About modification and amendments in the order of the Minister of Agriculture of the Republic of Kazakhstan of March 15, 2019 No. 108 "About approval of Rules of subsidizing of development of breeding livestock production, increase in productivity and product quality of livestock production"

I ORDER:

1. Bring in the order of the Minister of Agriculture of the Republic of Kazakhstan of March 15, 2019 No. 108 "About approval of Rules of subsidizing of development of breeding livestock production, increase in productivity and product quality of livestock production" (it is registered in the Register of state registration of regulatory legal acts No. 18404) the following changes and amendments:

Forming and distribution of amounts of subsidies is performed by MIO (service provider) according to the types and standard rates of subsidies established in appendix 1 to these rules based on information on requirement of amounts of subsidies provided by local executive bodies of the areas/cities the current year, taking into account final amounts of subsidies of previous year and availability of budgetary funds.

The offered amounts of subsidies no later than January 10 of the corresponding year are signed by the EDS of the head of MIO (service provider) and sent by means of GISS for approval in the Ministry.";

Amount of gross output (goods or services) of agro-industrial complex for previous year, thousands of tenges = amount of the made products (goods or services) of agro-industrial complex for previous year in kind, tons/heads/pieces x the price for products (goods or service) of agro-industrial complex, thousands of tenges.

In case of non-execution of obligations owing to force majeure (deterioration in climatic conditions, phytosanitary and epizootic situations), the producer places in GISS the document confirming this fact (the certificate of weather conditions issued by the republican state company on the right of economic maintaining Kazgidromet of the Ministry of Ecology and Natural Resources of the Republic of Kazakhstan and (or) the solution of MIO on establishment of quarantine or restrictive actions and (or) the appraisal certificate (test report) on detection of disease of animals and (or) the act of damage of crops by wreckers, diseases of plants and weeds).

"16. Confirmation of acquisition of breeding products (material), realization of livestock/products is performed electronic accounts invoices by means of the information system of electronic invoices (further – IS ESF) integrated with GISS.

In case of acquisition by producer of livestock directly at the foreign producer who is not using IS ESF, purchase costs are confirmed by the customs declaration on goods (from the third countries which are not members of the Eurasian Economic Union) or the statement (statements) for commodity importation and payment of indirect taxes with mark of tax authority according to Item 2 of article 456 of the Code of the Republic of Kazakhstan "About taxes and other obligatory payments in the budget" (Tax code) (from the territory of state members of the Eurasian Economic Union).";

"20. Forming and registration of the request is made by producer in the Personal account in the following procedure:

In case of compliance, the request is subject to approval, the EDS of the executive in charge of MIO (service provider) is signed and arrives in the register of the approved requests (waiting list), and also MIO (service provider) directs the notification on results of consideration of the request for receipt of subsidies in form according to appendix 6 to these rules.

Consideration of requests and payment of subsidies for the approved requests are performed according to the procedure of priority according to date and time of registration of requests.";

"24. In case of availability of means in the corresponding direction, MIO (service provider) within 2 (two) working days after approval of the request creates in the account GISS for payment on payment of subsidies loaded into information system "Treasury Client" taking into account monthly funding plan.

"24-1. In case of insufficiency of means for complete satisfaction of the request, MIO (service provider) by means of GISS the offer on partial payment of receivable subsidies goes to the Personal account of producer. The offer is accepted/is rejected by producer within 2 (two) working days. In case of the consent of producer, MIO makes payment according to the directed offer. The remaining balance of receivable subsidies is paid in case of funds redistribution between types of subsidies and (or) allocation of budgetary funds in current / following financial year(s).

24-2. In case of lack of means for satisfaction of requests in the current financial year, the approved requests for receipt of subsidies are subject to payment in case of allocation of additional budgetary funds in the current financial year and (or) funds redistribution between types of subsidies. In case of lack of additional budgetary funds in the current financial year, according to the requests which arrived in the waiting list, payment of subsidies is performed in following financial year(s).";

"25. District departments of agricultural industry (further – ROSH) by means of GISS perform monitoring of safety of the pro-subsidized livestock in the Section "Obligation Fulfillment Monitoring".

In case of establishment of ROSH of violation by producer of undertaken obligation on ensuring safety of the declared livestock (except for zootechnical regulation of disposal) and its target use within the submitted application for receipt of subsidies, ROSH within thirty working days from the date of factual determination (ов) violations by producer of undertaken obligation within the submitted application for receipt of subsidies are directed to producer by the return note of the received subsidy amount of the local budget, with indication of the amount, the term of return, code of budget classification of the Republic of Kazakhstan on which return of means, bank account details shall be performed, on which funds shall be transferred.

Obligation fulfillment monitoring, and also actions for return of means for the cities of Astana, Almaty and Shymkent are performed by MIO (service provider) of these administrative territorial units.

In case of violation by producer of the obligations provided within the submitted application, the producer has opportunity to submit the new application only after accomplishment of the previous obligations (after return of subsidies for not kept livestock).";

2. To provide to department of livestock production of the Ministry of Agriculture of the Republic of Kazakhstan in the procedure established by the legislation:

2) placement of this order on Internet resource of the Ministry of Agriculture of the Republic of Kazakhstan after its official publication.

3. To impose control of execution of this order on the supervising vice-Minister of Agriculture of the Republic of Kazakhstan.

4. This order becomes effective since July 1, 2024 and is subject to official publication, except for paragraphs of the ninth, tenth, eleventh, twelfth, thirteenth, fourteenth, fifteenth, sixteenth, seventeenth, eighteenth and forty eighth Item 1 of this order which become effective since January 1, 2025.
