About introduction of amendments to some acts of the Government of the Russian Federation for determination of the basic provisions regulating rendering in the wholesale market of electrical energy and capacity of services in management of change of the mode of consumption

The government of the Russian Federation decides:

1. Approve the enclosed changes which are made to acts of the Government of the Russian Federation for determination of the basic provisions regulating rendering in the wholesale market of electrical energy and capacity of services in management of change of the mode of consumption.

2. Establish for 2024 the price (rate) for services of the commercial operator in the organization of trade in the wholesale market of electrical energy and capacity in the part connected with the conclusion and the organization of execution of transactions on rendering services in management of change of the mode of consumption of electrical energy:

for holding procedure for registration of one subject to regulation of consumption of electrical energy of the consumer of the retail market of electrical energy or the wholesale market of electrical energy and capacity or for holding procedure for registration of changes of parameters proceeding from which one subject to regulation of consumption of electrical energy of the consumer of the retail market of electrical energy or the wholesale market of electrical energy and capacity, in the amount of 10000 rubles excluding tax on value added was created earlier;

for other services of the commercial operator in the organization of trade in the wholesale market of electrical energy and capacity in the part connected with the conclusion and the organization of execution of transactions on rendering services in management of change of the mode of consumption in the amount of 15000 rubles excluding tax on value added for 1 MW of decrease in consumption of electrical energy a month.

3. To Federal Antimonopoly Service in 6-month time to approve methodical instructions for price fixation (rates) for services of the commercial operator for the organization of trade in the wholesale market of electrical energy and capacity in the part connected with the conclusion and the organization of execution of transactions on rendering services in management of change of the mode of consumption of electrical energy for 2025 and the next years.

4. To the Ministry of Energy of the Russian Federation in 10-month time to develop and approve procedure for determination of the expected amount of services in management of change of the mode of consumption of electrical energy in price zone of the wholesale market.

5. Recognize invalid separate provisions of acts of the Government of the Russian Federation according to the list according to appendix.

6. This resolution becomes effective from the date of its official publication, except for the paragraph of the thirty third subitem 3 Items of 2 changes approved by this resolution which becomes effective since January 1, 2027.

Changes which are made to acts of the Government of the Russian Federation for determination of the basic provisions regulating rendering in the wholesale market of electrical energy and capacity of services in management of change of the mode of consumption

1. In standards of disclosure of information by subjects wholesale and the retail markets of electrical energy approved by the order of the Government of the Russian Federation of January 21, 2004 No. 24 "About approval of standards of disclosure of information by subjects wholesale and the retail markets of electrical energy" (The Russian Federation Code, 2004, No. 4, Art. 282; 2020, No. 30, Art. 4938; 2021, No. 6, Art. 985; 2023, No. 5, Art. 784):

The subitem "b" of Item 30 to add 1) with the paragraph of the following content:

"about results of competitive selections of contractors of services in management of change of the mode of consumption of electrical energy;";

Item 34 to add 2) with the paragraph of the following content:

"Information specified in the paragraph the thirty fourth the subitem "b" of Item 30 of this document is subject to publication on the official site of the subject of supervisory control or other official site in Internet network determined by the Government of the Russian Federation within 15 calendar days from the date of carrying out competitive selections of contractors of services in management of change of the mode of consumption of electrical energy.";

In the order of the Government of the Russian Federation of December 27, 2004 No. 861 "About approval of Rules of non-discriminatory access to services in transfer of electrical energy and rendering these services, Rules of non-discriminatory access to services in supervisory control in power industry and rendering these services, Rules of non-discriminatory access to services of Trading System Administrator of the wholesale market and rendering these services and Rules of technological connection of power receiving devices of consumers of electrical energy, facilities for production of electrical energy, and also the objects of electric grid economy belonging to the network organizations and other persons to power networks" (The Russian Federation Code, 2004, No. 52, Art. 5525; 2007, No. 14, Art. 1687; 2009, No. 17, Art. 2088; 2010, No. 25, Art. 3175; 2017, No. 20, Art. 2927; No. 32, Art. 5077; 2021, No. 45, Art. 7506; 2023, No. 5, Art. 784):

1) in the name and the paragraph the fourth Item 1 of the word of Trading System Administrator shall be replaced with words "the commercial operator";

2) in Rules of non-discriminatory access to services in supervisory control in power industry and rendering these services approved by the specified resolution:

in Item 12:

the paragraph the eleventh after the words "as a part of Power pool system of Russia" to add with the words "participation in forming and issue of production requirements in case of implementation of actions on providing conclusion of power generation facilities from operation";

after the paragraph of the seventeenth to add with the paragraph of the following content:

"the organization and carrying out selection of contractors of services in management of change of the mode of consumption of electrical energy according to the procedure, established by the Government of the Russian Federation;";

3) the Rules of non-discriminatory access to services of Trading System Administrator of the wholesale market and rendering these services approved by the specified resolution to state in the following edition:

Rules of non-discriminatory access to services of the commercial operator of the wholesale market and rendering these services

1. These rules determine the general principles and procedure for ensuring non-discriminatory access for legal entities to services of the commercial operator of the wholesale market in the organization of wholesale trade with electrical energy, capacity and other goods and services allowed to the address in the wholesale market (further respectively - services, the commercial operator), and also procedure for rendering these services.

2. Non-discriminatory access to services of the commercial operator provides equal conditions of rendering services to legal entities irrespective of their form of business and the relations with person rendering these services.

3. The commercial operator shall open information concerning access to services and their rendering according to standards of disclosure of information by subjects wholesale and the retail markets of electrical energy.

4. The commercial operator has no right to refuse rendering services to subjects of the wholesale market, to persons having intention to take part in selection of contractors of services in management of change of the mode of consumption of electrical energy, except as specified, the established these rules and Rules of the wholesale market of electrical energy and capacity approved by the order of the Government of the Russian Federation of December 27, 2010 No. 1172 "About approval of Rules of the wholesale market of electrical energy and capacity and about introduction of amendments to some acts of the Government of the Russian Federation concerning the organization of functioning of the wholesale market of electrical energy and capacity" (further - Rules of the wholesale market).

5. The legal entity wishing to get access to services of the commercial operator (further - the applicant), submits the application and represents to the commercial operator:

a) information on type of the subject of the wholesale market (the supplier of electrical energy, the power sales organization, the guaranteeing supplier, the large consumer of electrical energy, the aggregator of management of change of the mode of consumption of electrical energy, the power supplying organization, the organization performing export-import transactions, the territorial network organization for the purposes of execution of functions of the guaranteeing supplier) to which there corresponds applicant, according to Rules of the wholesale market;

b) questionnaire of the applicant;

c) copies of constituent documents;

d) copy of the certificate on state registration of the legal entity (leaf of record of the Unified State Register of Legal Entities);

e) the copy of the certificate on statement of the applicant on accounting in tax authorities of the Russian Federation;

e) the documents confirming powers of persons representing the interests of the applicant;

g) the copy of the document confirming assignment to the applicant of the status of the guaranteeing supplier in the corresponding zone of activities according to the procedure, established by the legislation of the Russian Federation;

h) the unilinear scheme of accession to external power network with indication of names and levels of tension of tires of external substations, expected groups of points of delivery (subjects to regulation of consumption of electrical energy), places of connection of devices of commercial accounting, measuring transformers of current and borders of balance sheet accessory approved by the applicant:

concerning groups of points of delivery:

with owners or other legal owners of power receiving devices (facilities for production of electrical energy, objects of electric grid economy, systems of accumulating of electrical energy) concerning whom the applicant intends to perform purchase and sale of electrical energy and (or) capacity in the wholesale market on which border of balance sheet accessory delivery points are organized. Approval for the benefit of the specified owner or other legal owner of power receiving devices (facilities for production of electrical energy, objects of electric grid economy, systems of accumulating of electrical energy) of the unilinear scheme of accession to external power network by the applicant - the guaranteeing supplier who intends to perform for the benefit of the owner or other legal owner of power receiving devices (facilities for production of electrical energy, objects of electric grid economy, systems of accumulating of electrical energy) purchase and sale of electrical energy and (or) capacity in the wholesale market with use of group of points of delivery of the guaranteeing supplier is allowed provided that power receiving devices (facilities for production of electrical energy, objects of electric grid economy, systems of accumulating of electrical energy) the specified owner or other legal owner have technological accession to other power receiving devices (facilities for production of electrical energy, objects of electric grid economy, systems of accumulating of electrical energy) only at the level of voltage of 10 kV and below;

with persons having general border of balance sheet accessory with owners or other legal owners of power receiving devices (facilities for production of electrical energy, objects of electric grid economy, systems of accumulating of electrical energy) concerning whom the applicant intends to perform purchase and sale of electrical energy and (or) capacity in the wholesale market. Approval for the benefit of the specified owner or other legal owner of power receiving devices (facilities for production of electrical energy, objects of electric grid economy) of the unilinear scheme of accession to external power network by the guaranteeing supplier whose part of group of points of delivery are (are subject to inclusion) power receiving devices (facilities for production of electrical energy, objects of electric grid economy) of the specified owner or other legal owner, provided that such power receiving devices (facilities for production of electrical energy, objects of electric grid economy) is allowed have technological accession to power receiving devices (facilities for production of electrical energy, objects of electric grid economy) of the applicant or person for the benefit of whom the applicant intends to perform purchase (sale) of electrical energy and (or) capacity in the wholesale market, only at the level of voltage of 10 kV and below;

concerning subjects to regulation of consumption of electrical energy:

with owners or other legal owners of power receiving devices and (in the presence) the related facilities for production of electrical energy and (or) systems of accumulating of electrical energy concerning which the applicant intends to register subject to regulation of consumption of electrical energy;

with owners or other legal owners of power receiving devices (facilities for production of electrical energy, objects of electric grid economy, systems of accumulating of electrical energy) who have general border of balance sheet accessory with owners or other legal owners of power receiving devices and (in the presence) the related facilities for production of electrical energy and (or) systems of accumulating of electrical energy concerning which the applicant intends to register subject to regulation of consumption of electrical energy;

i) the documents confirming availability of the service provision agreement on transfer of electrical energy, - if the applicant (person for the benefit of whom the applicant intends to perform purchase and sale of electrical energy and capacity in the wholesale market or the owner of the power accepting equipment and (in the presence) the related facilities for production of electrical energy and (or) systems of accumulating of electrical energy concerning which the applicant intends to register subject to regulation of consumption of electrical energy) in accordance with the legislation of the Russian Federation shall pay such services;

j) documents, confirmatory:

concerning suppliers of electrical energy - ownership of the applicant on the property right or on other legal cause by the generating equipment with which use the applicant intends to perform trade in electrical energy and (or) capacity in the wholesale market;

concerning large consumers of electrical energy - ownership on the property right or on other legal cause by the power accepting equipment with which use the applicant intends to perform trade in electrical energy and (or) capacity in the wholesale market;

k) the documents confirming availability of the service provision agreement on supervisory control, - if the applicant (person for the benefit of whom the applicant intends to perform purchase and sale of electrical energy and (or) capacity in the wholesale market) in accordance with the legislation of the Russian Federation treats the group of people, the services in supervisory control which are subject to obligatory servicing when rendering;

l) information:

concerning groups of points of delivery - about passport technical characteristics on the generating and power accepting equipment;

concerning subject to regulation of consumption of electrical energy - about amount of decrease in consumption of electrical energy and about duration of continuous decrease in consumption, and also about passport technical characteristics on facilities for production of electrical energy and (or) systems of accumulating of electrical energy (in the presence);

m) the documents confirming availability in group of points of the delivery corresponding the established Treaty of Accession to trade system of the wholesale market to technical requirements of the communication system providing transfer of the data to the system operator necessary for implementation of centralized supervisory control within Power pool system of Russia according to Rules of the wholesale market;

o) concerning group of points of delivery - the documents testimonial of compliance of measuring instruments which equip points (group of points) of delivery in the wholesale market of electrical energy (capacity), to the technical requirements established by Rules of the wholesale market and the Treaty of Accession to trade system of the wholesale market;

o) concerning subject to regulation of the consumption of electrical energy equipped with the measuring instruments attached to intellectual systems of accounting of electrical energy (capacity) with which use provision of the minimum functionality of intellectual systems of accounting of electrical energy (capacity) is provided - the documents testimonial of compliance of such measuring instruments to the technical requirements established by Rules of the wholesale market and the Treaty of Accession to trade system of the wholesale market;

p) the list of points of measurements for the purposes of commercial accounting of electrical energy (capacity) approved:

concerning the power accepting equipment - with adjacent subjects of the wholesale market;

concerning the generating equipment with which use the applicant intends to perform trade in electrical energy and (or) capacity in the wholesale market, - with the system operator regarding methods of forming of operational information;

concerning subject to regulation of consumption of electrical energy - with subject of the wholesale market in which group of points of delivery the corresponding power accepting equipment and (in the presence) related object (objects) for production of electrical energy and (or) system (systems) of accumulating of electrical energy is fixed in the wholesale market of electrical energy and capacity;
