About introduction of amendments to the order of the Minister of Finance of the Republic of Kazakhstan of February 16, 2018 No. 208 "About some questions of application of cash registers"

I ORDER:

1. Bring in the order of the Minister of Finance of the Republic of Kazakhstan of February 16, 2018 No. 208 "About some questions of application of cash registers" (it is registered in the Register of state registration of regulatory legal acts at No. 16508) the following changes:

6) of Item 1 to state the subitem in the following edition:

"6) Rules of inclusion (exception) of models of cash registers in (from) state (state) the register (register) of cash registers according to appendix 6 to this order;";

According to the subitem 11) of Item 2 of article 5 of the Law, the service provider provides entering of data into information system of monitoring of rendering the state services on stage of rendering the state service according to the procedure, established by authorized body in the field of informatization.

In case of modification and (or) amendments in these rules the service provider within 3 (three) working days after registration in the Ministry of Justice of the Republic of Kazakhstan sends information on modification of procedure for rendering the state service to Single contact center and to the operator of information and communication infrastructure of "the electronic government".";

be reworded as follows Item 6:

"6. The organization of work of the operator of fiscal data consists in realization of the following functions promoting accomplishment of its tasks fully:

1) creation and operation according to regulatory legal acts of the Republic of Kazakhstan of hardware and software system for acceptance, processing, storage and transfer in invariable type to bodies of state revenues of data on the cash settlement transactions performed using cash register;

2) ensuring functioning of information and telecommunication network in the territory of the Republic of Kazakhstan allowing to perform VPN connection of cash registers to hardware and software system of the operator of fiscal data;

3) connection of the cash registers included in the state register of cash registers to hardware and software system (server) of the operator of fiscal data and rendering services in acceptance, processing and storage of data on the cash calculations perfromed using cash register on paid or non-paid basis. Connection on paid basis is made on the rates approved according to the procedure, established according to article 20 of the Law of the Republic of Kazakhstan "About communication";

4) development and commissioning of system of acceptance, storage and data transmission of cash registers;

5) ensuring creation and technical support of the portal of the operator of fiscal data for interactive interaction with users of services of the operator of fiscal data, and also development for them additional services and placement on the portal;

6) creation of service of consulting and technical support of taxpayers, bodies of state revenues and centers of maintenance of cash registers for questions: works of the portal, hardware and software system, information and telecommunication network of the operator of fiscal data;

7) approval of the legal act concerning the responsibility of employees of operator of fiscal data for disclosure, information leakage which is tax, state secret and other information protected by the law;

8) rendering of services in the order of acceptance, storages of data from cash registers, and also their transfers to bodies of state revenues by the operator of fiscal data on the basis of agreements of rendering services, except the receiver of data, after registration on the portal of the operator of fiscal data by means of the digital signature;

9) processing of fiscal data includes actions of the operator of fiscal data on collection, record, systematization, accumulating, storage in invariable type, to extraction, use, provision of access of state revenues to bodies to fiscal data (and also any other information on the taxpayer), except for their changes, depersonalization, blocking, removal or destruction;

10) ensuring service of the operator of fiscal data at least six areas (geographical zones of numbering), the cities of republican value and in the capital.";

in Rules of transfer of data on cash registers with function of fixing and (or) data transmission by the operator of the fiscal state revenues yielded in bodies approved by the specified order:

2) of Item 7 to state the subitem in the following edition:

"2) on paper in case of impossibility of transfer of data on KKM with FPD in electronic form, in forms according to appendices 2 "Statement of cash register with function of fixing and (or) data transmission on accounting (change of the data specified in registration card of cash register with function of fixing and (or) data transmission)" and 3 "Removal from registration accounting of cash register with function of fixing and (or) data transmission" to these rules.";

state Item 8 in the following edition:

"8. The committee directs the reference book of the KKM models with FPD to e-mail of OFD in form according to appendix 4 to these rules.";

state Item 13 in the following edition:

"13. Fixing of all temporary parameters in the course of reception-transmission of messages is made on time of the city of Astana.";

appendices 2, 3 and 4 to the specified Rules to be reworded as follows according to appendices 4, 5 and 6 to this to the order.

2. To provide to committee of state revenues of the Ministry of Finance of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Finance of the Republic of Kazakhstan;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of Finance of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. This order becomes effective after ten calendar days after day of its first official publication.
