About modification of some regulations

The Parliament adopts this organic law.

Art. I. – Part (1) article 7 of the Law on grapes and wine No. 57/2006 (repeated publication: 2013, 193), with subsequent changes to state the official monitor of the Republic of Moldova to Art. No. 64-68, in the following edition:

"(1) Testing of grades of grapes and their entering into the Catalogue of plant varieties are performed according to provisions of the Law on seeds No. 68/2013.".

Art. II. – In the Law on protection of plant varieties No. 39/2008 of year (Official monitor of the Republic of Moldova, 2008, Art. No. 99-101, 364), with subsequent changes, to make the following changes:

1. In Article 5:

part (to state 1) in the following edition:

"(1) the Bodies performing state policy in the field of legal protection of grades are the State agency on intellectual property (AGEPI) (further – the Agency) and the National agency on safety of foodstuff (further – NABPP). State policy in the field of use of new grades in production process is performed by NABPP.";

in part (the words "and State commission" shall be replaced with words 4) "and NABPP";

part (to state 5) in the following edition:

"(5) the Government appoints public organization (further – the appointed public organization), who bears responsibility for testing of plant varieties within the test centers, experimental stations, specialized agencies and laboratories according to the established methodologies and terms, on the basis of international standards, for the purpose of determination of their compliance to patentability conditions, namely distinguishability, uniformity and stability, and also are carried out by testing of grades for the purpose of determination of their cultural and economic value. NABPP keeps the Catalogue of plant varieties including the grades permitted to production and sale in the Republic of Moldova and bears responsibility for decision about inclusion of grade in the specified catalog.".
