About introduction of amendments to the order of the acting minister of justice of the Republic of Kazakhstan of May 29, 2020 No. 66 "About approval of rules of rendering the state services in the field of state registration of legal entities and accounting registration of branches and representations"

1. Bring in the order of the acting minister of justice of the Republic of Kazakhstan of May 29, 2020 No. 66 "About approval of rules of rendering the state services in the field of state registration of legal entities and accounting registration of branches and representations" (it is registered in the Register of state registration of regulatory legal acts at No. 20771), the following changes:
1) in the Rules of rendering the state service "State Registration of Legal Entities, Accounting Registration of Their Branches and Representations" approved by the specified order:

State registration of consolidation of owners of property can be made based on the electronic Protocol of the vote directed by means of objects of informatization in the field of housing and communal services.";
state appendix 8 in edition, according to appendix 1 to this order;
2) in the Rules of rendering the state service "State Re-registration of Legal Entities, Accounting Re-registration of Their Branches and Representations" approved by the specified order:
State appendix 5 in edition, according to appendix 2 to this order;
3) in the Rules of rendering the state service "State Registration of the Made Changes and Additions in Constituent Documents of the Legal Entity Who Is Not Belonging to the Subject of Private Entrepreneurship, and also Joint-stock Company, Regulations on Their Branches (Representations)" approved by the specified order:

"12. Changes and amendments are brought in registration data of the legal entity, branch (representation) in case of:
1) change of the location of the legal entity relating to the subject of private entrepreneurship, branch (representation), except for joint-stock company, branch (representation);
2) change of the head (appointment of the head, appointment of the acting as the head, appointment of the managing director of property and activities of the legal entity, discharge from the head's position);
3) modification and amendments in constituent documents, except for requirements, the stipulated in Article 14–1 this Law;
4) to transfer of share of the authorized capital to trust management;
5) increase in the authorized capital of economic partnerships;
6) change of main type of economic activity;
7) change of list of founders (participants, members) of non-profit organizations, except for political parties.
8) change of the beneficial owner of the legal entity.";

"13. Changes and amendments are brought in the registration data of the legal entity, branch (representation) specified in subitems 1), 2), 4), 5), 6), 7) and 8) to part one of article 14-2 of the Law in the automatic mode based on the electronic notification.";
State appendix 3 in edition, according to appendix 3 to this order;
4) in the Rules of rendering the state service "State Registration of the Termination of Activities of the Legal Entity, Removal from Accounting Registration of Branch and Representation" approved by the specified order:
state appendix 2 in edition, according to appendix 4 to this order.
5) in the Rules of rendering the state service "Issue of the Certificate of Registration (Re-registration) of Legal Entities, Accounting Registration (Re-registration) of Their Branches and Representations" approved by the specified order:
state appendix 4 in edition, according to appendix 5 to this order.
2. To provide to department of registration service and organization of legal services of the Ministry of Justice of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:
1) state registration of this order;
2) placements of this order on Internet resource of the Ministry of Justice of the Republic of Kazakhstan.
3. To impose control of execution of this order on the supervising vice-Minister of Justice of the Republic of Kazakhstan.
4. This order becomes effective since June 8, 2024 and is subject to official publication.

Registration of commercial legal entities - state registration of commercial legal entities, accounting registration of their branches (representations) with participation of the foreign persons who do not have identification numbers according to the Law of the Republic of Kazakhstan "About national registers of identification numbers" (further – the Law about Natsreestrakh), are made no later than one working day following behind day of filing of application. 3. State registration of the legal entities who are not belonging to subjects of private entrepreneurship, and also the joint-stock companies performing activities based on the charter which is not standard, except for political parties, accounting registration of their branches (representations), and also branches (representations) of foreign non-profit organizations shall be made no later than 5 working days of the necessary documents following behind day of filing of application with appendix. 4. State registration of political parties and accounting registration of their branches (representations) shall be made no later than one month from the date of filing of application with appendix of necessary documents. 5. State registration of public and religious associations with the republican and regional statuses, including accounting registration of branches and representations of foreign and international non-commercial non-governmental associations, are made no later than 5 working days of the necessary documents following behind day of filing of application with appendix; in the location of the service provider, no later than 10 working days out of the location of the service provider of the necessary documents following behind day of filing of application with appendix. 6. State registration of commercial legal entities, accounting registration of their branches (representations) with participation of the foreign persons who do not have identification numbers according to the Law about Natsreestrakh are made no later than one working day following behind day of filing of application.
