About carrying out experiment concerning separate groups of goods, including goods in packaging

1. Conduct from September 1, 2024 to December 31, 2027 in the territory of the Russian Federation experiment concerning separate groups of goods, including goods in packaging.

2. Approve the enclosed Regulations on carrying out experiment concerning separate groups of goods, including goods in packaging.

3. Till September 1, 2024 to provide to the Ministry of Natural Resources and Environmental Protection of the Russian Federation readiness of single federal state information system of accounting of waste from use of goods to acceptance of information and the documents submitted by participants of experiment according to the Provision approved by this resolution.

4. Till September 1, 2024 the public company on forming of complex system of the address with solid utility waste "The Russian ecological operator" to sign with the Federal Customs Service the agreement on information exchange for the purpose of realization of the Provision approved by this resolution.

5. Determine that concerning goods, the packagings included in the list of separate types of goods the, including goods in packaging participating in experiment, according to appendix No. 1 to the Provision approved by this resolution, and imported from January 1, 2024 to December 31, 2027 into the Russian Federation from the states which are not members of the Eurasian Economic Union, importers of goods for the accounting periods 2024, of 2025, 2026 and 2027 are submitted in time, stipulated in Item the 17th article 24.2-1 of the Federal law "About Production Wastes and Consumption":

the reporting on the mass of goods, the packagings imported from the states which are not members of the Eurasian Economic Union in form according to appendix No. 2 to the Provision approved by this resolution;

the reporting on accomplishment of independent waste recycling from use of goods in form according to appendix No. 3 to the Provision approved by this resolution.

6. Realization by federal executive bodies - participants of experiment of the actions provided by this resolution and the Provision approved by it is performed within the established number of staff of workers and the salary fund of workers of the specified federal executive bodies, as well as budgetary appropriations provided to these federal executive bodies by the Federal Law on the federal budget for the corresponding financial year and planning period on management and management in the field of the established functions.

Regulations on carrying out experiment concerning separate groups of goods, including goods in packaging

1. This Provision establishes procedure for carrying out in the territory of the Russian Federation experiment on execution by importers of goods of the requirements established by the subitem 2 Items 2, Items 10 and 18 of Article 24.2-1, of Items 3 and 12 of article 24.5 of the Federal law "About Production Wastes and Consumption", in case of commodity importation, including goods in packaging, from the states which are not members of the Eurasian Economic Union, concerning the separate imported groups of goods, including goods in packaging which waste from use is subject to utilization (further - experiment).

2. The experiment is made from September 1, 2024 to December 31, 2027. Information on dates of experiment and the list of separate types of goods, including the goods in packaging participating in experiment, according to appendix No. 1 (further - the inventory, participating in experiment) is published on the official sites of the Ministry of Natural Resources and Environmental Protection of the Russian Federation, Federal Customs Service, Federal Nature Management Supervision Service and public company on forming of complex system of the address with solid utility waste "The Russian ecological operator" in the Internet.

3. The purposes of experiment are:

a) approbation of the mechanism of representation in single federal state information system of accounting of waste from use of goods (further - information system) importers of the goods participating in experiment, the reporting on the mass of goods, the packagings imported from the states which are not members of the Eurasian Economic Union about day of their release by customs authority for internal consumption;

b) identification of problematic issues regarding forming of the reporting on the mass of goods, the packagings imported from the states which are not members of the Eurasian Economic Union including regarding correlation of imported goods, goods in packaging according to names of goods and packaging items with codes of the single Commodity nomenclature of foreign economic activity of the Eurasian Economic Union, codes of the technical regulation of the Customs union "About safety of packaging" with groups of goods, packagings and names of goods, the packagings included in inventories, packagings which waste from use is subject the utilizations approved by the order of the Government of the Russian Federation of December 29, 2023 No. 2414 "About approval of inventories, packagings which waste from use is subject to utilization, and standard rates of waste recycling from use of goods, packaging" (further - inventories, packagings) and also regarding correctness of determination of mass of imported goods, packaging, goods in packaging;

c) approbation of the mechanism aimed at providing execution by importers of goods of obligation on waste recycling from use of such goods and non-admission of evasion from execution of such obligation.

4. Participants of experiment are:

Ministry of Natural Resources and Environmental Protection of the Russian Federation;

Ministry of Industry and Trade of the Russian Federation;

Federal Nature Management Supervision Service;

Federal Customs Service;

importers of the goods the, including goods in packaging included in the inventory, participating in experiment.

5. The experiment is obligatory for importers of goods, including the goods in packaging included in the inventory, participating in experiment.

6. Action of experiment extends on:

a) the goods, packaging (except for the case specified in Item 7 of this provision) imported from the states which are not members of the Eurasian Economic Union, included in the inventory participating in experiment;

b) the packaging included in inventories, packagings, and not included in the inventory, participating in experiment if from the states which are not members of the Eurasian Economic Union the goods included in the inventory are imported participating in experiment packed into such packaging.

7. If on the territory of the Russian Federation the goods in packaging which is included in the inventory, participating in experiment, and goods which are packed into such packaging are imported, it is not included in the inventory, participating in experiment, action of experiment does not extend to the specified goods and packaging.

8. The Federal Customs Service during the period based on the agreement on information exchange signed by the Federal Customs Service with the public company on forming of complex system of the address with solid utility waste "The Russian ecological operator" transfers from September 1, 2024 to September 1, 2025 to information system information about imported from the states which are not members of the Eurasian Economic Union, goods, including goods in packaging stipulated in Item the 6th this provision, about persons specified when importing such goods, including goods in packaging in the declaration on goods as persons responsible for financial settlement, in the form provided by appendix No. 7 to the Regulations on single federal state information system of accounting of waste from use of goods to No. 868 approved by the order of the Government of the Russian Federation of May 13, 2022 "About single federal state information system of accounting of waste from use of goods", in time no more than 1 working days from the date of receipt of the declaration of goods in the Federal Customs Service.

Before ensuring technical capability of transfer to information system of information specified in paragraph one of this Item, the Federal Customs Service weekly provides in the electronic form specified information in the Ministry of Industry and Trade of the Russian Federation, Federal Nature Management Supervision Service and the public company on forming of complex system of the address with solid utility waste "The Russian ecological operator".

For the purposes of identification of goods, packaging, data on which are subject to transfer to information system, the Federal Customs Service is guided by codes of the single Commodity nomenclature of foreign economic activity of the Eurasian Economic Union (CN FEA EEU).
