I ORDER:

1. Bring in the order of the Minister of Agriculture of the Republic of Kazakhstan of October 23, 2015 No. 18-02/942 "About approval of Fire safety regulations in the woods" (it is registered in the Register of state registration of regulatory legal acts for No. 12351) the following changes:

To be reworded as follows the fire safety regulations in the woods approved by the specified order according to appendix to this order;

2. To provide to committee of forestry and fauna of the Ministry of Ecology and Natural Resources of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on the Internet resource of the Ministry of Ecology and Natural Resources of the Republic of Kazakhstan after its official publication.

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of Ecology and Natural Resources of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. To impose control of execution of this order on the supervising vice-Minister of Ecology and Natural Resources of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Fire safety regulations in the woods

Chapter 1. General provisions

1. These rules of fire safety in the woods (further – Rules) are developed according to Item 2 of Article 63 of the Forest code of the Republic of Kazakhstan of July 8, 2003 (further – the Code) and determine procedure for fire safety in the woods.

2. The basic concepts used in these rules:

1) especially protected natural territory – sites of lands, water objects and airspace over them with natural complexes and objects of the state natural and reserved fund for which the mode of special protection is set;

2) the state forest owners – the state organizations to which sites of the state forest fund are provided on the right of permanent land use;

3) the mineralized strip is the protective strip processed by soil-cultivating tools to mineral layer of earth and intended for prevention of distribution of wildfire, is created on edge of the wood and interquarter glades;

4) forest fund – all woods which are in the territory of the Republic of Kazakhstan, and also the earth of forest fund, are not covered with forest vegetation, but intended for needs of forestry form forest fund of the Republic of Kazakhstan;

5) the forest fire station – the object of the state forest owner intended for the placement of fire service and the equipment providing carrying out measures for prevention of wildfires and their timely liquidation;

6) the forest user – physical person or legal entity which is granted the right of temporary forest utilization according to the procedure, established by the Code;

7) the class of fire risk is indicator of natural fire risk of the woods and indicator of fire risk in the woods under the terms of weather;

8) fire Items – the Items of concentration of the fire equipment and stock for suppression of wildfires created by forest users and private forest owners;

9) fire localization – the actions directed to prevention of possibility of further distribution of burning and creation of conditions for its successful liquidation by the available forces and means;

10) fire liquidation – the actions directed to final flame-out, and also to exception of possibility of its repeated origin;

11) fire-dangerous season in the wood – the part of calendar year determined by authorized body in the field of forestry, regional executive body proceeding from climatic and weather factors during which the threat of emergence of wildfire is possible;

12) fire-proof gap – the glade 10-20 meters wide which is specially split in the wood cleared of combustible materials, with the fire-proof mineralized strip, the road for the purpose of the organization of obstacles in way of distribution of wildfires and creating conditions for their suppression;

13) wildfire prevention – complex of the actions directed to prevention of origin and distribution of wildfire;

14) the fire fighting equipment – technical means for prevention, restriction of development and suppression of wildfire, protection of people, the equipment and material values from dangerous factors of the fire;

15) fire and technical arms is fire equipment, the hand fire tool, rescue and fire fighting devices, individual protection equipment of firefighters from dangerous factors of the fire the technical devices which are exported to the place of the fire;

16) fire distribution – increase in the amount of wildfire as a result of promotion of its edge;

17) large wildfire – development and distribution of the fire on grounds of forest fund: the forest 25 hectares covered with the wood and above; forest uncovered wood of 50 hectares and above; not forest 100 hectares and above on sites of the state forest fund;

18) the seat of fire - the place of emergence of the fire;

19) fire - emergence of the center of burning.
