About modification of some regulations

The Parliament adopts this organic law.

Art. I. – The first offer of Item 6 of the Standard regulations on education and functioning of local and regional councils approved by the Law No. 457/2003 (2003, 998), with subsequent changes, to state the official monitor of the Republic of Moldova to Art. No. 248-253, in the following edition:

"The secretary of village (utility), city (municipal) and regional council is appointed by criteria of professionalism by the relevant council according to the Law on the state position and the status of the government employee No. 158/2008.".

Art. II. – Parts (2) and (4) article 11 of the Law on administrative decentralization No. 435/2006 (2007, 91), with subsequent changes, to state the official monitor of the Republic of Moldova to Art. No. 29-31, in the following edition:

"(2) the Administrative capability is considered adequate to the legal status of certain local body of the public power in case its administrative expenses do not exceed 50 percent of total amount of its income, assignments from the national taxes and charges and transfers of general purpose.";

"(4) Administrative expenses, own income and assignments from the national taxes and charges and transfers of general purpose are estimated by each type of administrative and territorial unit in the limits established by the Law on local public finance No. 397/2003.".

Art. III. – In the Law on local public authority No. 436/2006 (Official monitor of the Republic of Moldova, 2007, Art. No. 32-35, 116), with subsequent changes, to make the following changes:

1. Item u) parts (Article 14 to state 2) in the following edition:

"u) appoints according to the Law on the state position and the status of the government employee No. 158/2008 of the secretary of council, changes, stops and stops the office relations with it according to the law, delegates power primara according to professional achievements of the secretary of council;".
