1. Bring in the Decision of Board of the Eurasian economic commission of December 24, 2019 No. 229 "About the technological documents regulating information exchange in case of realization by means of the integrated information system of the Eurasian Economic Union of general process "Ensuring exchange between authorized bodies of state members of the Eurasian Economic Union with information on the issued phytosanitary certificates" changes according to appendix.

2. This Decision becomes effective after 30 calendar days from the date of its official publication.

1. Rules of information exchange in case of realization by means of the integrated information system of the Eurasian Economic Union of general process "Ensuring exchange between authorized bodies of state members of the Eurasian Economic Union with information on the issued phytosanitary certificates", approved by the specified Decision to state in the following edition:

Rules of information exchange in case of realization by means of the integrated information system of the Eurasian Economic Union of general process "Ensuring exchange between authorized bodies of state members of the Eurasian Economic Union information on the issued phytosanitary certificates"

I. General provisions

1. These rules are developed according to the following acts entering the right of the Eurasian Economic Union (further – the Union):

The agreement on the Eurasian Economic Union of May 29, 2014 (further – the Agreement);

The decision of Council of the Eurasian economic commission of November 30, 2016 No. 157 "About approval of the Single quarantine phytosanitary requirements imposed to quarantine products and quarantinable objects on customs border and on customs area of the Eurasian Economic Union";

The decision of Council of the Eurasian economic commission of November 30, 2016 No. 159 "About approval of Single rules and regulations of providing quarantine of plants on customs area of the Eurasian Economic Union";

The decision of the Commission of the Customs union of June 18, 2010 No. 318 "About providing quarantine of plants in the Eurasian Economic Union";

The decision of the Commission of the Customs union of August 17, 2010 No. 340 "About questions of providing quarantine of plants on customs area of the Customs union";

The decision of Board of the Euroasian economic commission of November 6, 2014 №200 "About the technological documents regulating information exchange in case of realization by means of the integrated information system of foreign and mutual trade of general processes";

The decision of Board of the Eurasian economic commission of January 27, 2015 №5 "About approval of Rules of electronic data exchange in the integrated information system of foreign and mutual trade";

The decision of Board of the Euroasian economic commission of April 14, 2015 № 29 "About the list of general processes within the Eurasian Economic Union and modification of the Decision of Board of the Euroasian economic commission of August 19, 2014 № 132";

The decision of Board of the Euroasian economic commission of June 9, 2015 №63 "About the Analysis technique, optimization, harmonizations and descriptions of general processes within the Eurasian Economic Union";

The decision of Board of the Eurasian economic commission of September 28, 2015 № 125 "About approval of the Regulations on exchange of electronic documents in case of cross-border interaction of public authorities of state members of the Eurasian Economic Union among themselves and with the Eurasian economic commission".

The decision of Board of the Eurasian economic commission of March 19, 2019 No. 38 "About approval of Rules of realization of general processes in the field of information support of application of quarantine phytosanitary measures";

The decision of Board of the Eurasian economic commission of March 28, 2023 No. 43 "About approval of the Procedure for the traceability of batches of the quarantine products (quarantine freights, quarantine materials, quarantine goods) imported on customs area of the Eurasian Economic Union and moved on customs area of the Eurasian Economic Union" (further – the Procedure for traceability).

II. Scope

2. These rules are developed for the purpose of determination of procedure and conditions of information exchange between participants of general process "Ensuring exchange between authorized bodies of state members of the Eurasian Economic Union with information on the issued phytosanitary certificates" (further – general process), including the description of the procedures performed within this general process.

3. These rules are applied by participants of general process in case of control of procedure for performing procedures and transactions within general process, and also during the designing, development and completion of components of the information systems providing realization of general process.

III. Basic concepts

4. Concepts of these rules are used in the values defined by the Agreement, the Decision of the Commission of the Customs union of June 18, 2010 No. 318, the International convention on quarantine and protection of plants against December 6, 1951, international standards on phytosanitary measures and other acts entering the right of the Union.

The concepts "group of procedures of general process", "information object of general process", "contractor", "transaction of general process", "procedure of general process" and "participant of general process" used in these rules are applied in the values determined by the Analysis technique, optimizations, the harmonization and the description of general processes within the Eurasian Economic Union approved by the Decision of Board of the Eurasian economic commission of June 9, 2015 № 63.

IV. Main data on general process

5. Full name of general process: "Ensuring exchange between authorized bodies of state members of the Eurasian Economic Union information on the issued phytosanitary certificates".

6. Specification symbol of general process: P.SS.11, version 1.1.0.

1. Purpose and tasks of general process

7. The purpose of general process is creation of conditions for ensuring quarantine phytosanitary safety of customs area of the Union and decrease in risk of import, transit and the address of the quarantine products which are not conforming to quarantine phytosanitary requirements due to ensuring traceability of quarantine products in case of its movement on customs area of the Union.

8. For goal achievement of general process it is necessary to solve the following problems:

a) provide operational information exchange of data between authorized bodies on quarantine of plants of state members of the Union (further respectively – state member, authorized body) about batches of quarantine products (further – data on batches of quarantine products):

i) the state members moved between the territories, about arrival of batches of such products in the destination, including information about issued (including on replacement) and the withdrawn (extinguished) phytosanitary certificates (further respectively – data on the issued phytosanitary certificates, data on the withdrawn or extinguished phytosanitary certificates), and also information according to Procedure for traceability (in the presence), including data on identification batch numbers of quarantine products, traceability subjects;

ii) imported on customs area of the Union from the third countries, about arrival of batches of such products in delivery location if the place of arrival of such batches is in the territory of one state member, and the place of completion of customs clearance – in the territory of other state member, including information on acts of phytosanitary quarantine control (supervision), and also information on the phytosanitary certificates issued in electronic form and information according to Procedure for traceability (in the presence), including data on the identification batch numbers of quarantine products which are subject to traceability;

b) provide authorized bodies at the request of data on batches of quarantine products, including:

i) data on the fact of issue or lack of distribution of the phytosanitary certificate when moving batch of quarantine products between the territories of state members (further – data on the fact of issue or lack of distribution of the phytosanitary certificate);

ii) data about issued (including on replacement) the phytosanitary certificates which are drawn up on the batches of quarantine products which are taken out from customs area of the Union to the third countries through the territory of other state members (further – data on the phytosanitary certificates which are drawn up on the batches of quarantine products which are taken out to the third countries);

iii) data on the phytosanitary certificates issued (including on replacement) authorized bodies on the batches of quarantine products moved between the territories the member states through the territories of other state members;

iv) data on the phytosanitary certificates issued (including on replacement) authorized bodies of the third countries in electronic form on the batches of quarantine products imported on customs area of the Union from the third countries through the territories of other state members;

c) provide operational information exchange of data between authorized bodies on the violations revealed when conducting phytosanitary quarantine control (supervision) (further respectively – violations, data on violations);

d) provide provision by authorized bodies in the Eurasian economic commission (further – the Commission) at the request of the generalized data on the issued phytosanitary certificates on the batches of quarantine products moved between the territories of state members and also about the violations revealed when conducting phytosanitary quarantine control (supervision) (further – the generalized data on phytosanitary certificates and violations);

e) develop, harmonize and staticize the lists, qualifiers and reference books applied at the moment by authorized bodies and necessary for exchange of information about batches of quarantine products and also to develop their electronic forms.

3. Structure of general process

10. General process represents set of the procedures grouped according to the destination:

a) procedures of exchange of data on movement of batches of quarantine products;

b) procedures of exchange of the generalized data on phytosanitary certificates and violations.

11. Exchange of data between authorized bodies is made on the facts of movement of batches of quarantine products, withdrawal or repayment of the phytosanitary certificate, and also on the facts of identification of violations. Authorized bodies on demand provide provision in authorized bodies of other state members of data on batches of quarantine products, including about the phytosanitary certificates which are drawn up on the batches of quarantine products moved between the territories of state members, which are taken out to the third countries and imported from the third countries. Authorized bodies also provide provision of the generalized data on phytosanitary certificates and violations in the Commission on request.

In case of accomplishment of the procedure of submission of data on batch of quarantine products in full the notifying authorized body creates and sends to the notified authorized body (to body of the destination and body of delivery location respectively) data on batch of quarantine products:

a) moved between the territories of state members, including information about issued (including on replacement) phytosanitary certificates, and also information according to the Procedure for traceability, including data on identification batch numbers of quarantine products, traceability subjects;

b) imported on customs area of the Union from the third countries if the place of arrival of such batch is in the territory of one state member, and the place of completion of customs clearance – in the territory of other state member, including information on acts of phytosanitary quarantine control (supervision), and also information on phytosanitary certificates in electronic form and according to the Procedure for traceability (in the presence), including data on the identification batch numbers of quarantine products which are subject to traceability.

In case of accomplishment of the procedure of submission of data on violation the notified authorized body creates and sends to the notifying authorized body of the data on violation, such as:

a) the phytosanitary certificate shown when conducting phytosanitary quarantine control (supervision) is acknowledged counterfeit or invalid;

b) the phytosanitary certificate does not confirm compliance of batch of quarantine products to the imposed quarantine phytosanitary requirements;

c) the non-notification or non-presentation of quarantine products for implementation of phytosanitary quarantine control (supervision) to the official of the notified authorized body according to the phytosanitary certificate issued on batch of quarantine products took place;

d) identification batch number of quarantine products or means of identification (in the presence) does not correspond to information created concerning this batch of quarantine products.

In case of accomplishment of the procedure of submission of data on the withdrawn or extinguished phytosanitary certificate the notified authorized body creates and sends to the notifying authorized body of the data on the withdrawn or extinguished phytosanitary certificate. The phytosanitary certificate is subject to withdrawal or repayment when implementing phytosanitary quarantine control (supervision) on delivery location of batch of quarantine products.

In case of accomplishment of the procedure of provision of data on batch of quarantine products on demand the notified authorized body creates and sends inquiry for receipt of data on batch of quarantine products to the notifying authorized body. The notifying authorized body provides the information on batch of quarantine products or sends the non-availability notice of the data satisfying to request parameters to the notified authorized body. The procedure is performed if necessary for the purpose of receipt of data on batch of quarantine products on demand, including:

a) data on the fact of issue or lack of distribution of the phytosanitary certificate when moving batch of quarantine products between the territories of state members (including in case of presentation of paper version of the phytosanitary certificate and lack of the electronic phytosanitary certificate corresponding to it in information system of authorized body of the state of the destination provided that the place of issue of the phytosanitary certificate is the state member);

b) data about issued (including on replacement) the phytosanitary certificates which are drawn up on the batches of quarantine products which are taken out from customs area of the Union to the third countries through the territory of other state members;

c) data on the phytosanitary certificates issued (including on replacement) authorized bodies of state members on the batches of quarantine products moved between the territories of state members through the territories of other state members;

d) data on the phytosanitary certificates issued (including on replacement) authorized bodies of the third countries in electronic form on the batches of quarantine products imported on customs area of the Union from the third countries through the territories of other state members.

The procedure of provision of the generalized data on phytosanitary certificates and violations on demand is carried out in need of obtaining by the Commission of the generalized data on phytosanitary certificates and violations for the purpose of monitoring and the analysis of results of realization (execution) of general process. In case of accomplishment of the Commission procedure creates and sends inquiry for receipt of the generalized data on phytosanitary certificates and violations to authorized bodies. Authorized bodies provide the generalized information on phytosanitary certificates and violations or send the non-availability notice of the data satisfying to request parameters to the Commission.

In case of accomplishment of the procedure of submission of data on batch of quarantine products in limited amount the notifying authorized body creates and sends to the notified authorized body (for example, to body of transit state member) limited data on batch of quarantine products.

Exchange of data between authorized bodies and the Commission is performed according to Regulations of information exchange between authorized bodies of state members of the Eurasian Economic Union and the Eurasian economic commission in case of realization by means of the integrated information system of the Eurasian Economic Union of general process "Ensuring exchange between authorized bodies of state members of the Eurasian Economic Union with information on the issued phytosanitary certificates", the approved Decision of Board of the Eurasian economic commission of December 24, 2019 No. 229 (further – Regulations of information exchange between authorized bodies and the Commission).

Exchange of data between authorized bodies is performed according to Regulations of information exchange between authorized bodies of state members of the Eurasian Economic Union in case of realization by means of the integrated information system of the Eurasian Economic Union of general process "Ensuring exchange between authorized bodies of state members of the Eurasian Economic Union with information on the issued phytosanitary certificates", the approved Decision of Board of the Eurasian economic commission of December 24, 2019 No. 229 (further – Regulations of information exchange between authorized bodies).

The format and structure of the represented data shall match the Description of formats and structures of the electronic documents and data used for realization by means of the integrated information system of the Eurasian Economic Union of general process "Ensuring exchange between authorized bodies of state members of the Eurasian Economic Union with information on the issued phytosanitary certificates", to No. 229 approved by the Decision of Board of the Eurasian economic commission of December 24, 2019 (further – the Description of formats and structures of electronic documents and data).

12. The provided description of structure of general process is provided in the figure 1.

13. The procedure for performing procedures of general process, grouped according to the destination, including the disaggregated activity description, is given in the Section VIII of these rules.

14. For each group of procedures the general scheme showing bonds between procedures of general process and procedure for their accomplishment is provided. 4. Group of procedures of exchange of data on movement of batches of quarantine products

15. The group of procedures represents set of procedures of exchange of data on movement of batches of quarantine products.

Set is provided by the following list:

a) procedure of submission of data on batch of quarantine products in full (P.SS.11.PRC.001);

b) procedure of submission of data on violation (P.SS.11.PRC.002);

c) the procedure of submission of data on the withdrawn or extinguished phytosanitary certificate (P.SS.11.PRC.003);

d) procedure of provision of data on batch of quarantine products for request (P.SS.11.PRC.011);

e) the procedure of submission of data on batch of quarantine products in limited amount (P.SS.11.PRC.012).

16. The provided description of group of procedures of exchange of data on movement of batches of quarantine products is provided in the figure 2.

5. Group of procedures of exchange of the generalized data on phytosanitary certificates and violations

The "Provision of the Generalized Data on Phytosanitary Certificates and Violations on Demand" procedure (P.SS.11.PRC.006) is carried out in need of obtaining by the Commission of the generalized data on phytosanitary certificates and violations for the purpose of monitoring and the analysis of results of realization (execution) of general process.

VI. Responsibility of participants of general process

22. Attraction to disciplinary responsibility for non-compliance with the requirements aimed at providing timeliness and completeness of transfer of data of the officials and the staff of the Commission participating in information exchange is performed according to the Agreement, other international treaties and acts constituting the right of the Union, and officials and the staff of authorized bodies – according to the legislation of state members.
