About modification of some regulatory legal acts of the National Bank of Ukraine

According to Articles 7, of 15, 56 Laws of Ukraine "About the National Bank of Ukraine", Articles 21-24, 28, 48 Laws of Ukraine "About financial services and finance companies", Articles 57-59, 66114, 122, 123 Laws of Ukraine "About insurance", Articles 37, of 48, 51-53, 58, 59 Laws of Ukraine "About credit unions", articles 24 of the Law of Ukraine "About advertizing", for the purpose of updating and enhancement of regulatory legal acts of the National Bank of Ukraine the board of the National Bank of Ukraine decides:

1. Bring in Regulations on certification of persons on the right of implementation of temporary administration of the non-bank financial institution approved by the resolution of Board of the National Bank of Ukraine of December 21, 2020 No. 162 (with changes), the following changes:

The word "and" shall be replaced with words 1) in Item 49 of the Section VI "and/or";

Item 63 of the Section VII to add 2) with two new subitems of the following content:

"5) the physical person who received the certificate three times in a row refused appointment as the temporary administrator according to Items 5-1 and/or 5-2 of the Section II of Provisions on procedure for appointment, implementation and the termination of temporary administration of the insurer, the credit union approved by the resolution of Board of the National Bank of Ukraine of December 23, 2023 No. 178 (with changes) (dalee-Polozheniye No. 178);

6) the physical person who received the Certificate violated requirements of Item 5-3 of the Section II of Provisions No. 178.".

2. Bring in Regulations on the organization and conducting inspection checks in the markets of non-bank financial services, the Board of the National Bank of Ukraine approved by the resolution of December 20, 2023 No. 167, the following changes:

1) in the Section VIII:

in Item 128 of the word of "one month" to replace "three months" respectively with figures and the words "30 calendar days", "90 calendar days";

in Item 129 of the word of "one month" to replace with figures and the words "30 calendar days";

2) in the Section IX:

in the subitem 4 of Item 136 of the word "the member of person non-bank" shall be replaced with words" the participant non-bank";

in Item 141 of the word "lack of face, the representative to represent the interests of object of check" to replace with the word "absence".

3. Approve Changes in Regulations on procedure for appointment, implementation and termination of temporary administration of the insurer, the credit union approved by the resolution of Board of the National Bank of Ukraine of December 23, 2023 No. 178, which are applied.

4. In Item 3 of the resolution of Board of the National Bank of Ukraine of December 25, 2023 "About approval of the Regulations on characteristics and classification signs of classes of insurance, features of implementation of activities for insurance and the conclusions of agreements on insurance classes" figure "3" to replace No. 182 with figure "4".

5. Approve Changes in Regulations on characteristics and classification signs of classes of insurance, features of implementation of activities for insurance and the conclusions of agreements on classes of the insurance approved by the resolution of Board of the National Bank of Ukraine of December 25, 2023 No. 182, which are applied.

6. Bring in the resolution of Board of the National Bank of Ukraine of December 25, 2023 No. 183 "About approval of the Regulations on application by the National Bank of Ukraine of the adjusting measures, measures of early intervention, died influences in the field of state regulation of activities in the markets of non-bank financial services" such changes:

1) in preamble of the word and figures "Articles 26, 27 Laws of Ukraine "About advertizing"" shall be replaced with words also in figures "Articles 24, 26 Laws of Ukraine "About advertizing"";
