Bring in resolutions of the Cabinet of Ministers of Ukraine concerning simplification of the procedure of provision to persons of the status of person with disability owing to war and the member of the family of the died (died) Defender or the Defender of Ukraine the enclosed changes.

Changes which are made to resolutions of the Cabinet of Ministers of Ukraine concerning simplification of the procedure of provision to persons of the status of person with disability owing to war and the member of the family of the died (died) Defender or the Defender of Ukraine

1. Procedure for provision of the status of person with disability owing to war to persons who became disabled owing to wound, contusions, mutilations or diseases got during direct participation in anti-terrorist operation, implementation of actions for ensuring national security and defense, repulse and control of the armed aggression of the Russian Federation in the Donetsk and Luhansk regions, ensuring their carrying out, during direct participation in the actions necessary for ensuring defense of Ukraine, protection of safety of the population and interests of the state in connection with military aggression of the Russian Federation against Ukraine, No. 685 approved by the resolution of the Cabinet of Ministers of Ukraine of September 8, 2015 (The Official Bulletin of Ukraine, 2015, No. 74, Art. 2434; 2016, No. 35, Art. 1360; 2018, No. 23, Art. 782; 2019, No. 30, Art. 1050; 2022, No. 19, Art. 1038, No. 57, Art. 3390; 2023, No. 67, to the Art. 3821) to state in the following edition:

Procedure for provision of the status of person with disability owing to war to persons who became disabled owing to wound, contusions, mutilations or diseases got during direct participation in anti-terrorist operation, implementation of actions for ensuring national security and defense, repulse and control of the armed aggression of the Russian Federation in the Donetsk and Luhansk regions, ensuring their carrying out, during direct participation in the actions necessary for ensuring defense of Ukraine, protection of safety of the population and interests of the state in connection with military aggression of the Russian Federation against Ukraine

1. This Procedure determines the procedure of provision of the status of person with disability owing to war to persons who became disabled owing to wound, contusions, mutilations or diseases got during direct participation in anti-terrorist operation, implementation of actions for ensuring national security and defense, repulse and control of the armed aggression of the Russian Federation in the Donetsk and Luhansk regions, ensuring their carrying out, during direct participation in the actions necessary for ensuring defense of Ukraine, protection of safety of the population and interests of the state in connection with military aggression of the Russian Federation against Ukraine.

2. The terms used in this Procedure have the following value:

1) electronic office component of the Unified state register of veterans of war (further - the Register) which is intended for access for users of electronic office to the Register for the purpose of introduction and receipt of information from it;

2) the applicant person, specified in Items 11-14, 16 of part two of article 7 of the Law of Ukraine "About the status of veterans of war, guarantees of their social protection" (further - the Law), his legal representative or the authorized person which addresses for provision of the status of person with disability owing to war;

3) the user of electronic office - the applicant, the employee of structural division to which functions concerning veteran policy are assigned the district, district state administration in Kiev and Sevastopol, executive body city, district in the city (in case of its education) Council (further-seater structural division concerning veteran policy) or the administrator of the center of provision of administrative services (further - the center) to whom access to electronic office according to the rights of the user determined for it is provided and which underwent the procedure of electronic identification and authentication;

4) provision of the status of person with disability owing to war - public (electronic public) the service provided by local structural division concerning veteran policy on the application submitted in paper or electronic form by results of which consideration the decision on provision (refusal in provision) the status of person with disability owing to war is made.

Other terms are used in the value given in the law, the Laws of Ukraine "About features of provision public (electronic public) services", "About public electronic registers", "About personal data protection", "About electronic identification and electronic confidential services", "About providing the rights and freedoms of internally displaced persons", Regulations on the Single state web portal of electronic services approved by the resolution of the Cabinet of Ministers of Ukraine of December 4, 2019 No. 1137 "Questions of the Single state web portal of electronic services and the register of administrative services" (The Official Bulletin of Ukraine, 2020, No. 3, Art. 136; 2021, No. 43, Art. 2625; 2022, No. 69, Art. 4171), and other regulatory legal acts.

3. The area of conducting anti-terrorist operation and the period of its carrying out are determined by the Anti-terrorist center under the SSU.

4. The basis for provision to applicants of the status of person with disability owing to war is:

1) for applicants from among persons specified in Item 11 parts two of article 7 of the Law (except persons which were part of voluntary forming of territorial community, and employees of the companies, organizations, the organizations) and Item 12 parts two of article 7 of the Law:

certificate of medico-social commission of experts of group and reason of disability;

documents on direct participation of person which protected independence, sovereignty and territorial integrity of Ukraine and was directly involved in anti-terrorist operation, ensuring its carrying out, being directly in areas of anti-terrorist operation during its carrying out, implementation of actions for ensuring national security and defense, to repulse and control of the armed aggression of the Russian Federation in the Donetsk and Luhansk regions, being directly in areas and during implementation of the specified actions, the reference in form according to appendix 6 to the Procedure for provision and deprivation of participant status of the fighting of persons which were protecting independence, sovereignty and territorial integrity of Ukraine and being directly involved in anti-terrorist operation, ensuring its carrying out or in implementation of actions for ensuring national security and defense repulse and control of the armed aggression of the Russian Federation in the Donetsk and Luhansk regions, ensuring their implementation, in the actions necessary for ensuring defense of Ukraine, protection of safety of the population and interests of the state in connection with military aggression of the Russian Federation against Ukraine approved by the resolution of the Cabinet of Ministers of Ukraine of August 20, 2014 No. 413 (The Official Bulletin of Ukraine, 2014, No. 73, Art. 2068; 2017, No. 86, Art. 2614; 2018, No. 42, Art. 1484; 2022, No. 85, Art. 5274; 2023, No. 82, Art. 4703).
