About introduction of amendments to some acts of the Government of the Russian Federation concerning turnover of goods, subject to obligatory marking by means of identification

1. Approve the enclosed changes which are made to acts of the Government of the Russian Federation concerning turnover of goods, subject to obligatory marking by means of identification.

2. Declare invalid the subitem "ch" of Item of 2 changes which are made to the order of the Government of the Russian Federation of December 15, 2020 No. 2099, approved by the order of the Government of the Russian Federation of November 30, 2021 No. 2100 "About modification of the order of the Government of the Russian Federation of December 15, 2020 No. 2099" (The Russian Federation Code, 2021, No. 49, the Art. 8286).

3. This resolution becomes effective since September 1, 2024, except for provisions, the stipulated in Item 4 presents of the resolution.

4. The Item of 1 changes approved by this resolution becomes effective since April 7, 2024.

Changes which are made to acts of the Government of the Russian Federation concerning turnover of goods, subject to obligatory marking by means of identification

1. In Rules of marking by means of identification of tobacco and nikotinsoderzhashchy products and the organization of traceability of tobacco and nikotinsoderzhashchy products and raw materials for production of such products approved by the order of the Government of the Russian Federation of February 28, 2019 No. 224 "About approval of Rules of marking by means of identification of tobacco and nikotinsoderzhashchy products and the organization of traceability of tobacco and nikotinsoderzhashchy products and raw materials for production of such products and also about the features of implementation of the state information system of monitoring of turnover of goods which are subject to obligatory marking by means of identification concerning tobacco and nikotinsoderzhashchy products" (The Russian Federation Code, 2019, No. 11, Art. 1117; 2022, No. 9, Art. 1344; No. 49, Art. 8690; 2024, No. 11, Art. 1513):

a) add Item 21 with words "if other is not established by these rules";

b) add with Item 23 (1) the following content:

"23(1). The obligation on representation in information system of monitoring of information provided by these rules by delivery of the marked tobacco and (or) nikotinsoderzhashchy products within execution of the contracts signed according to the Federal Law "About Contractual System in the field of Purchases of Goods, Works, Services for Ensuring the State and Municipal Needs" can be performed by participants of turnover of tobacco and (or) nikotinsoderzhashchy products by submission of the documents on acceptance provided by part 13 of article 94 of the specified Federal Law in unified information system in the field of purchases (further - information system of purchases).

Information exchange of information system of monitoring and information system of purchases is performed according to the agreement on information exchange. Notifications (receipt) of the operator specified in Item 18 of these rules in case of transfer of data according to this Item are transferred by the operator to participants of turnover of tobacco and (or) nikotinsoderzhashchy products by means of transfer of the specified notifications (receipts) to the federal executive body performing functions on creation, development, maintaining and servicing of information system of purchases (further - the operator of information system of purchases).

The operator of information system of purchases provides:

transfer of the documents on acceptance signed by both contract parties in information system of monitoring within 2 hours from the moment of signing by the receiver of tobacco and (or) nikotinsoderzhashchy products in information system of purchases of the document on acceptance and its placements in information system of purchases, and also informing the participant of turnover of tobacco and (or) nikotinsoderzhashchy products on results of transfer;

transfer to participants of turnover of tobacco and (or) nikotinsoderzhashchy products of notifications (receipts) of the operator specified in Item 18 of these rules within 2 hours from the moment of signing by the receiver of tobacco and (or) nikotinsoderzhashchy products in information system of purchases of the document on acceptance and its placements in information system of purchases on condition of receipt of such notifications (receipts) from the operator.

In case of transfer of data by means of submission of the document on acceptance through the operator of information system of purchases:

completion date of obligation of the participant of turnover on submission of data in information system of monitoring the date of receipt of the document on acceptance by the operator is considered;
