About introduction of amendments to some acts of the Government of the Russian Federation and recognition No. 633 which voided separate provision of the order of the Government of the Russian Federation of May 21, 2019

1. Approve the enclosed changes which are made to acts of the Government of the Russian Federation.

2. Declare invalid Item of 1 changes which are made to Regulations on preparation and approval of the list of priority investment projects in the field of development of the woods approved by the order of the Government of the Russian Federation of May 21, 2019 No. 633 "About modification of the Regulations on preparation and approval of the list of priority investment projects in the field of development of the woods" (The Russian Federation Code, 2019, No. 21, the Art. 2587).

3. Determine that action of the subitem "v" of Item of 1 changes approved by this resolution extends to the relations which arose since January 1, 2023.

4. Determine that Item 2 of this resolution, paragraphs of the seventh - the twelfth, twentieth, thirty sixth - forty third, the forty sixth, the fifty seventh, sixty fifth, seventy first - the seventy fifth, the eighty seventh, the ninety first, the ninety fifth, the ninety eighth, hundred seventh and hundred thirteenth the subitem "v" of Item of 2 changes approved by this resolution become effective since September 1, 2023.

Changes which are made to acts of the Government of the Russian Federation

1. In the order of the Government of the Russian Federation of May 22, 2007 No. 310 "About rates of payment for unit of volume of forest resources and rates of payment for the unit area of the wood lot which is in federal property" (The Russian Federation Code, 2007, No. 23, Art. 2787; 2011, No. 24, Art. 3502; 2014, No. 25, Art. 3306; 2017, No. 35, Art. 5360; 2018, No. 10, Art. 1503; No. 52, Art. 8296; 2019, No. 17, Art. 2095; 2020, No. 2, Art. 205; 2021, No. 49, Art. 8283; 2023, No. 16, Art. 2919):

a) in Item 1 (1):

in paragraph one of the word "in the field of development of the woods" shall be replaced with words "for the purpose of development of forest complex";

to state paragraphs of the sixth and seventh in the following edition:

"The amount of the rent for other forest resources which are not subject to conversion is established according to the paragraph the second Item 1 (2) this resolution.

The term of provision of decreasing coefficient of 0,5 is performed from the moment of adoption by the Ministry of Industry and Trade of the Russian Federation of the decision on completion of implementation of the investment project.";

b) in the text of Item 1 (the words "in the field of development of the woods" shall be replaced with words 2) "for the purpose of development of forest complex";

c) add with Item 1 (3) the following content:

"1(3). Determine that in case of determination of the hire charge of the wood lot used to procurement of wood in the territory of the Northwestern Federal District by the legal entities or individual entrepreneurs performing wood procurement, conversion and delivery of industrial output of timber processing complex to export or consisting in the group of persons performing conversion and delivery of industrial output of timber processing complex to export to the rates of payment for unit of volume of forest resources and rates of payment for the unit area of the wood lot which is in federal property approved by this resolution in 2023 apply decreasing coefficient which is determined by division of the actual amount of the prepared wood into the amount of procurement of wood established in 2023 according to the lease agreement of the wood lot, on condition of procurement of wood in 2023 of at least 50 percent of amount of wood, the wood lot established by the lease agreement.";

d) in rates of payment for unit of volume of the forest resources and rates of payment for the unit area of the wood lot which is in federal property, approved by the specified resolution:

In the order of the Government of the Russian Federation of February 23, 2018 No. 190 "About priority investment projects in the field of development of the woods and about change and recognition voided some acts of the Government of the Russian Federation" (The Russian Federation Code, 2018, No. 10, Art. 1503; 2019, No. 21, Art. 2563, 2587; 2020, No. 23, Art. 3643; 2022, No. 44, Art. 7569):

a) in the name of the word "in the field of development of the woods" shall be replaced with words "for the purpose of development of forest complex";

b) to state paragraph two of Item 1 in the following edition:

"Rules of approval of the list of priority investment projects for the purpose of development of forest complex, inclusion in this list and exception of it of such investment projects;";

c) in Regulations on preparation and the approval of the list of priority investment projects in the field of development of the woods approved by the specified resolution:

After obtaining from authorized body of the notification on opportunity or impossibility of provision of the timberland included in the list of the timberland, the Federal Forestry Agency makes the decision on approval of the request or on refusal in approval of the request of reasons for the reasons of such refusal what informs the interested body on, and also authorized bodies.

In case of adoption by Federal Forestry Agency of the decision on approval of the request transfer by authorized bodies to the third parties to lease for the purposes of procurement of wood, creation and operation of objects of wood-processing infrastructure, the timberland provided for implementation of the investment project and also sale to the third parties of forest plantings on the specified sites are not allowed, except for sales of forest plantings when implementing actions for preserving the woods.";
