efficiency of activities of Central Election Commission of the Republic of Uzbekistan, optimization of system of the electoral commissions and forming of system of centralized electoral bodies, ensuring increase in their professional training.

Adoption of the Constitutional Law of the Republic of Uzbekistan "About the Constitution of the Republic of Uzbekistan" also requires modification and amendments of the existing legal acts of the Republic of Uzbekistan.

This Constitutional Law makes changes and additions to some legal acts of the Republic of Uzbekistan providing elections of deputies of Legislative house of Oliy Majlis of the Republic of Uzbekistan on the basis of the mixed electoral system (majority and pro rata), and also forming of centralized system of the electoral bodies, optimization of system of the electoral commissions, enhancement of activities of Central Election Commission of the Republic of Uzbekistan and increase in number of the women pushed by political parties from thirty percent to forty percent from total number of candidates.

This Constitutional Law will serve strengthening of ties between political parties and deputies, to further increase in the status of political parties and professional level of the electoral bodies.

Article 1. Bring in the Law of the Republic of Uzbekistan of November 18, 1991 No. 417-XII "About referendum of the Republic of Uzbekistan" (in edition of the Law of the Republic of Uzbekistan of August 30, 2001 No. 265-II) (Sheets of Oliy Majlis of the Republic of Uzbekistan, 2001, No. 9-10, of Art. 176; 2005, No. 1, Art. 18; Sheets of chambers of Oliy Majlis of the Republic of Uzbekistan, 2019, No. 9, Art. 588; 2021, appendix to No. 4; 2022, No. 3, Art. 216, No. 6, Art. 574, No. 10, Art. 983; 2023, No. 5, Art. 316) following changes and amendments:

Part the second Article 7 to state 1) in the following edition:

"Preparation and holding referendum are performed by the commissions on holding referendum. They inform citizens on the work, on formation of sites for vote, on structure of the commissions, their location and operating time, acquaint with lists of the voting citizens, report about vote results";

2) in Article 8:

in part two of the word "in the district commissions" shall be replaced with words "in the relevant territorial commissions";

in part three of the word "District Commission on Holding Referendum" shall be replaced with words "The territorial commission";

Paragraph two of part one of Article 9 to state 3) in the following edition:

"be present at meetings of the commissions on holding referendum";

To exclude 4) from the name of Chapter III of the word "DISTRICTS And";

Article 15 to exclude 5);

Article 16 to state 6) in the following edition:

"Article 16. Sites of referendum

The polling precincts formed according to the Electoral code of the Republic of Uzbekistan during referendum are considered as sites of referendum.

Sites of referendum under diplomatic and other representations of the Republic of Uzbekistan in foreign states, in military units, in sanatoria, rest houses, in hospitals and other stationary medical institutions, in the locations of the citizens located in the remote and hard to reach areas in places of detention and imprisonment are formed according to the procedure, established by the Electoral code of the Republic of Uzbekistan for formation of the polling precincts";

"The organization and holding referendum are performed:

Central Election Commission of the Republic of Uzbekistan;

the territorial commissions - regional and Tashkent city territorial election commissions;

precinct election commissions on holding referendum.

In the territory of the Republic of Karakalpakstan of power of the territorial commissions, connected with preparation and holding referendum, specified in this Law, the Central Election Commission of the Republic of Karakalpakstan performs.

In case of holding referendum along with elections of the President of the Republic of Uzbekistan, in Legislative house of Oliy Majlis of the Republic of Uzbekistan, the Jokargi Kenes of the Republic of Karakalpakstan, in representative bodies of the power of areas, areas and cities the organization and holding referendum can be assigned to the relevant electoral commissions";

8) in Article 18 part one:

paragraphs two - to replace the fourteenth with paragraphs the second - the thirteenth the following content:

"heads system of the territorial commissions and precinct election commissions on holding referendum, exercises control of execution of this Law in all territory of the Republic of Uzbekistan, provides its uniform application;

performs the common directorship and coordination of activities for use of the Single electronic electoral register of the Republic of Uzbekistan;

resolves issues of addition to the corresponding territory of the sites of referendum formed under diplomatic and other representations of the Republic of Uzbekistan in foreign states;

publishes the information about structure and the location of the territorial commissions;

determines procedure for modification of structure of the territorial commissions and precinct election commissions by holding referendum;

cancels independently or on representation of the Attorney-General of the Republic of Uzbekistan decisions of the territorial commissions and precinct election commissions on holding referendum in cases if these decisions contradict this Law;

issues mandates to observers of foreign states, the international organizations on referendum;

develops and approves expense budget on preparation and holding referendum, distributes money to the territorial commissions and precinct election commissions on holding referendum, controls providing precinct election commissions on holding referendum by rooms, transport and means of communication, considers other questions of material logistics of referendum;

establishes mandate sample for observers from political parties, self-government institutions of citizens, initiative groups of citizens, representatives of mass media, observers from other states, the international organizations;

establishes samples and forms of voting bulletin on referendum, lists of the citizens having the participation right in referendum, subscription lists, protocols of the territorial commissions and precinct election commissions on holding referendum and other documents, samples of ballot boxes and seals of the territorial commissions and precinct election commissions on holding referendum determines procedure for their storage;

hears messages of representatives of the territorial commissions, precinct election commissions on holding referendum, political parties, ministries, state committees and departments, public authorities on places, other state bodies and non-state non-profit organizations on the questions connected with preparation and holding referendum";

the fifteenth - the twenty first to consider paragraphs respectively paragraphs the fourteenth - the twentieth;

Articles 19 and 20 to state 9) in the following edition:

"Article 19. Formation of the territorial commissions

The territorial commissions are formed by Central Election Commission of the Republic of Uzbekistan according to the procedure, established by the Electoral code of the Republic of Uzbekistan.

Article 20. Powers of the territorial commission

Territorial commission:

exercises control of execution of this Law in the corresponding territory;

forms sites of referendum, establishes their numbering on the territory, publishes their lists with indication of the address;

forms precinct election commissions on holding referendum and publishes the information about their structure and the location;

coordinates activities of precinct election commissions for holding referendum;

distributes funds between precinct election commissions on holding referendum, controls providing precinct election commissions on holding referendum by rooms, transport, means of communication and considers other questions of material logistics of referendum in the corresponding territory;
