According to the subitem 3) of article 11 of the Law of the Republic of Kazakhstan "About special economic and industrial zones" and the subitem 187) of Item 15 of the Regulations on the Industry ministry and the construction of the Republic of Kazakhstan approved by the order of the Government of the Republic of Kazakhstan of October 4, 2023 No. 864 "Some questions of the Industry ministry and construction of the Republic of Kazakhstan" I ORDER:

1. Approve:

1) Rules of maintaining the list of the priority types of activity performed in the territory of special economic zones according to appendix 1 to this order;

2) the List of priority types of activity by special economic zones (further - the List) according to appendix 2 to this order.

2. Declare invalid some orders of the Minister of investments and development of the Republic of Kazakhstan and the Minister of the industry and infrastructure development of the Republic of Kazakhstan in the list according to appendix 3 to this order.

3. To provide to development department of industrial infrastructure and intra country value of the Industry ministry and construction of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Industry ministry and construction of the Republic of Kazakhstan.

4. To impose control of execution of this order on the supervising vice-Minister of Industry and construction of the Republic of Kazakhstan.

5. This order becomes effective after ten calendar days after day of its first official publication.

Determine that:

1) the subitem 32) of Item 1 of the List, extends to the legal relationship which arose since January 1, 2018;

2) subitems 1), 2), 3), 10) of Item 11 of the List are effective till December 31, 2031.

Rules of maintaining the list of the priority types of activity performed in the territories of special economic zones

Chapter 1. General provisions

1. These rules of maintaining the list of the priority types of activity performed in the territories of special economic zones (further – Rules), are developed in compliance by the subitem 3) of article 11 of the Law of the Republic of Kazakhstan "About special economic and industrial zones" and determine procedure for maintaining the list of the priority types of activity performed in the territories of special economic zones.

2. The main terms and determinations used in these rules:

1) managing company of special economic zone - the legal entity created or determined according to the Law of the Republic of Kazakhstan "About special economic and industrial zones" for ensuring functioning of special economic zone;

2) the participant of special economic zone – the legal entity performing priority types of activity in the territory of special economic zone and included in the unified register of participants of special economic zones.

At the same time:

to participants of the special economic zone "Park of Innovative Technologies" implementation of priority types of activity out of the territory of this special economic zone is allowed;

the individual entrepreneurs performing priority types of activity in the territory of the specified special economic zone can act as participants of special economic zone which limits fully or partially match with sites of customs border of the Eurasian Economic Union;

3) financial model – assessment of finance costs and the income, along with assessment of alternative schemes and sources of financing, the analysis of creation of projects, the cash flow statement, about profits and losses, project performance indicators in the territories of special economic zones from the point of view of economy of the republic (region) in general;
