About territorial schemes of the treatment of production wastes and consumption

According to article 13.3 of the Federal law "About Production Wastes and Consumption" Government of the Russian Federation decides:

1. Approve the enclosed Rules of development, consideration, public discussion, approval, adjustment of territorial schemes of the treatment of production wastes and consumption.

2. Recognize to invalid:

the order of the Government of the Russian Federation of September 22, 2018 No. 1130 "About development, public discussion, approval, adjustment of territorial schemes in the field of the treatment of production wastes and consumption, including with solid utility waste, and also about requirements to structure and contents of such schemes" (The Russian Federation Code, 2018, No. 40, the Art. 6134);

The territorial schemes of the treatment of production wastes and consumption approved in accordance with the established procedure before entry into force of this resolution can be applied before approval of territorial schemes of the treatment of production wastes and consumption or their adjustment according to the Rules approved by this resolution.

If about day of entry into force of this resolution by executive bodies of subjects of the Russian Federation the public contract on rendering services in project development of the territorial scheme of the treatment of production wastes and consumption or its adjustment is signed, but such territorial scheme or its adjustment is not approved, development, consideration, public discussion, approval of such draft of the territorial scheme or its adjustment are performed according to the procedure, acting before entry into force of this resolution.

5. This resolution becomes effective since January 1, 2025.

Rules of development, consideration, public discussion, approval, adjustment of territorial schemes of the treatment of production wastes and consumption

1. These rules establish procedure for development, passing of the procedure of consideration by the interested federal executive bodies, the Russian ecological operator and public discussion of the draft of the territorial scheme of the treatment of production wastes and consumption (further respectively - waste, the territorial scheme), approvals and adjustments of the territorial scheme, and also the requirement to structure and contents of the territorial scheme.

2. In these rules the following concepts are applied:

"the second shoulder" - routes of transportation of solid utility waste from reloading stations, objects of processing, utilization, neutralization of solid utility waste to other objects of processing, utilization, neutralization, placement of solid utility waste;

"source of formation of waste" - capital construction project or other object, and also their set combined by single appointment and (or) inseparably linked physically or technologically and located within one or several parcels of land on which waste are formed;

"the first shoulder" - routes of transportation of solid utility waste from sources of formation of solid utility waste (groups of sources) to reloading stations, objects of processing, utilization, neutralization, placement of solid utility waste;

"the reloading station" - the place (platform), including with located on it (on it) constructions and the equipment, intended (intended) for overload of solid utility waste in vehicles of bigger capacity on which (on which) creation of platforms of accumulating of solid utility waste is allowed;

"the scheme of flows of waste" - information in tabular and graphical form of transportation of waste from sources (groups of sources) of formation of waste to objects of processing, utilization, neutralization, placement of waste and between such objects;

"the territorial scheme" - the textual record and electronic model of the territorial scheme including text, tabular and graphical descriptions (maps, schemes, drawings, plans and other materials) of system of the organization and implementation in the territory of the subject of the Russian Federation of activities for accumulating (including to separate accumulating), to collection, transportation, processing, utilization, neutralization, placement of the waste which is formed in the territory of the subject of the Russian Federation and (or) arriving from other subjects of the Russian Federation;

"electronic model of the territorial scheme" - the systematized code of data in electronic and digital form of formation of waste, the treatment of them in the subject of the Russian Federation, including about the address with the waste which arrived from other subjects of the Russian Federation about development of system of the address with waste in the subject of the Russian Federation.

3. Territorial schemes are developed and affirm authorized executive bodies of subjects of the Russian Federation (further - authorized bodies) according to documents of territorial planning for the term of at least 10 years.

4. In case of development of territorial schemes can be used:

a) cartographic basis of the State Immovable Property Cadastre, public cadastral maps, cadastral maps of the territories of municipalities, and also schemes, drawings, land underlying causes, materials kosmo-and aerial photo shoots of the territories;
