About modification of some regulations (about assistance of activities in the food sector)

The Parliament adopts this organic law.

Art. I. - In the Law on the means of phytosanitary appointment and means increasing fertility of the soil, No. 119/2004 (Official monitor of the Republic of Moldova, 2004, Art. No. 100-103, 510), with subsequent changes, to make the following changes:

1. In all text of the law of the word "The State Center for Certification and Approbation of Means of Phytosanitary Appointment and the Means Increasing Fertility of the Soil" shall be replaced with words "body for approbation of means of phytosanitary appointment and the means increasing fertility of the soil" in the corresponding case.

2. In Article 19:

add with part (1-1) following contents:

"(1-1) Agricultural producer performing processing by means of phytosanitary appointment and introduction of the means increasing fertility of the soil, and the legal entity rendering services in protection of plants record applications of means of phytosanitary appointment and the means increasing fertility of the soil in the registers of application of means of phytosanitary appointment and means increasing fertility of the soil on the samples given in appendices 4 and 5. These magazines are registered and sealed in territorial subdivision of the National agency on safety of foodstuff in the field of activities of the agricultural producer / the legal entity rendering services in protection of plants. Records in the specified magazines are made and signed by the responsible person and are the official document in the course of quality control of phytosanitary processing.";

part (to state 2) in the following edition:

"(2) Business entities whose activities are connected using the means of phytosanitary appointment and means increasing fertility of the soil: producers, importers, implementors, distributors and consumers - shall provide information specified in appendices 4 and 5, at the request of the National agency on safety of foodstuff according to the terms and conditions established by the Government.";

add Article with parts (2-1)-(2-4) of the following content:

"(2-1) Information specified in appendices 4 and 5, are followed by copies of the checks or tax delivery notes confirming acquisition of means of phytosanitary appointment and means, increasing fertility of the soil.

(2-2) Provisions of part (2) do not extend to the right of bodies of the public power which consists in data exchange according to the Law on data exchange and interoperability No. 142/2018.

(2-3) National agency on safety of foodstuff provide to the public by means of electronic means information on the means of phytosanitary appointment and the permitted or prohibited means which are increasing fertility of the soil, including at least:

a) the name of the legal entity or name of the owner of permission and number of permission of the business entities performing the activities connected with these means;

b) commercial name;

c) type;

d) the name and amount of the active agent containing in these products, the phytoprotective or synergy agent;

e) classification according to Regulations on classification, marking and packaging of substances and mixes, danger warnings;

f) use or types of use for which permission was issued;

g) the reasons of recall or cancellations of permission if permission was withdrawn for safety reasons.

(2-4) Information provided in part (2-3), is in open entry and it is updated at least each three months.".

3. Recognize Chapter V invalid.

4. Declare appendix 2 invalid.

Art. II. - In article 11 of the Law on warehousing of grain and the mode of warehouse certificates on grain No. 33/2006 (Official monitor of the Republic of Moldova, 2006, Art. No. 75-78, 310), with subsequent changes, to make the following changes:

in part (4):

Item a) to declare invalid;

Item b) to state in the following edition:

"b) the quality certificate issued by the producer with appendix of laboratory researches according to Article 131 of the Security act of foodstuff No. 306/2018;";

part (to state 6) in the following edition:

"(6) For products intended for export/re-export, sampling for laboratory researches is performed by the National agency on safety of foodstuff.".

Art. III. - Article 23 of the Law on grapes and wine No. 57/2006 (repeated publication: 2013, Art. No. 64-68, 193), with subsequent changes to add the official monitor of the Republic of Moldova with part (7) the following content:

"(7) In tourist and agrotourist boarding houses, on tourist country houses, in the rural houses and recreation facilities rendering services of public catering, the wine made from own grapes can be implemented at retail and/or move to final consumers with observance of provisions of part (1) Article 21.".

Art. IV. - In the Law on veterinary and sanitary activities No. 221/2007 (repeated publication: The official monitor of the Republic of Moldova, 2021, Art. No. 13-20, 10), with subsequent changes to make the following changes:

1. In article 2 to exclude the concept "technical act".

2. Part (Article 15 to state 5) in the following edition:

"(5) Slaughters and Items of slaughter (according to appendix Item 5.1 6) are subject to the state veterinary sanitary inspection exercised by the veterinarians appointed by territorial subdivisions on safety of foodstuff.".
